I rented from my landlord (Malinda Antonik) as of 3/17/2016 in a shared living arrangement with my landlord. I gave her a check on 3/17/2016 for the requested security deposit of $800. There was not a signed lease agreement. She did not comply with (Fla. Stat. ***** (3) (a) to give me the required notice within ******************** **** she deposited the security deposit, the type of account (ie interest bearing) and confirm it was in a separate account not mixed with any other money. Per the ** ********: If the landlord doesnt hold the security deposit in the proper type of account or doesnt give the tenant notice of where the money is deposited, the landlord loses the right to keep the security deposit. If the tenant requests it, the landlord must immediately return the security deposit to them. I vacated the rental property on 5/30/2023 after a final inspection same day by her designated agent (as she was away on vacation) and the agent reported no findings of damage. The landlord also did a preliminary inspection of the her rental property while I was away on vacation and did not report any findings of damage. At this point I just want the rightly return of my full $800 security deposit as Im entitled to immediately because she did not give me any aforementioned notification regarding my $800 security deposit. I have been an awesome tenant for over 7 years and disappointed she is being difficult.
