    A recent termination of spouse (coach) employment with Tainas VC has elevated to daughter being in a toxic team environment.Daughter has attempted to stay on the same team for over a month and environment has not improved. We have requested to have her move teams on several attempts but have been delayed due to management not available or unable to make a decision. An in-person meeting on 26Jan eventually happened but was asked by management to delay due to daughter needed on team for travel tournament (2-3 Feb) which we were happy to comply, with the understanding that the matter will be resolved shortly after returning from the tournament. Unfortunately, follow-on meeting request will not take place until 22Feb. Due to upcoming travel, I have started corresponding via email with management for a decision but have been refused a compromise and will only allow the move if contract for 2024-2025 season is signed, which we do not agree is an option. We have requested the release my daughter from the team due to team environment along with fair refund, but was refused on both account. Additionally, the management has isolated us on a few parent/team meetings that prevents us from explaining our side which is very unfair, and can be perceived as discrimination as we are the only non-hispanic family on the team.This process has been going on for about a month with no resolution, and hoping that you can assist in this matter.     Us like any club have a contract for coaches and players and those contracts are official by AAU and USAV VOLLEYBALL, and right away to see that they are not right they have not

    gone to them to get release because they both will tell them that there is nothing wrong with the contract, they cant go over it. They signed the contract for her to  play on 17 ****** white and her dad 

    sign to coach that same team. our player contract states the only way a player can brake the contract is if they move out  or get injured. Her dad  started to do meetings and talking unprofessional about the club and directors

    and he was release of his duty as a coach, and after that happend that did not have to do with his daughter contract, they asked to move her to our best team, the only reason been that the enviroment is toxic thats what they state

    I met with players, parents and new coach and deny any problem at all with the team, They even have picture of her having fun with players in the tenneesee trip. the deadline that they speak about making moves its saids in the contract

    Feb 2nd its  moves that the club decide to do, to help teams not what parents want. they signed to play on a team the team is going good, the real excuse is because the team is not winning, thats not a reason to ask for a change and thats why they are trying to use the toxic enviroment  I can have all players and parents as witnesses. once again this runs by *** AND *** Volleyball if we are doing something wrong in the contract they can contact them, but they wont because the contract is been follow, they are the ones that want to brek it>

    I am rejecting this response because:

    TAINA club is focused on the situation that happened with my husband which clearly shows that the concern is NOT that of my daughter's welfare. The constant insinuation that we as parents are the ones that want to move our daughter is unfair as we provide the best support my daughter needs, which was also commended by ****** during our January 26th meeting as she discussed with him the concerns she has while I provided my inputs as a parent. 

    We as parents have expressed that our concern is the welfare and improvement of our child and not the winning as stated by the club. Furthermore, the contract that was signed was with the understanding that my daughter will be in the ****** (highest level) team, but once practices/tournaments had started it became apparent that there were a handful of players that have limited and minimal volleyball skills (don't understand rotation/position responsibilities etc.) that should not have been at the ****** level, these concerns were frequently addressed by many parents on the team and was TEMPORARILY corrected by ***** due to parents complaining.

     The toxic environment stems out from her teammates telling her how much they along with their parents HATE her dad, and another player telling her she no longer will play her position, contrary to what the coach assigned causes friction with that particular player and drastically impacted her emotionally. Additionally, a few of her teammates have also translated to her how after her dad was terminated that ****** and many of the parents continued to talk (Spanish) about the situation and would laugh about it causing my daughter additional stress and discomfort during their practice. Despite of the facade that my daughter displays, we see how negatively the situation has impacted her, hence the request to release her from the club instead of moving teams.

     Looking at my daughter showing happiness after the team has won their FIRST game is merely basis of how she really feels, especially since she was playing the entire game the last couple of tournaments and even after notifying her coach on her January tournament that she would like to be substituted due to her shoulder hurting from previous injury, coach declined as available players are not as skilled.

    I have attached the text that the club has sent to my husband stating that they "hope in a personall matter there won't be any problem on ******* to continue with her team", which we had also hoped for but unfortunately it became compounding concerns, as my daughter no longer feels comfortable with the team and club with said comments and situation flashbacks.

    once again there is no violation of the contract, what she is saying about players and parents speaking bad to her is not true and will let parents know about this in case they want to do something about defamation, is just her saying to try to break a contract 

    I have many witnesses not only her word. The team is a top team, does a top team needs to win all the time not, because they are facing the best. After everything that Happend she travel with the team they played their best

    tournament and she was the only  player that played all games and in her usual position, so there is another lie. about the Spanish is also not true all players there speak English and we have an afro American player on the team that does not speak Spanish. we would never have any kind of Prefererences  because we the owners are minorities and in this club we help everyone. The biggest example is that we hire dad as a coach of one of our top teams.

    the only problem here is that they want to break a contract just because dad is not coaching no more at the club for breaking contract rules. And  once again the main  mechanism to work with is that they contact AAU and USAV but 

    because there is no violation of the contract by us, they wont do it. and to put an end at this matter that her dad made and now wants to blame someone else, if she emails us the release letter for her, We will release her but 

    but as stated by the contract and because no rules has been broken there is no refund to be awarded. We have been working for ten years with parents, players and contracts and is the first time this happens. they need read carefully contracts and make sure to follow them.

    I am rejecting this response because:

    The club has failed to provide a common resolution, and keeps resorting back to the basis of my spouse termination instead of focusing on my daughter's welfare.

    My daughter and I are willing to meet with the club, parents and players to eliminate the constant one-sided inquiry that the club have been repeatedly doing. However, I will need to know if the termination of my spouse will be brought up so that my spouse can be present to speak for himself to prove that this is not the reason why we are requesting contract termination. 

    Additionally, I request this meeting take place between 25Mar-10Apr as we are preparing to move back overseas and would like to close this chapter asap.

    Request BBB keep file open as I requested a meeting with club, team with parents to close out the assumptions on both sides.

    Also we have not received any forms for termination and feel that this may be overlooked.

    Additionally, I believe that in preparation to moving overseas this is the only way that we can get the issue resolved appropriately.
