      On May 12th 2023 Gulf Eagle Supply delivered out roofing materials , after already rescheduling from the original date due to not bringing the correct truck to deliver the materials. The next morning during the install we notice the wrong color and materials were delivered. A few days later we contacted the person in charge at the local office and advised him of the issue. We were given multiple different promises from the branch manager of how the roof would be fixed and the correct color would be made available within the week. He even promised us dinner, which we never saw, to help make up for the mistake. Fast forward 3 weeks and still no replacement materials. Finally during the 4th week after putting our build a whole month behind and wasting hundreds of dollars worth of our time, the materials were delivered. They brought in sheets of plywood to keep from getting stuck and left them all over our yard. I contacted someone from the ***** office, who said he was the *** He I told him our entire story and how I felt about it. He stated that he would see that we were "taken care of" and has since avoided all communication. I've left multiple voicemails with my information with nothing. This company has set us back weeks in construction, has caused us to have our original roof torn off and rebuilt on our brand new home and treated us like their discrepancy is not their problem.

      Gulfeagle acknowledges that we originally provided the incorrect color of shingles for the homeowner's roof on 5/11/23 and we apologized for the error.  Once the error was discovered, the roof had already been installed.  Gulfeagle agreed to provide replacement roofing materials at no cost and also pay the labor to tear off the wrong color and reinstall the correct color.  During this phase, the homeowner decided to change the color of the shingles from the original color choice.  The original color selected was Pewter and at the time was in stock and ready to ship when the roofer was ready and this was communicated to the homeowner.  However, the homeowner decided to change the color of shingle to Charcoal.  At the time of ordering, this color shingle was not in stock and would need to be ordered.  This situation was communicated to the homeowner including the anticipated delay in receiving the new color of shingles and the homeowner approved Gulfeagle to move forward.  The new color roofing was received and delivered by Gulfeagle on 6/6/23.

      Gulfeagle disputes the homeowner's claim that this situation cost them any amount of time, money nor that it delayed any construction.  This was a new home being built, therefore other work was being performed on the home while the roof was being installed and caused no real delays with other trades.  Additionally, it was the homeowner's choice to make a color change and was fully aware that the new color choice was out out-of-stock and that it would take approximately three weeks to receive versus the original color that was in-stock.  Lastly, the new color cost more than the original color yet Gulfeagle did not pass that additional cost on to the homeowner as a good gesture.  

      Gulfeagle took responsibility and happily resolved the issues as quickly as possible while taking an extra step to accommodate the homeowner for their color changes at no cost.

      I am rejecting this response because: The color was in stock per the local representative provided by the company. The color was changed after speaking with the representative of the company. The color change was confirmed by the local manager of the company. This claim is a "copout" of the company and was discussed during the time of the issue. Per the company the change had no effect of the availability of the materials and/or cost. This was confirmed by contacting multiple other locations and per the **** of the company. Furthermore it was never expressed that there would be any delay in change the original color, only that a change would be acceptable due to the mistake made by Gulf Eagle. The expenses incurred we due to all operations being delayed due to a roof not being on the home. All drywall would not be protected due to not having a complete roof. If Gulf Eagle had delivered the correct roof, non delays would have been occurred.

      The homeowner is claiming the new color choice was already in stock.  This is simply not true as of when the order for the new color was placed.  The original color was in stock and ready to ship.  However, they changed the color to a shingle that was not in stock so it had to be ordered and that is why it took three weeks to be delivered.  We are not in the business to purposely delay shipments - if that was the case, we would be out of business.  

      The homeowner also claims there is not a price difference.  Again, that is not the case.  We base our pricing on "replacement cost" - if we have to order new stock of a particular product, that price may have changed since the last order - this is just the way it is in the roofing distributor business and we deal with it every day.  As stated, the new color cost us more than the original color but we did not pass it along to the homeowner and we were happy to accommodate the customer.  

      The homeowner's claim that this roof issue caused delays with drywall is also not true.  The homeowner had already mentioned to our Gulfeagle representative that they had countless issues with the construction of their home including many drywall issues and this was brought up before the original roof was installed.  When the wrong color shingle was installed, the roof was complete and water-tight and never had exposure to the elements.  When the new color shingle was delivered to the home, the old roof was torn off and the roofer immediately installed new "peel and stick" underlayment which completely sealed the roof from moisture intrusion.  The new color shingles were installed either the same day or the next.  Again, the roof never had any elemental exposure so there was absolutely no risk to the interior of the home and no delay in drywall installation.

      I am rejecting this response because: Once again false information from the company. Why would we change the color if we were told there would be a delay in getting the different color? That wouldn't make sense. The only reason we even changed colors is because the representative told us there would be no delay and it wouldn't effect the cost. It was not until I voiced my displeasure with the time it was taking that the manager tried to tell me the color change was a different price. I called multiple other Gulf Eagle branches and was advised that due to how common the color was, there was no price difference in the two colors. It was very apparent that the company was trying to cover themselves and make me feel like they did some kind of special favor so that I wouldn't be upset with the unsatisfactory experience. The company keeps acting like they did us a favor by replacing the incorrect materials with the correct ones, of course they did, otherwise it would have been settled in court and they knew they were in the wrong. Bringing any previous issues with our build is not relevant to this and is only a poor attempt at distracting from the fact that drywall cannot be put in if a new roof is going to have to be put on. Our contractor advised us that in his professional opinion putting in drywall before the correct/final roof was installed, would risk it being damaged if it rained(which during July in ******* it does a lot). Gulf Eagle is doing their very best to make every excuse they can to justify their poor performance and lack of customer service. I asked for nothing more than what was originally promised to us. Gulf Eagle thinks that because they eventually got us the correct materials that they can wash their hands of it and not make things right. If you deal with this company, do yourself a favor and record all conversations.

      I am a licensed contractor in ******* helping homeowners recover from the devastation of hurricane ***. Gulf Eagle supply allowed an out of state contractor , who holds no contractors license in ******* nor a registered business, to obtain a line of credit for roofing materials for 7 homeowners of which I was the licensed contractor doing the work. Although these homeowners have paid the owner of this out of state company, the roofing materials have not been paid and these homeowners are getting LIEN notices as a result from gulf eagle supply. I have attempted to acquire all invoices from Gulf eagle for these 6 homeowners but they seemingly refuse to provide them although I am the licensed contractor who did the work. I, nor they ever authorized that roofing material be obtained on credit. They have paid, they should not be scammed and conned any further and should be allowed to have a copy of their material invoice to ascertain the cost of the materials for which Gulf eagle supply is threatening to lien their propertys for. These homeowners deserve better but it seems that contrary to the strict laws of ******* that prosecute unlicensed contracting, gulf eagle supply was a direct partner and accessory to this unlicensed individual who obtained a line of credit from them for roofing materials used . How is it that this is even possible. These people have been through enough, they already paid this unlicensed fraud who obtained a line of credit from Gulf eagle supply. An unlicensed contractor, an unregistered business in the **************** whom was somehow allowed to obtain thousands and thousands of dollars of roofing materials on credit . I dont care that this same individual didnt pay me although he was paid by the honeowners. My concern and this complaint focuses on the seemingly unethical business practices of Gulf eagle supply.

      Gulfeagle Supply is a distributor of roofing and building materials.  We sell these materials to builders, contractors, DIY'ers and homeowners alike, therefore we do not, nor are we legally obligated to, verify any contractor licenses.  We had an existing customer relationship with the "out of state contractor" - this contractor had been approved for an account with payment terms for years prior to this situation.  The "out of state contractor" authorized us to charge his account for these materials. This "out of state contractor" has also been making payments in accordance with his payment terms. 

      As part of our normal course of business in the ****************, when we provide building materials to a property, we send the property owner a "***************" which is required by the **************** in order to retain lien rights.  The purpose of this document is to protect the property owner from unknown liabilities related to materials or services provided to the improvement of their property. This gives the property owner a fair warning of who provided materials or services for their project and provides guidance that they will want to make sure that they obtain lien waivers from all contractors and suppliers in order to protect their interests. Gulfeagle followed all guidelines and Florida Statutes in sending these Notice to Owners.

      Due to the fact that this account belongs to the "out of state contractor" and not the contractor that filed this complaint, we are not at liberty to provide any details (invoices, pricing, etc.) due to confidentiality.  However, if the "out of state contractor" gives us written authorization, we will be willing to provide any details he specifically approves. For the record, these two contractors have an existing relationship under a different legal entity but we did not sell this entity directly.  Since this relationship began, it is clear that these two contractors have had a falling out.  They need to resolve their differences between themselves and leave Gulfeagle out of the situation. 

      Gulfeagle Supply stands by the fact that we followed all State Statutes and therefore have done nothing wrong.
