My wife ***** and I did an assignment on benefits because of the enormous damage done to our house due to wind and rainstorms with Smart Storm Solution. However, we were unaware and misinformed as to what we were doing. When we signed that agreement, we were unaware of any allegations, complaints, and litigation. Smart Storm Solution has breached and misused their authority in representing us by holding the funds for over six months without contacting the homeowners (***** and ***************************) and mortgage company (Newrez - C/O PHH Mortgage). This behavior has been harmful and resulted in mold and mildew throughout the first floor of our home, which never would have occurred if the funds and contractor had contacted us concerning repairs. I have called Smart Storm Solution and their attorney over *********************************************** repairs. I respectfully request that a ********** Insurance agent check my policy to see if I have the right to sign an Assignment of Benefit Consent form.Smart Storm Solution has violated the assignment of benefits by not advising us of our rights to rescind the option of assignment of benefits within 14 in writing.Smart Storm Solution should have commenced or notified us of commencement within 30 days. Smart Storm Solution should have informed us of the funds received and repairs, and no work has ever been performed at my residence. Therefore, I request permission to rescind this assignment of benefits contract from Smart Storm Solution.Smart Storm Solutions have had our claim money for over six months, as verified by ********** Insurance claims, and no work or response within the last six months. I respectfully request permission to rescind the assignment of benefits from Smart Storm Solution for failing to commence or do any substantial work after over twenty-six attempts to contact them. Our residence has suffered harmful amounts of mold and mildew over this period of time.Initial Complaint

I have just been informed by my insurance company that Smart Storm Solutions filed a lawsuit and was paid $20,000 to replace my roof on 01-27-2020. They never did any work on my roof they were in my neighborhood going house to house scamming us. I was shocked to hear they filed a claim they did no work on my property. I have called them they do not answer and do not call back so I'm filing complaints for help. My roof needs repair now and the insurance will not "pay twice" , clearly they did not do work on my house. I wish to report this and want assistance with this. They never replaced my roof, this is a scam.Business response
