      I own a home in ***********, ** and currently has *************************** with ******* Home Realty *** as the realtor. My property has been listed for 2 months and had 3 showings. Mind you, the property is turnkey ready because it was gut rehabbed. The property was supposed to have an open house 2/25 but ****** decided not to because it was super bowl weekend. I accepted that and waited for the next showing as of 3/22 but that was cancelled without any knowledge to me until I asked. Again, a third open house was scheduled as of 3/29 and again that too was canceled. I didn't find out until the next day that the open house again was canceled when I asked. And to my surprise, no explanation why. The only thing ***************************** can tell me to do is lower the sales price which makes no sense when you are not putting in any effort towards marketing / advertising. Adding virtual pictures to show how the house would look with furniture won't cut it. It takes so much more. I then find out that ****** has vehicle and other personal issues which is interfering with her job. That explains why I had to find out myself on 4/3 that my home has several ant farms inside and out and I was never advised. I live a couple of hours from the home so unless the realtor advises on what's going on, I have no way of fixing things if needed. When I asked ****** the last time she's been to the house she couldn't give an answer but clearly it's been weeks if not over a month. So now I want out the contract and want to take my business elsewhere. ****** won't release my listings unless I pay her for what she thinks she did which is absolutely nothing. I contacted her broker and VP of Future Home Realty and again sadly, her broker ***************************** made no attempt to contact me and her VP basically said sorry but too bad. No one made an effort to investigate or take a closer look as to what's happening. So now I'm having to exhaust all other avenues prior to obtaining an attorney.

      My professional services for **************** began January 10, 2023,en which we entered a listing agreement on a vacant lot she owned. Our marketing strategies, limited but not limited to professional drone photography, began immediately. I presented a cash offer, which was executed on January 18, 2023.For over a month, the ************* and I worked diligently to assist *************** with a successful closing, **************** was unable to provide a deed to the vacant lot free and clear of all liens and encumbrances and defaulted on the executed contract. The Buyer was patient as we navigated through the obstacles,unfortunately the transaction was cancelled on February 20th, 2023. 

      At that time her investment home remodel was not complete (without HVAC) and *************** was expecting to use the proceeds of her vacant lot sale to complete the home remodel. Expecting and assuming the vacant lot would successfully close,**************** listed her home on February 1st, 2023 (without HVAC). My marketing efforts and investment on her home listing began immediately. 

      *************** did not have the funds to finish her rehab and a HVAC system was finally installed on 3/14/2023 by means of securing a second hard money loan against the home. 

      *************** and I communicated via phone weekly. She also received listing updates via email that included marketing efforts, views, open houses, showings and feedback. 

      On 4/4/2023 **************** and I discussed her listing verbally via phone and she also received emailed listing marketing updates as well as a detailed report of comparable homes located within 1 mile of her home, that have gone pending and/or sold. 

      The listing update presented to **************** on 4/4 via email included ***** online property views (Zillow, ****tor.com, etc) broken down by the top websites and views from each website. In addition, **** estate agents sell homes, en which her property was perfectly presented to every professional **** estate agent in the MLS. 

      Her listing update also included 5 feedback responses from agents that had shown her home to their buyers. Therefore, Ms. ******* complaint of the 3 showings is false.

      A pre-Super Bowl themed open house was held at Ms. ******* home. I called and invited her neighbors to a pre-Super Bowl open house (neighbors know others that *** want to live in their neighborhood), which was marketed to the public and I personally held open on 2/12/23. 

      During our weekly phone communications, open houses were discussed for March. We had mutually agreed to wait on holding the open houses until after spring break due to the increase of travel during that time. 

      I have not requested **************** to pay the commission owed from her default on the executed contract. I have continued to invest and provide professionals services to **************** on both of her listings therefore, I simply am asking for reimbursement of the direct expenses towards the marketing of her properties and the cancellation fee in which she agreed to, in the listing contract. Receipts of such paid expenses on her behalf have been shared with her. I wish **************** the best of luck in her endeavor to sell her properties. 

       

      Additional response from the ** of Operations, *******************: On April 6th, I was contacted by text by the Seller stating that she needed help canceling 2 listings that she had with our agent ******************************  I responded that same day gathering some details from the Seller about the situation.  I called our agent ****** right away and discussed the situation for canceling the listings.  ****** responded back that evening that there is a cancelation fee that the Seller agreed to in the Listing Agreement (page 4 attached for reference).  I responded right away to the seller that ****** will cancel the listing once the fee agreed upon in the Listing Agreement is paid.  The Seller responded that she would not pay it because she felt her agent did not do her job.  I responded back to the Seller that Sellers and their Agents come to terms using a Listing Agreement to lay out all those terms, and per Line 159 of the Listing Agreement, the Seller had Agreed to a $750 Cancellation Fee should Seller cancel prior to the Listing Termination date of 4/30/23.  We felt that the valid course of action was to follow the agreed upon terms per the signed Listing Agreement.  That was the last communication I had with the Seller on the evening of April 6th.

      I am rejecting this response because:

      Person is speaking about a matter that is irrelevant to the current situation. Person has canceled 2 showings because she did not have access to a vehicle in which she couldn't make it to the showings. This was confirmed when she was seen making it to another closing via uber. And instead of being honest of the situation she never said a thing until I asked why the showings never took place in which she could only say they were canceled with no apparent reason. After consulting legal advice in addition to other realtors I was informed that ******'s work was poor and in fact unacceptable. My current property is located about 30+ minutes from the ******* area and in a rural/suburban area. So it will take an extra effort to sell because of its location. 

      As for the empty lot...that was simply additional investment. I fulfilled everything that I was supposed to but the current servicer would not provide a partial lien release so the main dwelling would have to sell prior to the lot sale. ****** is fully aware of this. As a matter of fact, she called the lender and title company several times to obtain the release but lender wouldn't budge. She even stated the lender was foolish for such behavior yet she acts as she speaks. She is fully aware of this so to say I did not fulfill my end was a total lie. As for the hard money loan, the rehab took more money than was expected because of the condition of the home. The hard money loan took place because the lot sale did not take place as expected. Either way that comes with investments and is my business! Not ******'s! ****** obtained this information from the lender because they are all that unprofessional but also close friends.  They know each other and whatever business is done with the client is then relayed amongst each other. That is the other reason why breaking away from this crowed is mandatory because it makes no sense that professional business matters are handled outside the office. 

      When I initially sent the email to ****** her broker was included and ****** never said a word. Very professional!

      *** was just as useless because telling me that I would have to pay a fee by taking another parties word is not how you conduct business. I have no problem ever paying dues but only if services are rendered which was not in this case. Calling ****** to get her side of the story is ridiculous. Anyone can do that. But investigation is what should've happened. Find out why I want to cancel the contract. Find out what happened. Get to the bottom of it. But I guess money is more important than clientele for some businesses.

      Rehabbing properties is a means of income. But what sense does it make to put effort and money into a rehab to either come up short or in the negative? I'm not sure anyone wants to work for free and of course if I don't get paid then no one gets paid. I mean it makes no sense. As a matter of fact the same situation took place with another client because ****** did not fulfill her part. She simply kept stalling. However I am sure that ******'s office never looked into the matter while others get screwed because all they see is the client wants to cancel a contract.  Only common sense there would be a reason for cancelation. Either way today is 4/17 and in 13 days ****** is ghost. I would be a fool to dish out any money for services not rendered. I respect all decisions made and already in process for better. 

      I will however also continue to make this situation known through every channel there is. If you can't sell a property due to lack of transportation or knowledge of the area it would be best to say so. But either way better is already awaiting so 4/30 it is. Take care!

      ****************************** our realtors for a home we rented in ***********, *******- very unprofessional! So disappointed in the way they handled this rental! They should both have their licenses removed and/or put on probation!My *********** found out from a reliable neighbor that they were sharing our personal financial information and our credit scores!We are filing a complaint to the **********************************************

      Management of Future Home Realty has spoken to the agents involved and are satisfied that nothing inappropriate was shared by the agents. As noted in the detailed response below provided by the agent, any information that was provided was not specific to any party and was intended to provide general rental advice to a third party. Please see agent response below. 

      FHR Agents Response - The BBB complaint of ************************* against ********************* and *********************** is inaccurate and based on miscommunicated neighborhood gossip. The complainant was the tenant of the Realtors (who own a property which the Kennedys rented). Before this BBB complaint a formal process was started by the landlords (The ******) to remedy lease violations by the tenants (the Kennedys). It's likely these false accusations against the ****** are related to that landlord / tenant dispute which was underway since September. Importantly, *********************** was not at all involved in the conversation with the neighbor, which was miscommunicated and the basis of this complaint, so ***** should be removed from this BBB complaint ASAP.********************* did have a brief conversation (3-5 mins) with the neighbor in question on November 15, where the neighbor asked a lot of questions about renting property as she was considering renting her home. **** and the neighbor discussed generic advice about the application process for tenants. No specific information about any specific tenants was discussed, and certainly no specific credit information was revealed. After hearing about ********* complaint, the neighbor has confirmed that ***** misunderstood and exaggerated the generic comments about tenant applications. The neighbor is quite elderly and prefers not to have the stress of formal 'testifying' but if the situation escalates,she understands she may need to be involved.
