      I was purchasing a home at ******************************************************** and the seller chose this title company. Per the contract on the home, the seller was responsible for the title fees. Excel title company bypassed my realtor and attorney and directly sent a Borrower introduction letter that stated in red ***Please Note that we can not begin any work on your transaction until this document has been signed***. I therefore signed the document to not delay the process even though #3 of the contract stated that Should this transaction cancel or transfer for any reason, and fees ( including settlement fees and title insurance) and/or cost (lien search, survey, etc) incurred may be deducted from the ******* money deposit and/ or charged. This language completely contradicts the sales contract that was available to excel title and did not accurately reflect the terms of the sales contract. The only reason I signed was because my contract explicitly stated the seller was responsible. My contract was cancelled by the Seller and Excel title proceeded to withhold a portion of my escrow instead of charging the seller as stated in the sales contract. I called and emailed excel title multiple times and Excel title never responded to me directly. Instead they provided insufficient documentation of the itemized charges that did not include receipts for work performed. Additionally, since the contract was canceled the *** would have refunded the estoppel but Excel still charged for this fee. Excel title behavior was predatory and their lack of transparency and response to myself as the owner is unacceptable.

      We opened this file on June 6th, 2023.  We did not receive the cancellation until July 1, with a closing date on the contract of July 12th.

      We use Qualia as our encrypted portal ordering and communicating everything through Qualia.  We are charged via credit card through the Qualia Marketplace.  Since this cancelled so close to closing,everything was completed on this file and the buyers were the party that could not close on time.  The seller could not extend the contract.

      We have our clients sign a document before we even begin work on the file to ensure if it cancels at the last minute, we are not stuck with out-of-pocket charges.  If it had cancelled much sooner and we hadnt received the items and been charged, we would have released the entire deposit.I have attached a signed Buyer Introduction Letter and most of the invoices that did not include our Settlement Fee of ****** and Title Search of ****** and we didnt charge the full title insurance of ******** which we are entitled to charge.

      The client states we held ******** which is not the case, we only held and deducted 2,159.00.

      I have tried to explain this several times and sent invoices as well.

      I am rejecting this response because: As stated we had until July 12th to close. I had a clear to close. The seller chose to cancel the sale- not me, the buyer therefore I should not be helped liable for the fees when the decision was the sellers. A detailed invoice with attached receipt for each charge was never provided to me.
      Per the contract, the seller is responsible for the title fees. Your contract contradicts the first contract that was signed and in place.

      July 12 is the closing date not the date for the Mortgage Contingency.  This was canceled a few days right before closing after the work was already done.  Please refer to the mortgage contingency in paragraph 8.

      Date of transaction: June8th, 2022.I am manager of ***** Properties LLC of **********, and we bought a house in ***** Florida at ************************************************************ using Excel Title I of Florida. They have made many errors and placed wrong address of LLC on the Warranty Deed for the house, when we requested to have them put correct address on the Deed, they rudely stated that it is not needed and hung up on us.The never mailed us copy of the deed as requested otherwise we would have identified wrong address earlier.I cannot imagine how a Title company can state that incorrect address on a deed for the property is "OK'' and refuse to correct their mistake

      I spoke to the client and advised them that the Deed conforms and has no errors. The mailing address on Deeds has nothing to do with the validity of the Deed or anyone sending mail. I gave her the phone number of the county so she can confirm with the official records. The Deed is correct so there is nothing to correct.

      They made a mistake by putting wrong mailing address on the deed. Resultant to this, we are losing official mail and at risk of losing legal documents in mail in future. We are already late on HOA payments because of this. It can give rise to legal liability in future. Since it is a mistake made by Excel Title, they need to correct it to reflect correct mailing address in the deed.

      The Deed is correct.  She should not receive any mail on the address on the body of the Deed.  The Deed is valid and I recommend they contact all State entities to confirm.

      Mailing address listed in the deed (for ***** properties) by Excel title company was wrong. They had operating agreement & correct mailing address for ***** properties in their possession & still made this mistake. Least they can do is own up to their mistake & stop saying its correct.

      I listed my townhouse (**********************) with ************ realty and I was told if you want to avoid extra costs you need to go with our title agency (Excel Title). I found a buyer but after about 2 months,the buyer apparently had to go through divorce and backed out from closing . Since the closing did NOT happen I was supposed to keep $3000.00 initial deposit which was held by excel Title in their escrow account. Excel title refused to release my funds ,and presented me with an inflated closing cost ($4867.80 for a small townhouse) which did NOT even go through closing, title insurance purchase, etc. I contacted the Excel Title multiple times and they refused to release my escrow funds. I would like to file an official complaint against Excel Title and its owner Stephen K. H. for not releasing the escrow funds.

He did not pay ANY fees to Excel Title. Excel is entitled to deduct fees from the EMD per contract for services rendered. Excel title did not buy Title insurance,etc and withhold the $3000.00 escrow deposit even though the CLOSING NEVER HAPPENED ( It was cancelled by the buyer before closing date). my house was out of it's rental income and off market for 2 months and the escrow deposit should have come to the seller since the sale was cancelled by the buyer. Stephen ****** which was pushing the deal to Excel title has the ownership/interests in both Flat fee MLS Realty and Excel Title which is against RESPA rules. I need a detailed cost of my closing cost BEFORE THE CLOSING ( SINCE THE CLOSING DID NOT HAPPEN).       Horrible experience. We had a closing date 2 months and 20 days after the offer was accepted. The buyer's wording was "closing on or before April 20". Excel Title , sent a request for an Estoppel in February (without informing us) and then another one after the first one expired without asking the parties if the April 20th date was moved or we agree to multiple Estoppel. We received a charge of $1010, which is unacceptable

It is not our fees it was the fee to the condo associations that charge the fee. We could not disclose this when he first signed up with Excel as we had not yet done a title/lien search. It does not address the issue. The Excel Title company sent a request for an estoppel on the same day the offer was accepted, even though they knew estoppels expire in 30 days and our closing was in 2 months and a half later. So they requested and charged us a second estoppel. Normally the title company should have asked us if we agreed on a closing date or not if the date was not clear. Due to the pandemic and housing boom, all searches are taking double the time to be received. This client complained and questioned all fees and all terms. We have over 150 5 star reviews with a 4.7 rating and have never run in to a client like this. If they continue this harassment, I will have no choice but to have our counsel/owner of the Title Company Attorney ******* ****** involved.

      This Title company was acting as Title company on the sale of ***********************************. Seller was ********* LLC and our company **************************** had a invoice on the closing which seller had accepted and it was also in the HUD,,,closing papers but Excel Title company has not submitted this amount of $ 2840 . Closing took place 10/18/2021 so almost 3 weeks ago. When we are contacting to the Excel Title company they are stating that they sent the check on very same day. They did have also out bank account info. So we are still expecting to get the funds which belongs to our company paid immediately.
