The Towing Company has refused to release our cargo. Tractor-Trailer Leased Under Blue Rhino Logistics was involved in one (1) unit accident on 03.09.2024. The Tractor-Trailer were towed to PROCAR TOWING & REPAIR *** premises and the Insurance Adjuster later on inspected the cargo and instructed us to be collected and returned to the shipper. He made contact to have the storage invoice settled without success and we also made contact with the Towing Company via emails and several calls to send us the storage invoice and W9 to pay and collect the cargo without success too. We sent the driver there to the yard to collect the cargo but they refused to grant access or attend to him We need your help to have this matter resolvedBusiness response

Please be advised that we did in fact recover this trailer that was attached to the semi.. However through several communications we advised the callers from ********** that we had no record of them owning the said cargo. We dealt directly with the owners ****************** (Great ****************** IF you take a look at the complainants submitted paperwork, you will see that the ***************** shows ***************/*** Transportation as both the owner of the truck and trailer. No where is Blue Rhino Mentioned. If you also look at the email dated May 7, 2024 submitted, it also shows that I advised them that we had nothing showing them as owners of vehicles or cargo. I also advised that they needed to reach out to the owner and or his insurance. I am not legally allowed to release anything to anyone other than the owner.. The owner released his vehicle and all its property to his insurance company. NOT to Blue Rhino Logistics. Never did Blue Rhino send us any paperwork or information regarding ownership..they merely called daily to get the total owed on storage and recovery. As Florida Statutes dictate I followed the statute protocol. Certified letters were mailed to all parties the state showed as having financial or ownership obligations to the recovered vehicles and property. An adjuster did come out to inspect the vehicles and cargo. However, he showed no paperwork as to who he was working for. We assumed it was an adjuster hired on behalf of ********************** as they were the only insurance company that the vehicle was released to. As per Florida Statutes we are obligated to place abandon (unpaid for) property up for auction. That Statute protocol was followed. Again all persons/parties. as deemed by the state, were notified of said auction. To date, Blue Rhino has still not produced any proof of ownership. To date, ProCar towing has no idea how Blue Rhino is involved with the vehicles or property. To date the vehicle and property was placed at auction on May 8, 2025 as required by Florida Statutes. My advise remains the same. If Blue Rhino has rights to any property, they must reach out to the vehicle owners ***************** as they were the ones who handled payment and release. We did not refuse to release property to the owner of the tractor trailer or the insurance company he released it to. We only refused to release property to a company who provided no proof of ownership and who did not file through the proper channels (insurance company) to receive payment or return of product. We as a tow company for law enforcement can only go by the information the law enforcement and the State Division of Motor Vehicles offers us. At this time those channels have only showed us the above stated owner and insurance company. Be advised that if we had released this property to someone other than the owner or insurance company it could have been against the law. There are channels set into place just for this reason and Blue Rhino was advised of those proper channels in the email I sent them.Customer response

I am rejecting this response because: I am rejecting this response because: When the towing company claims to not recognize Blue Rhino and *********************** is not right. We clearly stated that *************** was leased under Blue Rhino Logistics. The adjuster also (must have) introduced himself and whom he was working with when he visited their facility to inspected the damaged loads. After he inspected the two (2) loads he contacted the towing company after his final report to send him the cargo/loads storage fees invoice and W9 without success. He reached to us to get the invoice and W9 that is why we called daily and yet Towing Owner. He further instructed to have the loaded returned to the shipper. The towing intentionally delayed responses and eventually refused released our load citing *************** as the Load Owner. We have referred the matter with the *********************** Legal Team but such behaviors must be stopped to protect others from rogue towing companies who take advantage of accidents victims and the loads they were hauling to benefit themselves
