      We have solar panels that were installed 12/29/21 with a 12 year warranty and the owner wants $195 to come out and fix a leak

      When the gentleman  called, it was explained to him the manufacturer warranty regarding his solar pool panels. Before the panels are replaced, they must be repaired 3 to 4 times. It was then mentioned to him about our service charge being service is not part of the warranty after the system is installed one year later (workmanship)  to which he became enraged.  At this point, he was told the company owner, *****, was out of the office and how it would be brought to his attention so he can call him the next day.  The gentleman hung up abruptly and wrote a negative review before we had a chance to resolve this in a civil manner. The company owner called this morning as soon as he arrived to let the homeowner know we will send ************** to assess the issue with no charge, however, the gentleman hung up once again before this could be relayed. Regardless, we have scheduled ************** to do the service/repair within a couple of days with no charge.

      On 6/14/2016 Innovative Solar **** was contracted to install solar panels on my 4 years old roof. Some where in 2021 I notice water leaking through my ceiling dry wall. After investigated I found multiple leaks on my roof caused by the solar installation screws.My first reaction was to put in a claim with the insurance company Avatar at the time, as the case was under investigate Avatar went into liquidation, the time process take close to two years. As I do more investigation during this time, I have learn insurance company will not cover mechanical issue or failure due to installation ******* ship. By the way Innovative Solar left an open permit on my house all this time also.By this time I decide to reach out to the owner of Innovative Solar( *************************) By certified mail, text and email all communication has been recorded. ***** and I almost work out an agreement, that his company will come out to remove the panels and reinstallation at no cost after the new roof replacement is done and be responsible for the cost of the damage area of the roof caused by the installation of his company and I will be paying the roof area portion that the panels is not contacted.After I show ***** my roof estimate by South Shore Roofing cost to remove and reinstall the panel plus a new roof cost estimate up to 65k, ***** got hype up and said I have a roofing company that work with ***** can do everything for 55K. my response to *****... South Shore estimate the roofing parts only costing me 45K and your roofing company charging me 55k that is outrageous. ***** didn't know South *********** 65k estimate has include the labor for remove and reinstalling of the solar panels. ***** tried to deceived me, even to his knowledge that ***** company causes the leak and damage to my current roof and tried to make money from me through this hardship instead of helping his past client. After all this incident been expose, ***** stop all communication with me by all means.

      The installation for **************** took place in 2016, however, no contract exists between our company and *****************  His contract was with ******* Solar and More.  We were hired as subcontractors/installers to install the equipment provided by ******* Solar and More. When the system was installed we did provide a One Year Workmanship and Labor.  Since the installation, his original solar contractor is no longer in business, however, within that year, had there been any issues at all with leaks, etc., we would have returned to correct it at no additional cost to the homeowner.  After that its all maintenance of the system which is the responsibility of the homeowner.   Since the time of the installation, there have been many major storms, yet not once did we receive any calls from the homeowner about his solar system needing repair.  Had we heard from him within all the time that passed, we wouldve been glad to schedule a technician to check his system with a service charge.
      He also speaks of being given a roof estimate. **************** had asked ***** to refer him to a roofing contractor.  ***** offered the information of the contractor we use.  That estimate was lower than the estimate originally given to **************** by one of his roofing companies, yet he states otherwise. There was no deceit involved. 
      ***** did offer to remove and reset all his solar panels at no cost to **************** even though our company is not committed to do this, to show good faith, being his original contractor is no longer in business and he is getting no help with his insurance.  **************** insisted our company pay for the small part of the roof repair as well.  ***** had attempted numerous times to explain we are not liable for that repair, however, to no avail. ****************, with each call became more and more threatening which was why there was no more contact attempt when ***** received the text, email, and certified letter.  There is absolutely no reasoning with ****************
      He mentioned having problems with his insurance, what he doesnt mention is his insurance provider went bankrupt and a storm damage claim he attempted to file became unobtainable.
      He then mentions an open permit we never closed.  There were two permits involved at the time. One was closed in 2016. The other one was closed in 2020.  This can easily be verified with the county building department.  We also have documents to prove it.
      We have come to the conclusion; ****************** anger and frustration is being directed at ** being he cannot aim at the original contractor nor insurance company. He wants to blame ** for poor workmanship when, it clearly held ** years after we installed the solar panels. Is was lack of maintenance on his system overall, after 5 years of named storms plus mounting points into the roof which are the weak link and about every 3 years an on-site inspection should be performed, to determine if any of the mounting points have been compromised, and then repaired as needed. This is at the homeowners expense as anything storm related is not warranted.

      I am rejecting this response because:

      ** 2016 Innovative Solar **** working in conjunction with ******* Solar and More installed a solar system for my house. Innovative Solar is the company that put the panels and screws into my roof not ******* Solar and More,that would mean Innovative Solar improperly installed the solar panels that caused the leaks.  Mr. ****** lawyer replied to the BBB stating One year Workmanship and Labor was provided however he also stated we should have known to inspect our roof after three years for leaks. As a consumer we would not know that we will have to have an inspection yearly if the company does not tell **.  Even though he was hired by ******* Solar and More to do the work he should have advised them or us that this needs to be done.  If they informed all their clients upfront on the potential issues such as panels and hardwares can malfunction due to heavy storms especially being in ******* then this situation would not occur today. That is just good business practice. Would that contradict Mr. ***** lawyer own word? How can one year workmanship and labor( very well they have known  that with in the first year the seal and hard wears will not be causing any issue) but leaks  may occurs after 3 years. If this was inform to all clients upfront including hidden information,  storms  may cause the panels and it hardware to get loose  before contract was sign no one would consider doing this to get leaks after 3 years.

      ** 2020 I got a call from ***** who worked for Innovative Solar letting ** know we have an open permit due to them pulling the incorrect permit.  ** 2016, the water heater permit was pulled instead of the pool solar heater. So ***** ( the owner of Innovative Solar) came out to my house, climbed ** the roof and in the attic to verify the incorrection that was made. I said to ***** that my electric bill is still high and asked him to give me a quote on adding more solar panels. ***** told me he would get back to me once he is back in his office. He never got back to me as he promised, so I contacted his office multiple times with no response. I am now getting frustrated and started to ask of my self questions. Why would a company not want additional business when being offered one?  After multiple calls to ***** and to his office I got no response. I left a final message advising Innovative Solar to not worry about installing extra panels but to please just correct the permit and close it out.

      Back to 2020 when ***** came out to my property to look at the incorrection on the permit, he climbed on the roof and in the attic to take a look at it.  ***** saw some issues with the leaks and  that is why he never responded to my request on adding the additional panels due to his knowledge on what he saw when he was up there.  He saw that the leaks were present and did not want to be responsible for the original job which was installed by his installer at the time in 2016. It is also why ***** corrected my permit in 2020 in silence and never informed me.  The only reason why I know this was corrected is because of the response from his Lawyer to the BBB which exposed the truth.

      Back to the present I know that ***** will not respond to my phone calls like as he has shown previously when I tried to reach out to him, so I wrote a letter and sent it to him via certified mail. Once again, no response from him.  A week letter I sent another certified mail and finally I received a phone call from *****. I told ***** what has happened and he said he will remove and reinstalled the panels at no charge once the new roof is installed. I also advised him he will also have to paid for the damaged section of the roof where the panels touched. ***** said he works with many great roofing company and asked if I would want them to take a look at it. At that time I have already informed **************** ********************* gave me an estimate of 65k. What ***** did not know is in the estimate the roof replacement cost only $45k and the other $20K was the labor to remove and reinstall the panels. Weeks went by, I asked ***** when he will have his roofer come out to inspect the damages on my roof? ***** later responded letting me know his roofer will replace the roof for $55k and he will remove and reinstall the panels at no cost. I advised ***** that is too much because South Shore only charged me $45k and he could remove and reinstall the panels at no cost that would make more sense. ***** got upset and started to use aggressive tone towards me. I believe ***** knew I caught him trying to scam me again with his roofing company. Afterwards, I have tried to reach out to ***** by phone, he did not respond, so I decided to send him a certified mail, also email and text as evidence to track all of my communication. With all this being said, I keep wondering why his roofer company never came out to physically inspect my roof but was able to give ***** an estimate.  How would he know what the true damages were?How would he know what the dimension of my roof is?  Did he just went by Jerrys words or just look at the estimate South Roof provided to me and then gave an estimate?

      The respond that the lawyer wrote to BBB stating ****** roofing companys estimate was cheaper is incorrect. Lets do the math Jerrys ************** estimated the cost to be $55k however South Shores estimate is $45k that is $10k less.

      ** conclusion, all Im asking is for Innovative Solar to do the right thing, honor that your installation caused my roof to leak and fix it.I am certain Innovative Solar has insurance. If the expense is too much for ***** to cover he can claim it with his insurance company. I have Email, Text and certified mail to prove our communication and I wasnt being aggressive.

      Unfortunately, there is no resolving this issue with *****************  He is determined to charge our company for the roof repair although we are not liable and refuses to hear otherwise.  Instead of going in circles with responses

      and going nowhere, we have handed this over to our attorney who will be reaching out to **************** shortly.
