Case #: **************** filed in *****, TX, ******* County: Court ID *******. I need to try and settle this old bill but the attorney is no longer working at the law firm that was hired by MSW Capital. Even when I called the attorney's office they can't give me any information. I need to get this cleared up ASAP as I am trying to clean up my credit. HELP.Business response

We do outsource the debt to our collection agencies and collection law firms to handle the debt with our customers. This debt specifically was sold to ****************** Group (***) back in May 2017. Because the debt was sold we can not handle any negotiations on this account. You would need to reach out to *** to directly discuss the judgment with them. In 2008 I opened up a credit card with ********** bank. There was a balance that needed to be paid off which I settled and paid with MSW capital back in 2013. I am now getting phone calls from a law office stating that the account has not been settled I have called the ************** telephone number several times and do not get an answer. This needs to be resolved . I am not going to pay money to a debt I already had to pay offBusiness response

In your BBB complaint you stated that are being called by a law firm in reference to a debt you previously settled. MSW Capital, LLC is a passive debt buyer meaning that we purchase debt which has been defaulted on due to non-payment. We do outsource the debt to our collection agencies and collection law firms to handle the debt with our customers. The debt we purchased from ********** Bank (Original account # ending in Your account ****) was purchased in June 2011. This account was handled by ******* and was settled back in 2014. The final payment of your settlement was made on July 30th, 2014. There is no legal right by any law firm to be collecting on this debt. It is not a law firm affiliated with MSW Capital, LLC because the law firm which settled this debt for MSW Capital, LLC back in 2014 is no longer in business. If you are being contacted by a law firm or collection agency reference this debt (which the original account # ends in ****** please do not pay as this would be some type of scam. Many scam or fraudulent businesses can obtain your original information on the debt by searching court records unfortunately. We apologize this situation has happened to you. We have heard similar situations over the past few years for victims which may have been taken advantage of. To confirm, this debt has been paid to MSW Capital, LLC back in 2014 and although it's been paid, we have not sold our rights to this debt so therefore no other entity can ever collect on this debt again! My office did attempt to reach out to you a few times within the last couple days but had not left any messages and would rather have spoken to you directly to address but at least this avenue gives us a chance to resolve along with the BBB. Our goal is always to try and assist every customer in resolving their accounts in accordance with the FDCPA and all other Federal and State laws and guidelines. In your BBB complaint you stated that you have paid your collections debt on account ********** and the judgment is still showing on your credit report. MSW Capital, LLC is a passive debt buyer meaning that we purchase debt which has been defaulted on due to non-payment. We do outsource the debt to our collection agencies and collection law firms to handle the debt with our customers. The debt we purchased from ******************* (Original account # ending in account ***** was paid off in 2019. This debt was being handled by ****************** who did obtain the judgment in 2018 on behalf of MSW Capital, LLC. As stated, the account has been paid off and we have reached back out to the law firm to confirm the judgment has been removed. We have no part in that process because we are not the law firm that secured the judgment. They should have provided you paperwork upon payment that shows the debt was paid and typically within a 60-90 day period the judgment should have been removed. I would like them to confirm that with me and then I can let you know for sure. Have you reached out to them to confirm whether that process was done previously? I spoke to ************ the advised they have no information for me in the system an told me that it's in y'all's system. MsW is the one on the paperwork including the court judgement an the resolution which is attached. It also shows MsW with the judgement not ************ so it's your responsibility to update it. As stated in our original documentation to you it is not MSW that updates the court information. We are not an attorney, and our attorney handled all information accordingly and correctly. I will attach the documentation which I obtained from them this week that shows they filed all necessary paperwork with the court back in 2019. We can't speak for the courts and why it wasn't updated. Once the debt was paid/settled you also should have been provided the same paperwork, but I do understand this was done years ago and maybe it's been misplaced. We have asked our law firm to assist you in this situation and our law firm did contact the court this past week and again asked that they update all their records to show this is satisfied. They did have the records from the law firm as expected so it could be a simple updating error within the court electronic system. The actual Circuit Court judgment was also released 6/17/20219 under # XXXXXXXXX. I have called MSW Capital multiple times since September and no one is returning my calls. This loan was sold to MSW Capital by *************** some time ago and I am trying to satisfy the loan with them but to no avail. The system prompts ask me for my social but it keeps saying that I am entering it in incorrectly. The vehicle that I put down as collateral is now considered a total loss and cannot settle without satisfying this unsecured loan. This has been going on since 9/4/21 and has moved no closer to resolution since this first began.Business response

********, I have reached out to this company numerous times to no avail. This account was fraudulently opened and an investigation was done years ago and the company was forced to delete once the investigation was completed yet the Leon never dropped off my title. This is insaneBusiness response

In your BBB complaint you stated that this account was fraudulently opened, that an investigation was done years ago and the company was forced to cancel the debt as well as not being able to get in touch with MSW Capital, LLC to rectify the situation. We apologize in the delay it has taken to respond by us; however, due to the ongoing pandemic, we have had to make drastic cuts to personnel over the last year so certain processes are taking a little bit longer than normal. MSW Capital, LLC is a passive debt buyer meaning that we purchase debt which has been defaulted on due to non-payment. We do outsource the debt to our collection agencies and collection law firms to handle the debt with our customers. Due to this, part of the delay was reaching out to the previous creditor so they could investigate the claims and determine validity. *************** did agree with you that an investigation was done into the claim of possible fraud, but they did not see this as fraud in any way. In 2019, *************** received a dispute from you; however, in their determination the fact there were many phone conversations with you and at least one payment was made on the account they determined that it was not fraud. They also referenced a conversation where you called in and potentially were looking to possibly add to the current loan. Furthermore, there were at least six different conversations with you about this account from 2014. You may have some documentation disputing what we were told by the previous owner. Were you provided some documentation from 2019 about their investigation and deletion of the debt? If so, we would be happy to review and decide the appropriate outcome. I have called numerous times to no avail for almost a year now. Release the lien on my title already . I have yet to receive a call from this company but the can respond to an public message! However, the police report PDF document shows zero bytes meaning there was an error during the upload. We get a message showing failed file. Can you please attach again so we can review. It shows an ID Theft report was opened in 2019; however, there is no data, no story to what transpired, when it transpired not what was taken, etc. We have conferred with ******* Finance again and they confirmed they had multiple conversations with you back in 2013-2014. I would suggest contacting a ******* Finance office yourself again to obtain more data. You mentioned that they removed it from your credit bureau and conducted a full investigation on it with results. I received a call today from John at *** Mgmt. He said I owed $2200 from a credit card from May 2011. I have not received statements or any collection letters. It has never been on my credit report either. I need to show that this was not me or my signature but they will not show me that proof that it's mine. They say today is the only day to pay a lesser amount. When I tried to call the supposed bank it originated from, they are giving me total different information such as name and acct number. I would like some type of proof of this account before handing over money to someone for something that I'm not even familiar with and don'tever recall. Now the bank is now stating the acct isn't with them and it's with MSW Capital LLC. We'll guess what... they don't answer the phones. Please help me resolve this. If I legitimately owe the money, I will pay it. Thank you, ***********Business response

We have had no legal right/obligation towards this debt since then. We have no connection to *** Management either. You should reach out to ************** Management to see if there is a connection between them and this group contacting you. This ********** Bank card, when sold to ********** had a principal balance of 660.70 at the time.
