I placed a refundable deposit on 10/30/24 in the amount of $300 to hold a vehicle at A1 Financial for 3 days while my wife and I considered our vehicle and financing options. The salesperson, ****** assured me multiple times that the deposit was fully refundable, regardless of whether I purchased the vehicle.Despite these assurances, I was later presented with a document to sign, which stated that the deposit would be retained if I did not take delivery of the vehicle. This directly contradicts the salesperson's verbal statements and constitutes misrepresentation and deceptive practice. The salesman repeatedly stated that the deposit "would come back to be if I buy the car or no." I was coerced into signing under false pretenses. Under Florida law, verbal agreements, particularly concerning refundable deposits, can be enforceable. Such misrepresentation may violate the Florida Deceptive and Unfair Trade Practices Act (FDUTPA). I relied on the repeated verbal assurances when making the deposit and signing the document, believing the original agreement would be honored.The salesman has stopped responding to my texts and calls, and I am out of options to reclaim this $300.Business Response

I am rejecting this response because: Verbal assurances were made and those assurances guided my decision to leave a REFUNDABLE deposit.I do not care what the website states, I was TOLD in person that my deposit was refundable regardless of whether I purchased the vehicle or not.
If the deposit is not refundable, your salesman should not have told me REPEATEDLY that the deposit was refundable.I did not sign any papers stating my deposit was non-refundable. If my signature exists on any papers that claim the deposit is not refundable, I was let to sign under false-pretense, as I was told verbally many times that I would get my deposit back.
If I was PROPERLY informed of the deposit NOT BEING REFUNDED, then I would have left the facility and would NOT have put down a deposit.
Please issue a refund check and let me know when I may come pick it up.

On 7/1/24, I presented to A1 financial cars and was assisted by *****. He told me I was approved for a 2014 ****** BRZ. I told the dealership I did not want to sign anything until it is confirmed that I was approved and can take the vehicle. They bring me the paperwork and were quick to collect the down payment of $1500. Right as Im getting ready to leave they will not give me the keys and said the bank had not approved the release of the vehicle yet and Id have to wait until the following day. 3 days go by and theres little to no communication from them. I called and texted every single day with no response. Friday 7/5/24 I presented to the dealership with my husband. ***** then tells me the bank did not in fact approve me and was coercing me into another vehicle. When I asked for my deposit back their response was we showed you other vehicles but you didnt want them and told me I had to wait for the owner, *****, to approve the refund. Another 3 days go by, Im still reaching out to them every day with no response. I post a ****** review explaining my experience within 30 minutes both ***** and ***** called me multiple times threatening to pursue legal action if I dont take down my review.Business Response

We as a company cannot deliver a car if the deal is not concluded by the bank, much less if there is any document that is being verified by the bank.
Two days passed when we had full communication with the client, it was even recommended that she get another proof of residence since there seemed to be some problem with the one she submitted to the bank, while the bank continued verifying we looked for options for other cars with other financing companies to have other possibilities if this bank rejected the loan, that is serving a client and looking for solutions, in no way is it forcing anyone to buy anything, the client told us that she did not like any other 80 car that we have in inventory, and that She preferred to continue waiting for the bank, then the bank notified us that it was going to cancel the day because the proof of residence, which was an electricity bill, was false, since they had changed her name and for that reason they canceled everything, because fraud, the clients were notified of this situation and they admitted having scanned and altered the proof of residence, which for us is an unacceptable fact and goes against our policies, our work ethic, the laws of the county, state and federal and most importantly against the morals and good customs of the Country.
The owner called the dealer to reach an agreement since we as a company have contract expenses, stationery expenses, work time invested and in our documentation and on our website it is very clear that the deposit is not refundable, much less if it is due to circumstances of fraud.
These people were kindly received by the owner of the dealer in his office and these people without saying any words began to record and say rude things and act like bad guys and look for problems by shouting, making a scandal and causing death due to this act on the part of the dealer. client and her husband, found it necessary to call 911 and ask the police for help. When the clients saw that they were calling, they left the dealership, got into their car and left.

I had bought a truck from them through one main financial.i paid my down payment and transfer fee and they are still holding my tags for another 300 dollars. I've had the truck almost two months now and the deal was finalized almost 2 months ago as well.Business Response

This person committed a crime and they took away his driver's license, and when the documents were sent to the *** they were rejected due to the violations that this person had, and he also had a balance of tols, all of this had to be clarified and paid in order to register the car and deliver your license plate, it is a procedure that does not depend on our company but on the client, after the client paid the *** his balance and obtained a valid Florida ID, the vehicle was able to be registered without any problem and it was I gave him his license plate.
We want to make it clear that at no time was the problem generated by our company, we are auxiliary to the *** in this matter and we only send the client's information and collect the money, but we do not have any decision-making power to ***** or approve a license plate. , the *** is the entity authorized by the state for these cases.

On June 2, 2023, I purchased a 2011 Ford F250 super duty. The down payment required was $5000 down. I only have $4000 down I was told by the dealership that I could give them $4000 and in two weeks to pay the remainder in $1000 I took the vehicle home that was on Friday, June 2, on Saturday, June 3 I attempted to use the vehicle at which I determined that the vehicle had malfunctions I called up the dealership. They asked me to bring the delay asked me to bring the truck back. I couldn’t bring it back on the fourth because it was on the on a Sunday and the dealership was closed so I return Monday morning , on 5 June 2023 at that time I talk to the owners of the place and they told me that they would check the vehicle out and see what they could do to fix it so as I was waiting and waiting and waiting. I finally got the phone call from the the finance nets people that financing the car and they was doing the verification and upon them doing the verification I spoke to the verification person and I told them that , the vehicle had mechanical issues at this point of the vehicle having mechanical issues the owners came outside Cousin and Ferguson and after about an hour more awaiting day they told me the deal was canceled so I love the vehicle. I took my belongings out of the vehicle and I and I went home without the vehicle so I only had a vehicle pretty much one one day with Sunday they I gave them a $4000 deposit on the paperwork. It says that I gave them a $5000 deposit and this deposit was for a down payment for the truck. I left the truck at the dealership since June 5, 2023 and my $4000 is being held without return and all I’m getting from the dealership is that I committed fraud. On July 14 I went to collect my money of what I thought I would get and the owners attempted to have me trespass from the property and I have still haven’t got my refund of $4000.Business Response

I never signed anything for the non refundable deposit. The signatures are not the same how does any business can just fell great about taking any money from a consumer I had possession of vehicle it was insured and all you can see the truck was sold to me it’s not fair to buy truck one day and return it with owners not willing to fix it they sold car to me with both ssn so it’s was not about the fraud it the truck has mechanical issue the letter fromJUAN M******* C******* Phone No* ***** ******** this is a agent if western funding would just tell you you would have to talk to dealer
how do you just take my family hard earn money don’t respond about fraud when you tried this deal with three financial company’s that were approved how do you sell cars that needs to be repaired
On the contracts they say I gave $6000
Your car lot show that I signed something saying I gave $4600 oweing 1400
I only gave you $4000 and you should not take it as you claim fraud or not
You can please give money back or sale a car that actually don’t have any issues
you really taking from my family if you just take the money like you trying to do

On 12/6/22, I went to the dealer "A1 Financial cars" to buy a 2016 Ford F-150 car which was financed by the bank "Veros Credit" an agreement was reached on the down payment for $4,500 which I gave 4,000 at that time and 500 to pay in 15 days, plus $195 for transfer, we signed contracts all fine, days later the bank contacted me because they needed proof of my address, which I provided right away. December 20 I received a call from the owner Ãngel, telling me that I had to pay them extra $1,600 because the bank deducted that from the check they received from bank, supposedly because my bank didn't show how much I've made of income from work which doesn't make sense because I didn't know I have to have all my money deposited indefinitely to get approved especially after I was already approved on Dec. 6th. I contacted the bank and explained what's happening and they tell me that the dealer shouldn't charge me $1,600 outside the deal without a valid reason which they didn't have either. So then tired of them threaten me with repo the car, I asked the dealer that if I paid them the $1,600, if that would go towards the principal of the vehicle or the loan and they said no, that that was for the dealer, like if I'm giving them an extra for no valid reason or proof of why they're asking for extra $1600 without reason when we already made a deal with different term to what they asking for now. Today I received a call from Ãngel telling me that I can call whoever I want, but the bank nor anyone else was going to tell him what he was going to do or not with his dealer, then in a threatening tone he tells me that if I don't pay the $1,600 even if I was in a payment plan then they would send a tow truck to lift my car, minutes later, his brother "Pedro" calls me telling me to talk to him instead, he tells me to pay the 1,600 in a payment plan, to which I didn't agree to and proceeded to tell him that after the car came out with many flaws they were supposed to fix and didn't.Customer Answer
