      I am a victim of identity- theft, I am writing to request that you block all accounts disputed as fraudulent on my credit reports with Transunion, Equifax, and Experian. This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by Congress and The ************************* which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. I understand that the Office of the Attorney normally provides copies of the complaint forms or information regarding complaints to the business complained about and other private and public agencies. I authorize BBB to give copies or any information on the form to anyone deemed advisable.

Our client, ******* Emergency Physicians/Kang and Associates, is a provider  of emergency room physician services at Advent Health in ***********, **. The following accounts have been placed with our office. Reference number ******** date of service 7/25/19 balance $191.91, reference number ******** date of service 6/26/17 balance $1,498.00, reference number ******** date of service 12/21/17 balance $501.00, reference number ******** date of service 3/9/18 balance $1,092.00. We have verified that the information being reported is  accurate, and have reported the accounts as in dispute with the credit bureaus. We have requested that validation of the debts be mailed to the consumer. There is no requirement that a third party debt collector obtain authorization from a consumer to credit report unpaid collection accounts.

      The following account #******** was opened around the date of 08/20/2020 without my knowledge and added onto my credit report for the total amount of $159.00 dollars. This is considered a fraud and is also a violation of my rights as a consumer. In addition to that, this company never validated the account with supporting evidence as required under 15 usc ****g I want this account to be taken off as soon as possible from all the credit reporting agencies including Experian, Equifax and Transunion. I also demand $1,000 per occurrence for this violation.

      We have reviewed our records in this matter, and find the following. Prior to receipt of this complaint, we  have received no correspondence, or notice of dispute from the consumer. Our client, Emergency Professional Services, is a provider of emergency room physician services at ********************************** in *********, **. The account in question was placed for the collection of an outstanding balance of $159.66 on 8/20/20. The charges stem from services that were rendered to the consumer on 6/10/19 and represent a patient pay amount that remained after insurance. Our initial validation notice, including the right to dispute language, was mailed to the consumer on 8/24/20. Follow up notices were mailed to the consumer on 10/6/20, and 12/1/20. We have verified that the information being reported is accurate, and have reported the account as in dispute with the credit bureaus. We have requested that validation of the debt be mailed to the consumer.

      Account Resolution Services ("ARS") is a debt collection agency. This agency allegedly obtained medical records, unauthorized and without my consent, my signature consent from its client. This practice is a direct violation of HIPPA laws and the Fair Debt Collection Practices Act.For your immediate review, I have attached a copy of a communication sent to ARS on February 21, 2022. To-date, ARS has failed to response, either via email, phone or regular mail, to the communication that I forwarded to its attention on February 21, 2022.Please note that directly upon receipt of this communication, I demand to promptly delete this negative listing from all three major credit reporting agencies, namely: ******************** and Equifax. If ARS is not willing to comply with this request, I further demand ARS to send any correspondence, regarding same, to the original business/entity. Additionally, please note that I am prepared to file further action against ARS in order to reconcile this apparent discrepancy.

      We have reviewed our records in this matter, and find the following. Our client, Emergency ******************** of S. Jersey, is a provider of emergency room physician services at ********************************** in ***********, **. The account in question was placed for the collection of an outstanding balance of $1,602.00 on 4/20/21. The charges stem from services that were rendered to the consumer on 11/6/19. HIPAA allows a provider to release certain information necessary to obtain payment for services rendered. We are not in possession of medical records, treatment notes, diagnosis, or any other information that would be considered a violation. We have received, and responded to one direct dispute received from the consumer. As required, we verified that the information being reported was accurate and reported the account as in dispute with the credit bureaus. Validation of the debt was mailed to the consumer on 7/8/21.

      I am rejecting this response because a proper validation notice is not in receipt and was never provided.  I am requesting ARS to forward the original copy of a hospital ****/services with signatures from both counterparties.  If the hospital is a client of ARS, it would be sufficient for ARS to provide such information.  ARS reluctance to provide such proof/validation of debt is evidence that its company, ARS, is in direct vioation of HIPPA laws and regulations.  If matter is not reconcilced with the next five (5) business, I will be forced to seek resolution in a different jurisdiction.

      I checked my credit reports and saw that ARS was reporting an alleged debt on my report. On 1/18/2022, I mailed them a Certified letter to the company, however, they completely ignored my request for them to validate this alleged debt that they are reporting on my credit report. They never mailed me a dunning letter, ignored my request to legally validate this alleged debt, and continue to mess up my good name. Account Number: 859595xxx Amount: $710 I need them to close this account and delete it from my credit report.

Our client, Inphynet South Broward, is a provider of emergency room physician services at Memorial Pembroke 24/7 Care Center in Pembroke Pines, FL. The account in question was placed for the collection of an outstanding balance of $710.00 on 7/20/18. The charges stem from services that were rendered to the consumer on 5/24/17. Our initial validation notice, including the right to dispute language, was mailed to the consumer on 7/23/18. Follow up notices were mailed to the consumer on 9/4/18 and 12/30/19. Each of these notices was mailed to the consumer at the same address provided in this complaint. We have verified that the information being reported is accurate, and have reported the account as in dispute with the credit bureaus. Validation of the debt was mailed to the consumer on 2/18/22.
