No show to Commence work. I would like my 50% deposit returned

    Business Response

    Date: 07/08/2023

I am here to reply to the illegid complaint of no show for work.  I am gathering all email and text messages between the plaintiff and myself to post for all to see what actually transpired with this client and her complaint.

To begin, the day of commencement of this project was on a Monday. I had a worker call in sick that morning immediately calls the client before 10 AM that morning to note of I heard that I was short one man and would have to reschedule for the following day.  Tuesday. She immediately stated. She went to cancel and ask me. Did I have her check. I replied? Yes I do I did not present it to the bake. It's still in my vehicle's glove box.  She then requested that I tear it up. Because she put a stop payment on it. I don't know problem as I have not even presented it to her. Bank or deposit in my bank account. I stated it was still in my vehicle scrub box.

Not sure what type of losses this client has suffered to file this complaint.  I replied to the client to inform her. I regret having to move her business, and thanked her for the opportunity to earn her business never less.

Again, I'll be more than happy to share all of the communications and emails and post them for all to see. That's what she said and what I say the nearest the truth. Everything will be possibly bodily to clearly see at no harm or malice. What theft I need deception or unprofessionalism with reflected to this client at any time.  Period I have done several jobs for her in the past as the reason why she was called me for the third job if I was on professional. And anyway, she probably would've called me back for repeat business.

To be honest, I was hesitant for taking the jobf to create a dog run, as she has several large dogs (Rottweilers) that were allowed to deficated throughout the entire back yard. And it was a bio hazard, and informed her that I would have to charge a biohazard fee if we were to clean up the enormous amount of dog **** in all the work area. If I was to work under these conditions. She stayed that she would clean it up herself.

I ordered materials for the job.  Out of my own expense, having not cashed her. check, the materials cost was paid at my expense and was available for me when I was to commence that Monday.

Again, I will provide text and email thread that will clearly show protocol was adhered to in a courteous and professional manner, and that the plaintiff suffered no loss of money, or handled in an unprofessional manner.

Inaddition, speaking with the plaintiff once again as she returned my text messages apologizing for having to reschedule for the following day.  She asked if I could add the additional work she wanted but could not afford it with her budget.  I was more than happy to try to regain her business.   I added 5 line items that she had previously requested which she said placed her outside of her budget.  The cost for these items were an additional discounted price of $500 where I showed it on the invoice, and at the same giving a credit for $500.  Giving these added items to her at no cost.  Also part of her request for me to re-earn her business was to also give her a 40% discount.   Yes, a 40 percent discount.   Which equated to $3200 on a $5200 job including the $500 additional work at no cost.  I should have been the one to file a complaint with the BBB for this request.

Inconclusion, I see no damages or loss here for the plaintiff.  And all communication thread will be posted for transparency for all to view to know the full truth behind this complaint.  Amazing how she never told this side of all the event which took place.  She won't , but I am more than happy to share them with all who desires to view the threads or even call me at ************ or email at ******************* to share threads directly.   BBB please share my full post to the public and let the readers decide for themselves.

Thank you for your time and reading my reply to not yield to these complaints where the full truth has not been shared with BBB and is readers.

I am rejecting this response because: One day project to commence at ****. Yard was prepared, cleaned and animals secured for the safety of all project workers at 0600.  I contacted *************** via text informing him of this.  ********** showed at **** and no communication from *************** at ****. I consider this unprofessional. *************** was to return my check, he stated it would take 30 days. It has been over 30 days and I have not received  my check. Please see attached.   Please ask *************** to return my check, as he was a no call no show.

My file is too big to attached. I will attempt to submit another way.

    Sincerely,
