April 28th 2022 I paid $4,999. to Fed Biz Access for the purpose of getting 8A Certification which would allow me to get Federal Contracts for a 9 year period. For over a year I was providing my Business information to my then ************************** I have attached the emails sent to the representative (attached to the receipt) where she suggested putting my account on hold. They kept sending me more paperwork to fill out which was not a part of the original agreement paperwork, with no progress. This continued for 2 years Fedbiz did not complete the contract as promised. I asked for a full refund and all of my paperwork returned.Business Response

The order represents an 8(a) certification order placed at a considerable discont accommodating the client or on about April 28, 2022. The order is not a subscription product. As customarily with such orders, our fulfillment department worked diligently and consistently to process the required paperwork to attain the certification status on behalf of the client. Although that process was ongoing to the satisfaction of our fulfillment department complete with QA assessment, we insisted on the production of two REQUIRED financial documents from the client to ensure compliance with the government standards and requirements. The client wanted additional time to produce such documents, and after a considerable amount of time we placed the order on Admin Hold in order to satisfy our internal policies and preserve the order status. We even offered to apply the REQUIRED financials to a new application so that all submissions were current. The client refused to produce the required documents and asked for a refund instead, contrary to the terms of the order and the cancelaltion policies (attached). Our team has performed the work required for the fulfillment of the order and in complete satisfaction of our terms and conditions. Our offer still stands to the client to submit the current REQUIRED financials, at which time we are willing to fulfill the order a second time, at no additional charge.Customer Answer

As we have previously communicated to the client, the government requires current financial and operational statements, as well as requiring that their questions (clarifications) on such financials and other pertinent documents (such as, confirmation by the client of the true and accurate nature of such financials),be answered accurately and timely. That also includes requests by the government to update such financials as requested by them and their recently upgraded platforms. This is not something that is controlled or initiated by our company as a third party provider; we take good care to reflect the guidelines and requirements of the government in order to secure a successful filing for our client. *********** has been in business with good practices for over twenty years, building the required good reputation and trust with our clients. This can be verified by the hundreds of 5-star public reviews across several different platforms like the BBB, ******* Trustpilot and others. Our employees are bound by confidentiality agreements and secure company servers and cloud services in the fulfillment of all services. In fact, we have offered over and over to safeguard this client's interest in the fulfillment of their order by placing them on Admin Hold until the requested current documents are produced, so they dont have to start over in the future. We have also recently extended the offer to include other beneficial offerings to this client utilizing the same requests for current documents by the government, so they can achieve additional benefits. However,we cannot submit inaccurate or incomplete/outdated information that would only result in a negative outcome for the client. I was working with a company to learn how to get government contracts (GSE). Then I got a phone call from FedBiz. Sales Rep ************************ he was selling me "upgrade services". I agreed to $1499, but was charged $1500. Then I contacted GSE, and asked why they are charging me after I was told I had paid everything. GSE told me FedBiz was a different company. I contacted FedBiz and asked for a refund, adn was told I had signed a contract. I explained that I thought I was talking to GSE. I contacted my bank, and they have disputed the charge, I need the $2000 back from FedBiz. Thank you.Business Response

The customer placed the referenced order in the normal course of business acknowledging the order and fulfillment details with our company. After speaking with an industry competitor the client said they made a mistake and requested a refund. The refund process required the disclosure of our terms and conditions which we performed, and the subsequent refund action which takes three to five business days to appear with the cardholder's financial institution. However, we were also notified that the order was charged back and the customer's credit card had been cancelled, making a refund action technically impossible. We explained to the customer that the chargeback acts as the refund action, and we could not take any further action to effect a credit any faster. The credit will be posted in the normal time frame of the customer's credit card company chargeback process, which we have no control over. I contracted a company to help my company to get a Cage code thru the government to help me get a contract to do work for the government and there salesman knows how to sale only The salesman told me he could help me get my cage code and then help me get a contract with the government and I did my research in this company and they seems legit but they lie to me and took my 6k and I got a over price cage code for my troubles that I can get from ********** for FREEBusiness Response

Customer did not pay for *** **********************; He paid for marketing services and design services including government contracting data points annual subscription for access to information on upcoming bids and solicitations, complete with a FREE renewal of ***. Customer received all services for almost a year now and complained at the time of renewal that there was no contract awarded or benefit derived. When we offered to extend a free consultation to see where the customer may need assistance, he declined our offer. Our services do not guarantee any work awarded, they are marketing and design services as aptly and accurately represented on our website, advertisements and monitored communications with our clients. 10NOV2023 Contacted VIA text by ***** asking me if I received an email from *****. I reply who is this at this time they reply This is ***** from FedBiz Access. Thanks for checking out our email. Are you preparing your business for FY24 spending? Now is the time to proactively market your company to the right government buyers. Do you have some time over the next couple of days to discuss?I decline and request to be removed from all contact from their company. Soon as they receive the message from me they reply back still soliciting. From the other complaints filed. FedBiz Access has been contacting me to solicited their services, even after I asked them to stop. FedBiz Access targets small businesses by making themselves appear to a federal government agency. FedBiz Access extorts money under false pretenses by leading businesses to believe they are doing business with a government agency. Many small businesses want to have the federal government as one of their clients and FedBiz Access uses this as a "hook" to extort small businesses. They send businesses official-looking emails (which will be readily shared, in order to protect other businesses from harm) that cite violations to various laws and rules, which results in small businesses paying FedBiz Access for services that they do not need.FedBiz Access has been recently trying to scam me out of money. *********************** and *************************, on behalf of FedBiz Access, sent me multiple emails, telling me that my business profile is not complete (despite ***.gov validating my business and wouldn't have done so if my profile had omissions). They sent official looking emails, telling me that my marketing profile has omissions and government buyers will exclude my business pursuant to Rule 19.202-2 (again, I will show you how deceptive these emails are, as I am sure FedBiz Access will try to downplay their wrongdoing). I provided copies of their emails to my accountant and lawyer. Both advised me of the fact that FedBiz Access violated many laws and encouraged me to file complaints with the BBB, and other federal agencies, as they expect to see FedBiz Access become defendants in a class action suit for unfair and deceptive business practices. FedBuz Access should NOT be contacting small businesses, especially with misleading and deceptive language. Yet, despite the fact that I continue to ask this PRIVATELY HELD company to stop contacting me, they continue to send emails to me, telling me that I am in violation. We are a full service consulting firm and we proudly observe commercial B2B anti-spam rules in our email marketing campaigns, including advertisement disclaimers, identifying information including name of our business, physical address, our .com website (clearly not a gov website), and visible and immediate unsubscribe options for recipients who do not wish to take advantage of our services. Several emails from the company came into my account regarding my small business was being notified that it was not in compliance in a Government database. In the email it was stated that new government relations required small business to be certified through a third party agency. The certification process no longer allow self-certification from business owner and my small business would not qualify for any federal contracting or funding according to the assign cage code. I contacted the company to verify that the statement in the email was true and was assured they could assist me in the certification process. After receiving funds from the Small business administration, I moved forward and contacted the company and was told by the representative that it was a great investment and was charge 3,499 in order to complete the WBE/WOSB certification. I later contacted the representative to provide more information of why it cost so much to me certified and I was told that the process can be rigorous and it would prevent my company for participating in the new funding money following the pandemic. I explain that consult other potential entrepreneurs and needed to know what exactly is within the certification process that align with the cost. It was explained again that most individuals give up because the process is so difficult and a third party can complete the process more efficiently. I sent more documentation and had to call the Texas Secretary of State to explain documentation provided was rejected by the certifying agency. While getting certified, I was told to complete a capability statement and it was best to pay the $900.00 fee while the certifying process on in motion. After, resubmitting documentation repetitively I was told that the certifying agency may still need more documentation that it would take more time to complete. After 3 month, not certified due to misrepresentation of information. My bank stated 120 days liability has passed, & contact BBB.Business Response

Client filed for a refund request for services completed opposite the terms and conditions of our agreement. Any issues with the certification process regarding the clients specific file details can not be disclosed publicly however have been discussed with the appropriate certifying authorities and unless the client is willing to provide any further information to benefit her accounts' standing, we are unable to help them further. The case was also referred to the clients credit card company in the form of a chargeback which the Company has won after submitting all evidence on the record. The client then proceeded to file a BBB complaint in retaliation, again opposite the terms and conditions of the agreement regarding the services provided. The services contracted and the charged amount conflicts with the client's request. The client and specialist for Fed-biz maintain excellent rapport. The intention of this complaint is to acknowledge the need to assertively communicate the issue. The miscommunication sent in the emails resulted in a critical decision to invest company financials that did not aligned with the company budgeting terms. This experience ended with the company suggesting acts of the client to retaliate, the small business was effective by the pandemic and in no position financially loss of $4,400 funding capital. How was this company helping the company in it's journey with no accountability. The resources available to perform the services could have been performed by the the client instead to responding to urgency emails stating the small business is not in compliance, no self certification is allowed etc. , The client's accounting responsibilities and utilization of available resources from the state has been sufficient and monitoring prior to the experience with the company. The client is on the record with the Company actually accepting the service in satisfaction. Any financial difficulty that may have affected the client independent of the service provided is unrelated to the efforts of our Company, and it is misrepresentative to attempt to assign any such circumstance in response to the good faith efforts of our representatives in assisting the client. We have explained and communicated with the client on numerous occasions but because the client's file is not subject to a refund (services have been provided), it is the accountability of the client that we bring to question. These charges have been successfully defended with our credit card merchant as well, providing additional confirmation from a third party independent reviewer of the instant case. We continue to wish the client well as we have all throughout our interaction despite what we have experienced from them in return. The client spoke to the certifying agency and it was agreed that the information in the email-marketing tactic was incorrect. Even though the company has a right to provide services to assist small business owners new to the federal marketplace, it is not practical to mislead the client. As a business owner seeking b2b services, it is imperative that accountability is important. There have been several complaints regarding similar encounters and loss of funds. The company has not shown any account of the services for the 3,449 credit card transaction.
