Business Response /* (1000, 5, 2021/10/12) */ Thank you for notifying the company of Mr. *****'s complaint. We appreciate this opportunity to respond. An investigation of the grievance proved the company committed no wrongdoing. On April 9, 2021, Mr. ***** borrowed $2,200.00. The total cost of the loan was fully explained to Mr. ***** by the company's personnel, as well as on the loan documents in compliance with the Federal Truth and Lending Act. Based on the monthly income and expense information that Mr. ***** entered on his application, the loan's scheduled monthly payment was within his ability to repay. At no time did Mr. ***** indicate that he was confused about the terms of his loans. Notwithstanding the above, the company is a customer focused business and always tries to work with customers. With that said, in light of the total payments submitted and in a good faith effort to resolve this matter, the company agreed to settle Mr. *****'s account for a reduced amount. The company's Assistant General Counsel, *******, spoke with Mr. ***** directly and is pleased to report that he was satisfied with the resolution and agreed to submit his final payment on or before October 22, 2021. Thank you again for your assistance in this matter.

October 07, 2021 Last week I requested a title loan going in person to the Topeka, KS LoanMax on SW 29th, I handed them my car title and they gave me a check for a loan but it was a bad check, their own bank would not cash it. I took the paper check to them within 24 hours of when I requested that title loan and they refused to take the check back or give me my title back. They made me come back, drive to their location, three times on three different days and drive to both of their bank locations on two separate days to cash that check but their own bank would not honor their check. They continued to deny giving me my car title back and taking the check back that I handed them. This week they ask me to bring in the check and I did that but they still did not give me my title back. Please advise. Sincerely, ****** F. ******

Business Response /* (1000, 5, 2021/10/12) */ Thank you for notifying the company of Ms. ******' complaint. We appreciate this opportunity to respond. An investigation of Ms. ******' statements prove the company committed no wrongdoing. First, the check Ms. ****** received for her loan proceeds was not rejected by any bank. Second, Ms. ****** brought the check back to the company after she had already endorsed it for a mobile deposit. Nonetheless, despite her contentions, the company took the check back and rescinded the loan. As explained to Ms. ******, since she endorsed the check, the company had to wait until a 'stop payment' on the check was confirmed. Obviously, the company wanted to make sure that Ms. ****** did not deposit the check via a mobile device. After confirming the check was not deposited, the company mailed the title to her address on file (per Ms. ******' instructions). Should Ms. ****** need anything further, she should contact *******, the company's Assistant General Counsel, at XXX-XXX-XXXX. Thank you again for your assistance with this matter.

Oct 2020 I took out a title loan on my vehicle. I defaulted on this loan and in April 2021 my vehicle was repossessed and sold at auction. May 2021 I received a letter stating I was to receive a surplus amount of $667.80 120 days after I called to claim my funds. I called and was told Sept 20 2021 would be 120 days. I called again after Sept 20 and was told no funds were sent and no future date was given. I have been given no name, dept or date that helps me at all. Loanstar Title Loans, Wellshire Financial Services, and Select Mngmnt Resources have effectively stolen my funds from me. Can you help mediate a solution to this problem. I don't understand how a company that makes a profit loaning money cannot seem to pay their debts on time, or at all.

I took a title loan from ********* Title Loans and due to financial hardship had to relinquish the vehicle. A sale of my vehicle was held on 5/10/2021. The vehicle sold with an overage of the borrowed amount and consequently I received a letter on 5/12/2012 stating I was due a refund and could expect it to take 120 days. It has now been beyond 120 days and the ONE number provided to me has a lady who says she is a corporate office but can offer NO information on when I may expect my money. She states there is no one higher up to talk to and that basically I need to wait indefinitely. I have contacted ********* Title Loans local office and their "customer service" number and receive the same run around, yes they owe me money but no they don't know when I can expect it. I have never encountered a business who has no idea why something isn't being done and states that there is no one available within the company who can answer any questions. They owe me 2,674.58.

      Moved from Case# ********

I took out a title loan from Northwest Title loans, due to financial difficulties I had to relinquish the vehicle. The vehicle then sold at auction 5/10/21 and I received a letter of sale stating the company owed me ********. I called to begin the refund process and was told to wait 120 days. It has been well beyond that time and still when I call the "corporate" office I talk to the same lady, ***********************, who repeatedly tells me that there is no information on when the check will actually be sent. She tells they have to receive a "list" with my name but will not say who generated this magic list. I have called almost every customer service number for ******** ******************************************* LLC and LoanMax and get the same run around. This is clearly a fraudulent and thieving company who has no intention of paying their customers what is owed to them. There is no actual corporate department and no one in a higher position being held accountable for customer service and honest transactions. We willingly relinquished our vehicle to settle our debt and would like the same respect from this "company." They owe us ******** which is not a small amount of money and want them held accountable for the stealing they are currently doing. I've seen several complaints of the same nature and wonder how long they are going to be able to lie, cheat and steal people's money when, during these times, people are struggling. The company responsible for payout is ******** Financial Services, LLC dba Northwest Title Loans, via Loanmax.

An investigation of the grievance proved the company committed no wrongdoing. The local branch i got a loan from has not been very trustworthy in their dealings, infact they are crooks and i can easily prove it, i not going to discuss this in an open forum and im sure that defrauding a disabled veteran would be frowned upon by any judge and/or jury should i decide to take this to court. I need to speak with someone who is able to settle this ad if loanmax is not interested ill just move forward and not waste my time trying to negotiate. I am aware there is a forced mediation clause but being that from day one the branch acted dishonestly, i cant see any judge requiring me to follow a contract when loan max never abided by that same contract, . anyway, please contact me so this can be settled. I have filed a complaint with the CFPB already.

Business Response /* (1000, 5, 2021/09/21) */ Thank you for notifying the company of Mr. *****' complaint, we appreciate this opportunity to respond. An investigation into Mr. *****' grievance proved that the company committed no wrongdoing. On February 8, 2020, Mr. ***** borrowed $888.00. Then, on February 21, 2020, Mr. ***** submitted the minimum amount needed to refinance his contract. On that date, he also borrowed an additional $1,117.00. The total cost of the loans, including the fees and interest were fully explained to Mr. ***** by the company's personnel, as well as on the loan documents in compliance with the Federal Truth and Lending Act. Based on the monthly income and expense information that Mr. ***** entered on his applications, the loan's scheduled monthly payments were within his ability to repay. At no time did Mr. ***** indicate that he was confused about the terms of his loans. Thereafter, instead of paying off his loan off in full when due, Mr. ***** elected to submit the minimum amounts needed to refinance his contracts. Moreover, a review of Mr. *****' accounts reveal that he did not always submit his payments in a timely manner. The majority of the company's customers pay off their loans in a short period of time, which significantly reduces the amount of interest and fees the borrower pays. In closing, the company operates in strict compliance with federal and state laws, as well as any local ordinance, and has committed no wrongdoing. Nonetheless, in light of Mr. *****' complaint and his menacing and threatening statements toward company personnel, as well as the total payments he has submitted on his accounts, the company is willing forgive his remaining loan balance in exchange for is signature on a simple mutual release agreement. The company's Assistant General Counsel, *******, tried to reach Mr. ***** at his telephone number in the complaint, but was unsuccessful. With that said, if Mr. ***** would like to take advantage of the company's offer, he should call ******* at XXX-XXX-XXXX by September 29, 2021. Thank you again for your assistance in this matter, as well as the opportunity to respond.
