    On September 29, 2022 I met with ***************** of A Seed in Time Tree Service LLC to get an estimate to cut down a fallen tree from the hurricane in my back yard. He told me it would cost $1,900. I gave him the $100 deposit and he said they would email me the receipt. He told me the dumps were closed, I said they could put the debris in my back yard until they could come get it, he agreed. On September 30, 2022 the crew came and cut the tree down and after the tree was cut down, I paid the balance due and ***************** said they will email me the receipt.On October 13, 2022 I called ***************** and left a voice message that I needed to talk to him about my tree. He returned my call and informed me that I did not pay for the tree removal and they would not be returning to remove it. On October 13 2022 I talked to *************************** and she told me that ***************** had given me 2 prices, one for just cutting the tree down and one for cutting the tree down and its removal, that was a lie. There was no second price given. She then informed me that I was sent an estimate with the statement that the debris would be left, I didnt see that estimate until after I got off the phone with her. I was not informed that was sent like I was informed that the receipts were sent. I was never given the opportunity to see the estimate to sign it.

    On September 29, 2022 ******************** was verbally provided 2 prices, which have been confirmed by 2 of my employees.  ******************** was given a price of $1900 which included the removal of an oak tree located in the back right side of the home; leaving the debris on the property.  He was given a price of $2300 which included the removal of an oak tree located in the back right side of the home and the hauling of wood and debris from the tree removal.  ******************** agreed to the price of $1900.  Due to the hurricane and emergency jobs were receiving calls about, we asked ******************** for a $100 deposit to lock in his job which he paid.  The estimate was emailed to him on September 29, 2022 which is attached.  A text message was sent to ******************** from my Sales Manager, *****************, telling him the invoice was sent.  On September 30, 2022 ******************** sent ***************** a picture of us being on site performing the removal, which was the day the removal was completed.  On October 13, 2022 my business partner, ***************************, was informed that ******************** had a conversation with ***************** demanding that we come pick up the wood/debris that afternoon and he was not paying the additional $400.  The amount was reduced to $300 and he still refused to pay for the debris removal.  ***** was also informed that ******************** used some profanity when speaking with **** as well.  ***** called and left a message for ******************** that day.  ******************** called on the 14th and had a conversation with ***** regarding his conversation with ******************  ******************** denied using profanity and denied having been given 2 prices originally.  She told him that the estimate he received via email clearly stated "Leaving debris on property".  He claimed in an email dated October 13, 2022 that was the first time seeing the estimate.  He said the deal was made verbally when he made the $100 deposit.

    The $1900 that ******************** paid was for the cutting down (removal) of the oak tree on his property which did not include the hauling away of the debris from the removal.  He also would have been told that an estimate was going to be sent to him via email as that is standard protocol with our estimators and sales personnel.  We provided our services and cut down (removed) the oak tree from his property, I don't agree with providing him a full refund as what he is disputing, he refused to pay for.

    I am rejecting this response because: Its a lie. They gave me one price, not 2. I never was shown an estimate to view or to sign. Because they said the dump was closed, I told them they could leave the debris until they could retrieve it, they said okay. I enquired how they would remove it and the ******* said with a grappel machine small enough to fit through my gate, so removal was established.

    I was unable to find their license on the State site. Their lack of PPE would greatly interest OSHA.

    A woman representing "A Seed in Time Tree Service" came knocking at my door with a flyer. I told her I would like an estimate for trimming my trees. A company salesman (***) shows up shortly thereafter, and I proceeded to tell him what I wanted done. He said trimming the trees that much would be harmful to the trees" so he provided me with a signed proposal for what he would do at a cost of $4000.00. I approved the proposal and we agreed on a scheduled date for the work. *** shows up on the day of work and appears to be waiting for his boss, ******. ****** walks the property and immediately says we can't do what is on the proposal. ****** then tells me what he will do (which is considerably less than what was agreed to on the proposal). I said OK to the reduction in work for the $4000, but then he said that he had to check with the female owner of the company (his ex-wife). He comes back in a few minutes saying he would do the reduced work that he agreed to but for $6000. So the original proposal was not backed up by the company plus they jacked up the price once on site. Their flyer says they offer veteran and senior discounts, but ****** said they could not give me a discount on the original signed proposal. Typical bait and switch operation.

    We apologize for the experience ************ had with our company.  **************** comment "typical bait and switch operation" is an unfair statement towards the company.  The proposed cost of $4000 was low considering the scope of work ************ wanted completed on the property and the estimator should not have offered that price for the job.  We will not do any type of work that is harmful or will cause damage to a healthy tree.  ************ wanted to top the each of the Oak trees on his property and that would have caused damage to those trees.  The scope of work on the contract included work to be done on 8 trees on the property.  Even with the change in scope of work after ****** walked the property with ************, the quoted cost of $4000 was still low for the amount of work that needed to be done and that is why it was increased.  We did not do the work as the contract was cancelled.

    I am rejecting this response because: I had a signed proposal from an experienced salesman from the company. The owner came on site on the day the work was scheduled. He increased the cost by 1/3 and reduced the work to be done. The contract was not cancelled by me. I was willing to have the work done as agreed to on the signed proposal submitted by the salesman. The owner of the company refused to do the work on the proposal that was signed by the salesman and cancelled the contract because I refused to pay 1/3 more for a reduced amount of work.
