I purchased an extended auto insurance from Affordable Auto Shield back in March of 2023. I own a 2009 ***** ES with around ****** miles at the time of purchase. Later, when I had some issue with my vehicle and present the insurance for repairs no reputable dealer that works on my type of vehicle would accept the insurance That being said, I am requesting a full refund of monies paid, because I wasn't able to use the insurance. A company should not just be able to keep my monies and a service cannot be render. I notified the company in July of 2024, to discuss this matter, cancel the policy and request a refund. A representative stated they would contact me via a letter in 30 days to resolve the issue. Thirty days have passed and I haven't heard a word telephonic, email or letter. I purchased a policy form AAP under contract DAE1010642 and the car that the contract was on was traded in. I sent the necessary paperwork and when I contacted them about my refund back in 2022 I was told that because of covid there was limited staff and the refund would be delayed. Every time that I reached out I would get the same response. When I call now *************) the admin **** says checks are issued every Thursday and you will get a call when checks are done. They say the processing **** doesn't accept calls but my message will forwarded to them. This has been going on for the last 6 mths. I just need my refund for this policy.Customer Answer

On 9/20/21 "***************" with Allegiance sold me an auto warranty policy for $3600, that would expire 10/23/2026 or after ******* miles for my 2016 Audi Q5. I was given a confirmation #********** & told to call ************ if I wish to cancel before 10/22/21.l recently received notification that a recent payment to Mepco was declined (Mepco is company handling the payments). I spoke with ****** at AAP (************) and asked how a $3600 contract ballooned to over $4400, he told me the $3600 was for if paid in full that day "***" did not explain it in those terms. I asked ****** if he could give me the ************* of a manager to discuss the matter he could not, instead he told me to call back & request a manager. It's a number operated call-system as I explained to him and I could not call back if I don't know what number to key into the system.Only thing I have to support this are my notes from September 2021, and notes taken today (9/28/23) from over 5 different people I talked to trying to resolve the matter. The only thing I want is to have the policy marked paid in full (thereby giving me a valid active policy), or a refund of what has been paid to date.Initial Complaint

2/24/2023 Affordable Auto Protection promised me in 12 weeks, to return a refund of my auto extended warranty. Ive spoken with AAP several times and was told by their ***** **** forward a reminder to the department that process refunds, or the department that process refund is hard to reach, the refund process takes a long time. As of last week, theyre saying, our computer system was hacked. I explain to AAP, the circumstances of the cancellation: On or about 6/14/2022, I received a call from Affordable Auto Protection inquiring about auto extended warranty. Not realizing my automobile was already under warranty and paid-in-full for three years, with Vanguard Vehicle Armor, which expires on 12/31/2023, I purchased another auto warranty with AAP. A months later, 7/28/2022, I closed on a home in ************, ** and several days later, my home insurance rep called and informed me that my auto extended warranty was with AAP, a subsidiary of their company. After realizing my mistake, I cancelled the extended warranty with AAP. The 12 weeks expired 1/31/2023 and Ive been expecting a refund of $950.00 +, as promise, its been 16 weeks now. Affordable Auto Protection (AAP) has violated the Telephone Consumer Protection Act by contacting me over and over again. while they disregard the National Do Not Call List and Florida State Do not call list. They do not have a license to make telemarketing calls to ******* Residents. Penalties for failure to obtain lic to make telemarketing calls could result in criminal charges (Felony), Civil penalties.They are in violation of federal law. 47 U.S.C. 227(c)(5) states:A person who has received more than one telephone call within any 12-month period by or on behalf of the same entity in violation of the regulations prescribed under this subsection may, if otherwise permitted by the laws or rules of court of a State bring in an appropriate court of that State State Laws:F.S.S.501.059(4)No telephone solicitor shall make or cause to be made any unsolicited telephonic sales call to any residential, mobile, or telephonic paging device telephone number if the number for that telephone appears in the then-current quarterly listing published by the department (A) an action based on a violation of the regulations prescribed under this subsection to enjoin such violation, (B) an action to recover for actual monetary loss from such a violation, or to receive up to $500 in damages for each such violation, whichever is greater, or (C) both such actions. ...If the court finds that the defendant willfully or knowingly violated the regulations prescribed under this subsection, the court may, in its discretion, increase the amount of the award to an amount equal to not more than 3 times the amount available under subparagraph (B) of this paragraph.Damages exceed $12,000, and I have not got a response to my emails giving them a chance to negotiate a settlement. I am the *** for my aunt ************************* and noticed a pending charge for $100 on her account on December 13, 2022, to Advanced Auto Protection with the phone number ************. I called that phone number and spoke with ****** who told me this was cancelled and she saw my *** was on file. I also requested a refund. ****** stated the card declined so a refund wasn't necessary. Today, December 16, 2022, I saw the charge posted to the account so I attempted to call ************ again. It went straight to hold for several minutes so I hung up and tried again, same thing. I then contacted the bank. I was told by the bank manager that the card was run and was declined, however; it was run again and somehow got through even though the card is set to not run if not used in person. PLEASE SEE THE ATTACH LETTER.ON 7/27/2022 @ 2:35PM, I CALLED AAP AND SPOKE WITH *******. I WANTED TO MAKE SURE AAP RECEIVED THE LETTER FOR THE CANCELLATION AND MY REFUND. I WANTED ******* TO EXPLAIN TO ME WHY I WAS PAYING $160.21 A MONTH AND GOT NOTHING. SHE BECAME RUDE AND SAID WE GOT YOUR LETTER AND IT WILL TAKE 7 TO 10 WEEKS TO GET MY MONEY.
