      We closed on 12/31/2021. It has been nothing but one issue right after another since the day we closed. There were NUMEROUS issue we had brought to the attention of Butch(our construction manager) prior to closing and we received the same response every single time. We are in good shape, I will get that fixed, it will all be taken care of. At final walk we walked up to the house and we immediately noticed the shutters we pointed out at our blue tap walk were missing(these needed to be fixed to the house prior to the stone being placed). Our home was never pressure washed there was dirt on the side of the house/windows. The garage door did not close, garden tub was not set properly, we were missing weather stripping for the entry doors/garage, shattered microwave in kitchen, low hood in kitchen, backsplash not properly caulked so now cracking, damaged cabinets, etc. I emailed Dale the Area Construction Manager to see if he could help with many issues we were having and he did seem genuinely upset that our home was pushed along and there were so many issues and said they'd get it fixed. The warranty rep has attempted to get these issues corrected but it seems like it'll never get done. We have since had other issues arise including water damage from our master shower that has now made the house even harder to live in and work since I work from home. Instead of having DriRite complete the work they want to save money so we(the consumers/homeowners)have to wait with incomplete work until their "trades" can fix it for a lower cost. We've been in this home for 72 days, why are we having this many problems? Why is it other homes on the same street have trades there(plumbing/electric/paint) but we cannot get the things done here or seems like its a whole ordeal to get one thing done. Please just fix our home, that is all we truly want. We are living in a home that is still under construction basically. The process should not be this stressful!! We've been patient.

      I originally reported a leak coming from my downstairs A/C vent in August of 2021 which was two months after we moved in our brand-new home. I was told that it was our A/C return downstairs needing to be wider. This was cut and I was told the problem was fixed. It wasn't. A month later I saw more water leaking from the vent. I reported the problem once again and was told our filters were dirty (they weren't) and that was the cause of the problem was us keeping the air too cold (which is impossible due to my daughter having respiratory issues). However, this not being my area of specialty, I tried to adjust what had been explained to me. Christmas time came and we noticed our downstairs covered in water. I immediately contacted WestBay to inform them. They waited days to send someone out. Another A/C tech came out and told us it was not our A/C but a plumbing issue (this was the first we had heard of that). The plumber then came out and told us it was an A/C issue stemming from our condensation line. The A/C techs then came back out and told us this was not accurate, and it was definitely plumbing. The plumber then returned. He filled our upstairs shower with water to overflow. Nothing happened initially then a few minutes later water began streaming from our downstairs ceiling. He cut into our ceiling to locate the core problem and while doing so cut through a plumbing line. The water mixed with debris covered all of our furniture that left stains and residue that have not been able to be cleaned or restored. He went inside our ceiling and noticed water had been leaking possibly for months. Westbay sent a company called Dri-Rite out with humidifiers to dry our ceilings. I then contacted WestBay to see what the next course of action was. I was told that the repairs were minor and would take a few days to fix. That was wrong. WestBay dispatched Manasota flooring to destroy the bottom pan of our shower in order to see what was under our shower and where the leak w

      NOVEMBER 16,2021 CLOSING DATE AMOUNT PAID FOR THE HOME, $ 910,000. a pool that was supposed to be fully functional ,jandy system, with remote control, and salter set up properly ,including pool school ten days from date of closing. warrantee items that have not been addressed since our 30 day review. sprinkler systems, LOOSE ELECTRICCAL SOCKETS) second floor boards under the rugs squeaks, ( cannot get hot water from the sink in the faucet in the laundry room) front door rubber sweep on the front door broken) pull on the kitchen drew was glued on as it was broken.) has not repaired or fixed theses items, and has not provided us with the remote for our pool, that we paid for and the remote must be programed to the box that runs the pool.

      **************************************************************************************************************************************************************** Mold around all outside windows on patio:: told by warranty: its my problem.. I need to recaulk them yearly.. window caulk has mold and is cracking.. called warranty stated not their problem. 2. Cabinet fell in kitchen: drawer fell forward::: 180,000 in upgrades in home: told warranty 6 months ago: told by Brian in warranty department , "your responsibility not our problem" then texted contractor:: ignored.. had a cabinet guy come out.. drawer not secured to the wall.. by the cabinet people. 3. Had a leak in my laundry room: told by the contractor: don't worry about it.. don't call the roofing company.. unless it happens again: it was from running the steam in my dryer... thank god.. I called the roofing company and they came out::: 2 nails not properly placed on a shingle.. they fixed it.. problem solved... if I would have listened.. to your contractor.. I'd have rotten wood , possibly mold with a collapsed ceiling in my laundry room. 4. Ripped screen on cage of pool: snakes in pool Cheap screen: not applied properly... Called: they came: not repaired. I had to replace my entire cage screen:: $2700.. both screen patio doors, placed on backwards. 5. I paid for upgrades toilets in my home::: extra $800.... I got stock toilets.. missed by contractor::: so when I replaced all my toilets they caught it: and finally was refunded the upgraded money that was not used for correct toilet.... My toilets kept clogging.. now resolved. 6. Ceiling fan: living room: multiple fans replaced 3 times... still have problems with it.. 7. Floor tiles in living room loose... but home out of warranty... 8. Motor and modulator blown on my Carrier air unit:: freezing up... home not even 3 years old...getting that repaired/ possibly replaced 9. Ceiling plaster/coating in master bedroom falling off Resolution: 1- Fix my loose tiles in the living room 2- Re caulk all outside windows 3- Fix ceiling plaster/coating in master bedroom that is now falling off

      We purchased a brand new home from WestBay in February of 2020. We have a current two year warranty on our home and were advised to send any requests via WestBay's warranty website. One report consisted of both of the screw in plugs in the two bathroom tubs. Originally, both were the screw in type...one being severely scratched and the other so stripped that it would not stay up when letting water out. When the warranty representative came out, they replaced both with a different type of plug...ones that suction to the bottom of the tub. We were fine with these because they closely matched the hardware, and were functional. Fast forward to Oct/Nov of 2021, we discovered the flooring we had professionally installed a few months prior in our office (located behind the leaking bathroom wall) was wet. We initially thought our pet was having accidents which never happened before, but then noticed the planks were leaking water when putting pressure on them. We noticed started warping/buckling and eventually glue coming up through the slats and crystalizing. This was when we realized we had a major issue. We contacted WestBay on 11/10/21 and they sent a plumber on 11/11/21 and then DriRite came on 11/12/21 but neither could find the issue. On 11/17/21, it was discovered by DriRite to be the drain seal inside the tub... same one that was replaced by WestBay months prior and the seal had been slowly leaking for months. That same day, the plumber came back out and explained that they have would've had to replace the drain and the plug, that it was the wrong size to begin with, and that "WestBay has never used those plugs before and appeared to be from Home Depot". Their final report included pictures of our toilet sprayer and our shower head. No idea what that has to do with leaking tub, but we are under the impression they aren't willing to take responsibility for THEIR mistake when its documented the leak is from bathtub not being properly sealed. Leak still not fixed.

      Business Response /* (1000, 5, 2021/12/03) */ On 12/21/20 the plumber went to the home to replace the lift and turn part for the two tub drains in the home, not the drain assemblies themselves. They were scratched. While this is a cosmetic item and does not fall within the terms of our warranty we had them replaced as a courtesy. We use only Moen products. November 2021 homeowner notified us of a leak. We provided all necessary work to diagnose what was causing the leak. It was found that the tub drain assembly was leaking at the master bath. The product currently installed on the tub drain is not a Moen product and was not installed by our plumber. Unfortunately we cannot warranty a product that we did not supply/install. Consumer Response /* (3000, 7, 2021/12/03) */ (The consumer indicated he/she DID NOT accept the response from the business.) These drains were installed by someone who is affiliated with Westbay. When the individual came to install the drains he stated he didn't have the exact ones that were currently in the home, but did have something that was close. I stated that was fine along as they worked. Westbay is responsibly for the damages that have occurred and the damages that they have done since arriving. Westbay is very unresponsive to its home buyers. We want the drains fixed and the water damaged repaired. First thing that Westbay stated to me was to put it on your home owner policy. This is not the first issue with have has with Westbay on warranty issues, we have lost a freezer full of meat, a deep freezer due to electrical breaker that are recalled and they knew about. It has taken months for them to address issues. Westbay and their sub contractors are now saying that myself and my wife are lying about drains that were installed by them or someone they authorized to perform work. As stated before we want the drains to be fixed and the water damaged fixed. We are a few months from out warranty from being up with them and we believe this is their way of dragging out an issue till the warranty runs out.

      Issue: Listello design and real work are not the same. We designed the bath 4 listello with double band under the window that goes across completely as seen in the design photo that is attached. However, construction team built the following way where listello is cut because of window. They should have contacted us if they were not able to meet the design specification. However, they built it their way and no one contacted or notified us. Now, construction manager is refusing to fix the listello design. If windows is in the way then we would like to put one band of listello above the window and another band of listello under the window.

Dee, the director of the design studio, responded and declined the changes in the bath 4 as we requested. Her response is below. "Bath 4's listello is placed as per our agreement at the height indicated on the tile worksheet - 60" AFF. The drawing states not too scale and that all locations are approximate. It will not be changed." I dont accept her response. The design contract is showing the complete listello under the window. The design person should have known the window size. Also, construction team built it with cut in the listello when window is blocking. They didn't try to contact the buyer (myself) to discuss. In my opinion, this is not a small change. I paid for the design and I didn't receive the result what I paid for or agreed upon. This will cost me around $5000-7000 to fix if I hire the external contractor. I am completely not satisfied with the response and the way westbay handled this situation. As per the signed design documents, the drawings are not to scale and are an approximation. The listello was installed as noted at 60" above finished floor. She is throwing the fine prints of the contract to us. I didn't have the house blueprint and I didn't know how high or big windows was during the design appointment. The design person told us we can put the double band listello under the window. She drew the diagram showing that, which is in the contract. We followed the design person as she educated us on this. Second, if construction team wasn't able to build the bath 4 as per design then they should have contacted and notified the buyer and discussed the options. But, construction team decided to build it without contacting the buyer. Now, as a buyer, I didn't get the design what we were told during the design appointment. It is not our fault. We are asking westbay to build the bath 4 differently if windows is in the way. The director of the westbay refused to make any change. Plus, director of the westbay is throwing the fine prints of the contract to us to make the excuses. I talked to lawyer on this. The lawyer said that builder's contract is 100% favor them and there is no protection for the buyer. What are my options as a buyer when westbay denies to fix the issue that is caused by their design and construction teams? Should I complain to media or Florida government or some other organization? I feel like the builder can get away with anything and they make the contract to protect themselves.
