      i purchased a tesla model 3 from benji auto sales in october of last year. i have contacted them numerous times in attempts to get the paperwork and specifically the clean vehicle seller report so that i can have my own copy of the buyers paperwork and so that i could file my taxes to get the tax credit as per the conversations prior to buying the vehicle. they filed paperwork that says i elected to transfer the credit to them which i did not. they will not provide me the paperwork from the purchase and now today april 15th the will not answer my calls so i cannot file my taxes accurately to get the tax credit. there are many other things about the process of buying this car that have been very similar but to not provide a customer with the papers from purchase and preventing them from correctly filing there taxes is unfair.

      Hello my name is **** **** Im from ****. I purchased a vehicle with benji weeks ago.I traded my 2020 Glb 250 for the 2023 EQB 300. I received the car on the ******* sales person his name is *****. I do not know what the finance manager name was I worked with.I am very frustrated and annoyed with the customer service!My old auto loan company ********* has not received the payoff. And I have been calling every week and nobody has corrected this!2nd the paper license plate is going to expire on 4/11 on the new vehicle and I have not received metal plates and tags registered in **** in my name.I can not drive a car with an expired temporary plate!Please fix this for me immediately!!! And if youre unable to fix this please direct someone who can help me and have them contact me! I am very annoyed calling every day and being tossed around and nobody is answering! My sales person has ignored all my messages!I am currently 25 weeks pregnant with twins and this is the last thing I need to be stressed about!I need all this to be correct asap!If I need to take this up with someone higher up I will.       I am rejecting this response because: now I am finding out I have to do a vin inspection in order to complete the registration process! Why wasnt this told to me from the very beginning! 

      all this time was wasted when I couldve gotten that done ahead of time. 

      and I was not aware of a $4000 energy car credit for taxes? I dont see anything about that in any document I signed! I want that credit for 2026!

      However, my old car loan Santander Consumer has not been paid off yet! Now the payment is late! I already emailed ***** multiple times. Called multiple times! And I cant pay two car loans! I am not responsible for my old car when I no longer have it. 

      Also, I never signed anything to give $4000 for tax credit to the dealer for a purchase of an electric car. I need that removed! I never signed it I never was informed of it.

      This letter outlines illegal practices, misrepresentations, and safety violations by the dealership, as well as their failure to respond to my attempts at resolution. Summary of Transaction and Violations On March 1, 2025, I finalized the purchase under the following agreed terms: 1. Registration and titling to my Ohio address. 2. Provision of a full service record and inspection report confirming the vehicles safe condition (brakes, tires, suspension, battery, etc.). 3. Completion of minor repairs (rim scuffs, paint chip). 4. Removal of dealership specific service contracts from the final quote. 5. Timely vehicle shipment to my home. Dealership Violations:1. Failure to Provide Signed ************************ Charges Pressured into signing documents under false urgency (threat of losing the vehicle to another buyer). Received signed agreements only on March 12, 2025, revealing an unauthorized $1,995 "Maintenance Contract"directly contradicting our agreement. - Violates the *** Used Car Rule (16 CFR Part 455), requiring accurate disclosure of terms. 2. Undisclosed Vehicle **************** Risks Upon delivery (March 17, 2025), the vehicle had critical undisclosed issues: - Low-voltage battery error, preventing software updates and Tesla ownership transfer. - Three unsafe, mismatched tires (illegal in ****) and undisclosed wheel alignment issues. - Violates the ********-**** Warranty Act (15 U.S.C. 2301) and Ohio consumer laws, which prohibit selling defective/unroadworthy vehicles. 3. Failure to Provide Required Documentation - Delivered without temporary registration, plates, or title, making it illegal to drive. - Violates **Ohio Revised Code ******* (30-day title requirement). 4. Dealerships Refusal to Respond - Dozen+ attempts (calls, texts, emails) since March 1, 2025, ignored by management.

      1- Registration and Titling of your vehicle is in process. We are located in ** and title vehicles in another state takes longer due to us having to subcontract a third party tag agency in your state to process it. I double checked our records and your registration has been assigned to an agent on OH and it's being reviewed.

      2-All of our vehicles are inspected and compliant with  FL safety standards

      3-Our records show that your vehicle was sent to a body shop to complete minor repairs. Please keep in mind that these are used vehicles and are sold "As Is"

      4- If you wish to cancel any additional products please email ********************************** she will process the cancellation and refund will be sent to *********** (lienholder) and deducted from your outstanding balance.

      5- As previously mentioned we are located in **, it takes time to find a coordinate transport to another state. Also, your vehicle was sent to a body shop for minor repairs before being dispatched which caused a bit of delay. I understand this process can be frustrating but we work diligently on dispatching vehicles to our customers out of state.

      I am rejecting this response because many aspects of the original complaint were not completed nor addressed.  I am writing to formally follow up on my complaint dated March 22, 2025, regarding egregious violations and unresolved issues stemming from my purchase of the above-referenced vehicle from Benji Auto Sales (Broward, **) on March 1, 2025, and financed through *********** Auto Finance on March 3, 2025.


      Failure to Resolve & Lack of Dealer Communication 
      While your office acknowledged my complaint via phone call, the responsethat your Dealer Relations team is "still working to find a resolution with the dealer"is wholly inadequate. As of today (April 8, 2025), the dealer still has not contacted me to address: 

      1. Undisclosed critical defects (low-voltage battery error, unsafe tires, alignment issues)
      2.  Missing legal documentation (title, registration, plates), rendering the vehicle illegally undrivable 
      3.  Unauthorized $1,995 "Maintenance Contract" charge, in direct violation of our negotiated terms. 

      This ongoing non-compliance breaches: 
      - ************************ (***) Used Car Rule (16 CFR 455) (misrepresentation of terms/condition), 
      - ********-**** Warranty Act (15 U.S.C. 2301) (failure to disclose defects), 
      - Ohio Consumer Sales Practices Act (ORC *******) (unfair/deceptive practices), 
      - **** Rev. **** ******* (title delivery requirements). 

      Repair Costs as Potential Resolution
      If *********** and Benji Auto Sales wish to avoid loan cancellation, the dealer must immediately and at their sole expense:

      Repair all defects using a Tesla-certified facility, with the following estimated costs (attached):
      --Low-voltage battery replacement
      --Unsafe Tires replacement and address suspension check and related issues
      --Wheel Balancing and Alignment
       Please see attached:

      1.  Discount Tire quote dated 3/21/2025 in the amount of $1421.84
      2.  ********************* quote dated 3/27/2025 in the amount of $1,274.59
      3.  Paint/rim repairs per original agreement: $600 (Body shop estimate)

      --Provide all missing documentation (title, registration, plates) within 5 business days.
      --Refund the unauthorized $1,995 "Maintenance Contract" and update the lien holder/financing partner of the reduced financed cost

      All repairs must be completed by April 15, 2025, with written proof of payment and repairs provided to me. Failure to meet this deadline will result in immediate escalation.

      Notice of Escalation 
      If the dealer fails to resolve this matter by the deadline, I will continue to pursue legal action including but not limited to: 
      1.  File formal complaints with the ***** ***, Ohio Attorney General, and Florida DMV, 
      2.  Pursue legal action for violations of the above-cited laws, including treble damages under Ohios CSPA, 
      3.  Hold Benji Auto and ************************ jointly liable under the *** Holder Rule for the dealers misconduct. 

      This letter serves as final notice before escalation. I have acted in good faith for over five weeks;further delay is unacceptable.

      I purchased a 2021 polestar 2 November 29th,2024 and I'm still unresolved today March 15th, 2025. This is a list of all the issues I have had to dispute over time. 1) the vehicle was delivered it to wrong address almost 2 weeks after I paid 2) vehicle had no temp tag 3) came with chips in windshield 4) did not come with an EV charger despite being told I'd have one 5) they can't provide second temp tag because of an error on their part 6) poor customer service i became just a number in a filing cabinet after they received my down payment 7) I've made well over 100 calls to them over the past few months weeks and all I get is a "leave a voicemail", "we will get back to you", "I'll call you right back", "I'll leave a note"8) even the general manager was ghosting me not replying to emails or anything 9) they put the car in my co-signers name. I'm currently as of today still waiting on the windshield repair, I've had to send multiple quotes and renew quotes. And I still don't have the title for the vehicle

      I originally reached out to Benji Auto on Friday, February 28th as I was interested in purchasing a 2019 Tesla Model 3 (red) vehicle. I put down a $1500 deposit. My salespersons name is ****** *. I am very frustrated and fed up as there has been absolutely no communication whatsoever throughout this entire profess, and it has been weeks without knowing the status of my vehicle. I have reached out to the dealership more than a dozen times and I either get hung up on, re-routed, or sent to a voicemail box that is always full. At this point in time, I am demanding that I be refunded the $1500 that should be owed back to me as I have exhausted all possible avenues/ options.

      December 26, 2024 was the initial date of purchase. Following the purchase, the title and tag were not received for three weeks. After finally taking possession of the vehicle, significant issues arose, including problems with charging and software updates. Upon inspection at a local Tesla dealership, it was revealed that the vehicle is a salvaged total loss, a fact that was never disclosed during the transaction.This situation raises serious concerns regarding misrepresentation and potential violations of consumer protection laws. Additionally, because *********** financed the purchase and does not finance salvaged total-loss vehicles, it appears that the dealership misrepresented the vehicles status to the financial institution, further compounding the issue.Despite multiple attempts to contact Benji Auto Sales to seek a resolution, the dealership has refused to cooperate. Due to this lack of responsiveness, legal action is being considered, including but not limited to:Filing complaints with the states Attorney General, the ****************************, and consumer protection agencies regarding potential violations of auto fraud and deceptive trade practices laws.Seeking full reimbursement for the purchase price, financing fees, and any additional damages incurred.Pursuing litigation to recover damages, including legal costs and statutory penalties.Despite multiple attempts to contact the dealership, we have been met with no response.

      Ms. ******* already opened a complaint with the BBB and we provided sufficient proof that the vehicle was a clean title a not a re-rebuilt. Ms. ******* also opened a complaint with the FL DMV and the same information was provided to the state which reviewed the information and deemed that dealership was not at fault. 

      The vehicle was purchased from the auction without any damages  and as previously stated it has a clean title. 

      We were also informed that you opened another complaint with the FL DMV for the same issue under your name. We would like to inform you that re-opening a resolved complaint with the state under someone else's name could be considered fraud.

      Business falsified loan documents. Claiming I had put $5000 down and they adjusted the sales price by the same amount. They did this so the loan company ******** would accept the loan. They also did not disclose the car they were trying to sell me had 4 accidents on Carfax. They showed me My Carfax only regarding the trade in value of my car. I couldn't take the car home same day because it had so much wrong with it AND I couldn't find insurance for it. I figured I just needed more time to find more reasonable insurance. Well, since it was a Tesla with 4 accidents I couldn't find anything less than $700/mo. So, I left messages, both voice and text letting the business know I had to back out since without insurance the lender ******** wasn't going to complete the loan. I needed a co-signer for the loan, which is fine but the business actually made the cosigner THE Primary Buyer without their permission. She never agreed to that and when we asked before signing, the finance person said the car would still be registered and insured by me so it's FINE. Well the first bill came and it was in HER name, not mine.?!? They kept my $500 deposit, I have been asking for this back but they won't take my calls or return my messages.

      They absolutely falsified the down payment and I have the form attached to prove it.  This was NOT a 1 owner EV rebate eligible vehicle so there was no reason for them to mention that. On the official ************** information they claimed I put $5000 down AFTER they raised the Posted price of the vehicle by the same amount. This was done to fool he lender into accepting my poor credit and poor income.  The swapping Buyer and Co-signer info was also done to get the deal(proof attached).

      Finally, I have NOT received the $500 refund and ****************** is still calling me wanting Payment on 4/1/2025!  II would like to know when my $500 refund is coming.

      3/2/2025 Amount of Transaction: ******* To Whom it May Concern, On February 18, 2025, I spoke to a sales associate at the business whom I began making the deal with.I put a ******** dollar down payment on a vehicle. After filling out the paperwork I discovered that another vehicle of the same make and model was sold to me instead of the vehicle that was advertised.The associate assured me that the delivery of the vehicle would take between 3 to 4 days contingent upon the approval of the auto loan. The loan was approved on the following day (February 19, 2025). Today is 3/2/ 2025 and I have NOT received the vehicle.Last contact with the dealer was on February 28, 2025. I was told that the sales manager would contact me regarding the matter at hand, but they have yet to get in contact with me.       I contacted Benji Auto Sales through the *********** Auto Navigator application after being pre-qualified by the bank. I then spoke with a ******** ******* through text message.He proceeded to inform me that the vehicle I had inquired about on the phone application was already sold. He showed me several different vehicles by text message photos. I specified the criteria I was looking for which was an excellent exterior and interior condition Tesla Model 3 or Y with less than ****** miles and a clean Carfax with no history of rental fleet use.He showed me photos of a vehicle, the photos of which were actually a recording of a photo on his computer screen and not the actual images. Mr. ******* emphatically described the vehicle as "brand new" and in "excellent condition". I have the text messages to prove it as such. Given his assurance on the condition of the vehicle, I then signed an agreement for a financed purchase of the vehicle on 1/10/2025. Mr. ******* and his finance manager also pressured me to accept a $1295 appearance protection package despite my refusal. The package was originally pre-included at $3,000 until i complained about it's inclusion. In which case they lowered the amount but made it seem as if I was compelled to do it to keep the offer as-is. They also misled me into believing that the vehicle was already at the location of the dealership and told me to inform the bank I had the car in possession to approve the loan transaction. They delivered the vehicle 10 days late on 1/21/25 without any proper tags. They took another 25 days to deliver the physical plates. Once the vehicle arrived it was clear that the condition was far from excellent. The roof glass replacement was quoted at $1770 alone by ******************** and I've already spent $1670 on the tires and alignment.There are thousands of more dollars in paint and part replacements on the body damage.

      I was going to buy a Tesla Model 3 from Benji Autos and asked if there was any past damage on the car.. I was told there wasnt any past damage and so I sent my down payment of $3000. Come to find out I get the car history from another dealer and it shows that it was a salvage car and was repaired. They never told me this and I requested a refund. When I did the next day the manager texted me and said we dont offer refunds, but that is illegal because I did not sign on anything, he basically told my father to shut up and said dont be the reason your son loses $3000. I was in shock, now its been 3 weeks and I call daily nobody picks up and if they do they hang up in my face when I say what im calling for, this is very inconvenient for me because this was supposed to be my first car and I trusted them but i was lied to. I need my refund back there holding my money illegally and procrastinating on purpose, its just not cool. Even when they gave me no other option but to let the car get delivered they never even delivered it, so I dont have $3000 and the car isnt even in my possession, so there literally just scamming me and took advantage of the fact I am young and this is my first vehicle purchase. It is very sad that they are taking my hard worked for money for no reason. The managers are mean and disrespectful. Nobody knows anything apparently. I just want my money back I have all the proof of how they were talking and the promises they made in my phone, hopefully this works or I will take this to another level. This situation is stressing my entire family. I dont want there damaged car they are trying to give me, I want my money, and on top of that the hidden fees they didnt tell me about. The car says 21k but these dudes gave me a 24% interest on it so in 60 months they want me to pay 41k for a damaged car, they are scammers. I need my money.
