    9/13/2024 I contracted with **** to arrange shipment of my 2023 Viaggio R22L Pontoon Boat. **** contracted Four Runner Trucking to transport the boat from *******, ** to *******, **. The boat arrived damaged as it had been strapped to the trailer crushing the Bimini Top support, mountings and wiring. **** would not file a claim with the insurance company. I filed a claim with **************************** which was denied due to exclusions.Under DAPA'S advice the boat was transported on an inappropriate trailer and DAPA did not adequately assure the insurance policy would cover damages.Cannot or will not provide a Bill of Lading

    Hello,

    I am attaching the contract with the shipper "*** ******" we shipped his boat using the proper equipment to do so, the boat got loaded and unloaded without issues! Our agent did all he had to do to make this a smooth transaction he even called *** the day that this was delivered and he did not mention any damage to the load. 

    3-4 weeks later *** calls and complaints about the boat being damaged by our driver, which is a complete lie! It can't take someone almost a month to noticed something they bought has damage.. Our guess is that it was used during that time and it got damaged and they want to get it repaired at our expense. 

    We provide insurance on every load we moved, I also attached the certificate of insurance for your reviewal, it's valid, it has cargo and liability insurance. 

    There was a claim with insurance submitted and it was denied upon reviewing the case they decided they are not covering it because it makes 0 sense. 

    Also, please review our contact throughly, it specifically says we are not to he held responsible for any damages during transport because we are obviously not present and that is why we use the carriers insurance.

    This email is in response to your letter dated December *******. I have attached an outline of the timeline, which I furnished to DAPA weeks ago, as well as photographs showing how the damages were difficult to notice, provided to ***********************************
    Included is a letter from ************************************ explaining the reason for denial: the NATIONAL LIABILITY & FIRE INSURANCE COMPANY policy does not apply due to exclusions for marring,scratches, and shifting cargo (which makes NO SENSE). Additionally, Ive attached a letter from DAPAs *** & ******************** Services,Certificate of Liability with interesting comments.
    Their assumption is that the boat was used and thats when the damages occurred. In the *****************, boats are typically taken out of the water from October through April. The boat was not used during this period, which can be verified by contacting several neighbors if needed. Ive attached photographs of the boat loaded without damages in *******, **, and photographs showing damages upon its arrival in *******, **. PHOTOGRAPHS DONT LIE!
    The boat was loaded and unloaded without issues. I have pictures showing the boat being loaded adjacent to an embankment. I called DAPA on the day it was delivered to explain that the trailer selected by **** did not have adequate ramps to offload the boat. It took 4 hours and cribbing to extend the trailers ramps.
