I recently purchased my home and was blindsided by a phone call demanding an immediate payment of $10,000 in HOA fees. I was told that if I didnt pay, a lien would be placed on my property, putting my home at risk of foreclosure. There was no prior notice, no breakdown of chargesjust a threat hanging over my head. This is my home, my familys shelter, and now Im being extorted under the threat of losing everything. I am a member of the The Association of Poinciana Villages. I have had an ongoing dispute with the *** since 10/14/23. The *** has been adding late fees against me since last year for a moved garbage can that was moved when i was on vacation for a month for my daughter giving birth. When i returned home the fee was already at $1000 dollars. I requested a hearing, because I'm elderly and on a fixed income. I asked for a hearing i was denied. I offered to pay in installments I was denied. I was asked to prove extenuating circumstances that i was out of town which i did with my flight tickets. i called the office repeatedly and i could not get anyone to resolve it. i was just told to pay. Every thing i did was disregarded and overlooked and the board voted twice without my knowledge to keep this fee in place. Today 10/18/24 they denied my association fees. I was told it was sent to collections and they have no further information to help me resolve it. I am unsure how to fight this because the *** seems to have all the power. There is lack of transparency with the community member which make the problem hard to resolve. Please adviseBusiness Response

I did not receive any notifications in the mail from my *** (Association of Poinciana Villages) for the annual assessment of 2024. I did not receive any late notices from my ***. I did not receive any notices from my *** that my account *** go to collections. All I received was a certified letter on 5/20/2024 from *************************, PLLC stating I owed an *** assessment of $101.68, collection fees $200.42, attorney fees of $330.00, and postage fee of $13.33. I immediately contacted my *** about the certified notice and letting them know I did not receive any prior notices and they told me I would have to dispute the issue with *************************, PLLC. I emailed a (formal dispute) to the *** and *************************, PLLC stating that I did not receive any prior notices in the mail, but no one has responded to address the issue. *************************, PLLC just email me back on 5/30/2024 with an updated validation of debt with more fees (*** assessment of $101.68, collection fees $200.42, attorney fees of $580.00, and postage fee of $15.49, copy fees $6.00). My *** assessment fee is only $101.68 and they are trying to charge me more than quadruple. This is unfair collection practices on both parts of the Association of Poinciana Villages and *************************, PLLC.Due to the notices not ever being received from the ***, I am requesting *************************, PLLC remove this account from collections and send back to the *** and allow me to bring my account up to date. I called *************************, PLLC and the receptionist voicemail just picks up and no one calls you back.Business Response

For 3 weeks I've tried to get in contact with the Association of Poinciana Villages about my neighbor who leaves all his trash in the yard. At night raccoons are running around 2 to 3 of them. And the neighbors don't care. It's disgusting. Poinciana Villages doesn't care either. I've tried for weeks to have someone come to get my neighbor to clean up his trash. Nothing has happened. HOA cannot provide an annual HOA statement for my property address as requested from my mortgage company in order to finish an application for a loan modification. Been to their office multiple times. I was only offered a payment history ledger, which is not accepted by my mortgage company. I feel that they do not have a staff that is competent to draft a statement or they just dont care.Business Response

I Paid my *** fee 5 days later than usual. Recieve letter from the Association of Poinciana Village 2 day post payment. Charging me a $50 dollar late fee for a $25.49 bill. When I went to their office in attempt to resolve the issue. Not only was the lady at the office that I spoke rude. But she lied and said that I made a payment on 1/24. When in fact he payement was made on 1/20/2024. When I showed her the recipet showing proof of payment with a ************* stamped on it. She proceed to this regard my recipet, unwilling to listen to my complaint. Instead demanding avpayment. According to her $25 from the $50 late fee is a collection fee on a bill that was paid 2 days before their letter to me was generated. Informing me that I had made my *** payment late in the month of January. How is this legal? This Association is known to commit fraud against their resident and has been sued in the past regarding this same matter. The President of the *** *********************** have several lawsuits pending against him due to real estate fraud. And he seems to have a personal vendetta against me. Due to issues that I had in the past with him. Therefore I believe their action towards me is a form of retaliation. I just want to know how is it that this country allows citites from another country to do business in ***************** and commit fraud against tax paying cititzens. Because allegedly *********************** the President of this Association is a ******** cititzens who has been scamming ******** citizens out of their moneyBusiness Response

April 2022, I closed on my home in Poinciana. The lender gave them my 2 checks in total during closing amount of $1200.00. My fee's were only $747 leaving me a credit for $453, I continued paying in 2023, called when I got letters and even if a payment didn't go through I still went back and paid a total of $941.95, that plus the credit if $453 , ****, paid for the year they said I had NSF charges which I know I paid, however even if I didn't but I did fees for 2023= ****** , if i owed 120 in NSF that still leaves a credit of $278 dollars , but they sent My account to ****** and ****** and threatened to put a lien on my home ! Although they have been overpaid, and the debt collector refuses to even do the accounting correctly..Then they say they can't talk to us Although the *** representatives are the ones who made the errors, I can not understand why they are refusing to correct this ... even with the proof!!!Initial Complaint

This village of Poinciana looks more like a semi-truck parking at area as semis and trailers are being parked alongside the pond on Laurel **** two rows of six semis and trailers double parked in the grass, also semis are being parked in the so-called fire lane behind the houses on ***************. It is also noted does not appear to matter where you drive in Poinciana that semis trucks are being parked alongside of several roads. Is this what my and other residents Hoa yearly assessments are for to support semi-truck parking? This place is beginning to look like a slum village.Business Response
