      We purchased a new home on August 10, 2023 in a PMC community( *******************). My complaint is about customer service or lack there of. We pay a ***************** fee which includes ******* cable. When we closed, we assumed that it was installed, it wasnt. I spent three hours with ******* trying to set it up and it isnt available on our street. I was referred to *************************** with PMC and throughout August, we were in weekly contact and she told me the cable would be installed on 9/1, this was a firm date according to her. I never had any trouble contacting ***** prior to 9/1. When the install did not occur on 9/1, I called her on 9/5 and she told me that they were supposed to have an update from ******* on the 6th or 7th and she would call me back. Since 9/7 I have left 7 voicemails for ***** without any return calls. I am not happy with being completely blown off by her. This is the kind of customer service you get for $700,000. I am frustrated by the lack of response and answers. This should have been done during the construction phase of the home. Now my wife and I are paying the price. It is frustrating not having cable/high speed internet for over a month and not getting any answers now that the deadline has passed. In my view, this should have been disclosed on our closing. It also frustrates me that we are paying for a service that isnt provided.

      ***** was sharing the date ******* was relaying to her.  ***** was on PTO 9/8 and 9/12 which were two of the days she was called and 9/9 was a Saturday.  Her last call to ****************** was on 9/15 and she left a message. ******* is a private company not controlled or operated by PMC. Sawnee EMC does not joint trench with *******  as does GA ***** and will not even take our work order until power has been run.  We have been calling ******* on a daily bases and provide information as it changes or becomes available.  We apologize for any inconvenience this may have caused, but please realize we are doing everything within our power to resolve this issue.  PMC  builds houses from the mid 300's up to 7 million and prides themselves on treating all customers with the same care.

      I am rejecting this response because:  An acceptable answer is not we have done everything we can and its not our fault. 

      We paid $2500 down and a monthly HOA fee for a number of items that we dont have. Gym, clubhouse, pool, security system and cable.  We were not told on closing that we would not have ******* for a number of months after the close.  No one has offered to reimburse us these costs, so the least I would expect is a timely response. The communication with PMC is very good pre-closing with sales, design etc..  however after closing it is another story. 

      I spoke to ***** on 9/5 when the cable was to have been installed on 9/1. She informed me that she would have an update on 9/5 or 6 and would call me back. When I didnt hear from her I called and left messages on 7, 9, 11, 12 and 13 and did not receive a return call until I filed this complaint on the 14th. Her voicemail message did not indicate that she was out of the office. I would have expected a call in less than 10 days on this critical issue even if she was out for two days. 

      I realize that we are small potatoes to PMC, as indicated by your response. However, I would just like to receive what was promised when we signed the contract and closed.

      Again we offer our apology for any shortfall in our communication which you have experienced.  We continue to communicate with ******* through our IT Department.  The information is then shared with your HOA as often as ******* updates PMC.  In your contract it clearly states we have no control over cable providers.  The latest information we are given today is that service will be available 10/31/2023.  ******* is on site running the infrastructure needed to make this happen.  The Resort will be completed in 18 months and there is a monthly update in your HOA Newsletter.

      PMC lied at almost every step of the construction of our new home. Beginning with the realtor (employed directly by PMC), who promised ** features for our home but were later never followed though with by the builder. When confronted, the realtor lied multiple times and then attempted to blame the builder. The builder, in turn, blamed the realtor and did nothing to fix the issue, simply stated it was too late to make changes - no refund. The design center consultants also lied about materials for our master bath, and instructed us that the builder would take care of it for us. When asked, the builder then pointed the blame back at the design center consultants. The result was that we didn't get the bathroom we wanted. The design center also attempted to charge us over $15,000 for a feature that we discussed multiple times, and had in writing, as included in our purchase. Only when we threatened to cancel the contract did they honor their original commitment. The builder then proceeded to lie multiple times about the ownership, maintenance, and after construction plans for our private road. The result was that they did nothing to it. Simply left it damaged and in poor condition. When asked about warranty coverage, the warranty department lied and deflected blame back to the builder. During the warranty process, the warranty rep consistently counseled us not to fix items because, 'the repair would look worse than the poor quality you see now.' He asked us to delay repairs, and promised us all would be fixed during the end of warranty inspection/fix. He never sent a communication about the 11 moth warranty, and when prompted to do so, never communicated a warranty date. When asked to schedule calls, he simply didn't do it, and then told us he wouldn't because the warranty period had run out. He cleverly ran out the clock. He then showed up and stated he would so some of the repairs himself, but isn't licensed, bonded or insured in the state of GA.

      We strive at Patrick Malloy Communities to be consistent with our processes and procedures with each home we build.  Contractually, we delivered exactly what we promised.  We followed the guidelines set forth by the municipality as well as the *** bylaws for this community.

      AS for the warranty process, we provide 2 opportunities for each homeowner during the 1st year to provide us a list of items.  We send out email reminders for each so they have plenty of time to provide the list to us (email reminder was sent on 4/20/23).  In this case, the owners failed to provide a list in the designated timeframe, although we had provided them a document back in May to do so.  Although the list was late, our warranty tech still went out in good faith to meet with them to review the list, to see if there was anything that we could still do, such as drywall/paint/caulk etc..  Upon arrival, the homeowner berated him for approximately ***** minutes, using profanity, about him and anyone that they had come in contact with throughout the process.  When this happens, it is our policy that we remove ourselves from the situation and can void the warranty in extreme cases.  Since the owners were technically out of warranty, we decided that we would not perform any work and let them know that.

      Also, we encourage owners to wait until the 11 month to have drywall (nailpops, etc.)/caulk/grout caulk, etc. completed, but they still have to initiate the list to us.  You don't need a license as an employee to perform such work as caulking/paint/drywall, etc...

      I am rejecting this response because: PMC did not contact me for the 11 month warranty check in, I contacted them. There is no evidence to support the claim that the warranty representative was 'berated'. He was asked to leave the premises multiple times and would not. He consistently argued with me and my wife and was extremely condescending and patronizing; not for ***** mins, for a full hour. We have the camera footage to prove our version of events. For example, he said, 'you know a house isn't maintenance free, you have to fix some things,' in reference to two door that would no longer close. PMC has consistently lied to me, my wife, and multiple residents in this neighborhood.

      I bought my house in March of 2022 in a ************************ a year went by and Patrick Malloy Warranty is one of the most horrible experiences I had to deal with in my life, most of my issues where either ignored or not taken serious, the only work they wanted to do was patch the problems instead of fixing them, I sent over 20 emails with proof with pictures to their warranty department and they dont do anything unless I call and send them more emails, a major issue was my Grass is all dead the grading on my lot was most likely skipped since all I see in my backyard and huge rocks growing into my grass and water puddles stuck in various areas of my home, YES water is seen *****+ after it has rained depending on the amount of rain it produced during that day, these people are so funny they told me is not flooded when they came by and it was not even raining the disrespect is beyond me, i had many companies come and tell me the grading and water drainage in my brand new home Is Horrible and is the reason why my backyard looks like a rodeo field, for some reason they used this low quality wood in my house that is bend everywhere they call my house The Wavelander not because of model but because every single piece of wood has a wave and bend into it while they built my neighbors house with ********************* making their looks nice and amazing while Im stuck with the Wavelander and the Walking Dead grass, I got a quote of 20,000$ to fix your horrible grading and fix drainage issues on a brand new home? If this helps i had 3 different builders work on this single house and they all 3 failed, something a hard working individual wants to fix for 20,000$

      We are very disappointed to see this type of ****** about our company.  We strive to provide an extremely pleasant buying experience to all of our customers.  In review of this complaint, the yard/sod issue is not a warrantable item after closing.  I have attached a page from the Patrick Malloy Communities warranty manual that describes this.  Our warranty tech visited this home on several occasions after a rainfall and witnessed no standing water within the 48 hour timeframe. They also witnessed that the owners had some work take place in the backyard that added some patio space to the end of the home in the rear.  This also could have altered the yard when the construction was taking place and could have killed the grass and caused some stress to the yard.  We have attached a document also that states what "Is NOT covered" from the warranty manual that states this as well.

      As for the wood trim, most homes are comprised of many materials, ranging from wood to composite.  ********** the market may dictate what material is used at any given time based on availability, cost, etc... These conditions are out of our control but we retain the right to change materials as we see fit, this is referenced in the contract.  Regardless of what material is used, there is a human element that plays a part in the installation process, so no home is going to be perfect, although we strive for it.  Also, as we all know, wood materials are subject to bow/warp/bend as they are exposed to the elements. Again, this is out of anyone's control.

      I am rejecting this response because: The history you guys have on my unit, does it also show and say that I was never given a final inspection? Can you pull out a document? I pointed out many issues during my homeowner orientation that are now  not warrantable and I was expecting them to be fixed during our final inspection; one I never had, one critical issue, the grass, the condition of it, the grading , also drainage after completely ignoring my homeowner orientation request to repairs like damage to WOODEN cabinets in the bathroom and Living Room, etc. and never giving me my final inspection I moved into dirty house with **** everywhere In the bathroom, my wife started crying when she got in the house which that was of course after 11 of my windows had to get ripped open and replaced 3 days before moving in, that is not all I get a visit from Canton sewage and water department right after moving in saying there was 500 Gallons!! Of water being poured Everyday at 8pm and they were worried there was a leak, they come to find out the builder set the sprinkler on at night and was flooding and destroying my Grass while it was being built for over 2 months before moving in which caused all the plants in the front of my house to drown and die before moving in! When I get your warranty agent he says WE DROPPED THE **** we own you this and that well I dont see a fix yet, I will admit there are some things they took a very long time to do but as long as the issue get resolved I have no complaints however those are the STANDARD warranty repairs well this is not a STANDARD CASE ( I have documentation and paperwork of everything and emails sent during the one year since purchasing a brand new home) the issues I had started Before any type of work was done in our backyard and where the work is done is not the target where the problem is located, we have reached  about the grass and the land not being graded correctly, at one point even while it was being built the land had problems with drainage and was told to the builder who is no longer part of the **** the person appointed to build my house buried my outside fireplace key and did not even connect the gas pipe, to my fireplace and I have this agent telling me that you guys inspected TOP TO BOTTOM! yet when I step outside I find a big piece of rotten wood and a buried non operational fireplace, and my white bathroom turned pink from all that **** that is impossible to clean, so who was inspecting my house Mickey ****** this is what I mean by disrespect, thankfully PMC DID take care of SOME of the issues the rest I had to take care of myself because I refuse to live 3-5 months with issues without a resolve before it gets worse, I also have been told by multiple companies from Local all the way to ATL and everybody says the same thing the grading and drainage is not good there is standing water in many areas on my backyard due to poor drainage and its killing the grass I called many turf companies, landscaping companies, etc. trying everything to get my issues fixed, the builder knowing this is a high wind, high rain, area in the mountains did not bury or put a single drainage pipe I had to do it myself and that is when it dramatically helped and again why do I have to do all this in a brand new home?

      I am rejecting this response because: I am definitely seeking going to arbitration and that will be my next step If you could send the information required or if there is form from your end that I need to sign ? your booklet says to contact you first before I proceed and I did over a year ago  trying to constantly get my issues fixed and doing it again now trying to fix the nightmare you guys left in my property, starting with where is my final inspection? Just because there is no final inspection there is grounds for builder negligence you guys robbed me of that privilege already, there is not a single document that I signed,in the community I live in I have an amazing Mountain Views I have nothing but time, patience, resources and the documents to provide and a strong case identifying the same issues Before closing and after closing, Ill let the mediator decide the outcome so please if you need my business email it is attached in the BBB file otherwise give me the contact to the right person to start the process because I will on my end.

Per the signed contract and the $ amount paid, kitchen Pendant pre-wiring was to be completed by the builder.Nature of dispute Not providing what was written in the signed contract Details of the Issue - We bought a home from Patrick Malloy Communities in 2021. As per the signed contract, the kitchen Island Pendant lights were to be pre-wired. When we recently had the electrician come to hang the pendant lights, it was discovered that pre-wiring was not done by the builder. Per the electrician laying wires for kitchen island pendant lights will need digging holes in the wall and is a bigger task now. We brought this to Patrick Malloy's attention as we are still under warranty. Patrick Malloy agreed that they miss the pre-wiring and has offered to pay a measly $250 credit. We do not accept this offer and want Patrick Malloy to get the wiring and the drywall patchwork done. The electrician gave us a rough quote of $400 for laying the wires which do not include the drywall patches and paintwork. We would like your intervention to resolve this dispute with the builder as they are refusing to do what was promised in the contract. Pre-wiring not done during construction is their negligence and they should get it fixed. We have received an email response from the ***************************** that they can only offer $250 credit and that too in the next 2 days or else the matter is closed at their end.

      We bought our house in May, 2019 and are satisfied with it and the ***********************. The issue is the site behind our house. There is a crumbling stone foundation on it full of rats. It was formerly the site of a slave house. Last know use was a barn. The rats have increasingly consolidated there since the development has grown. There are now 4 houses whose yards adjoin the site. Rats come and go freely from the site down into our yards and along the retention walls. We have repeatedly asked over the past year for PMC and HMS (property management company for PMC) to keep the vegetation cut down and ongoing rate abatement in place. Last year they mowed/weed whacked several times and placed two rat bait boxes in the site. The boxes have NEVER been rebaited. No weed whacking/mowing being done. We were told by HMS that they would be rebaited over two weeks ago. Hasn't happened. A man did come and do some weed spraying last week but no mowing or weed whacking. Today we were once again outside about 10 am having coffee and breakfast when rats started leaving/entering the site, coming down into our yards, running the retention walls and just scurrying around. Rats carry diseases which are transmitted by not just biting/scratches but via urine and ***** droppings.. This can infect humans, wildlife, and pets who then serve as vectors of disease spread to others. Despite many letters, pictures, etc the site is left in disarray full of rats and who knows what else. This is a problem that is not going to go away unless an ongoing abatement plan is enacted and maintained.

      Please note that the area in question behind the lot owned by ***************************** is listed on the final plat as an OUTLOT.
      The OUTLOT does contain a historical foundation which CANNOT be removed so building on that area is not an option.
      We have to be very careful not to disturb the foundation so we are limited on what we can do inside of the stone.
      We do spray to control growth and we cut just inside of the protective metal fence and around the fence for a width of approx. 1-2 feet.
      Since the homes on each side of the outlot had growth and rats were seen-we did place  a few bait traps. The bait has been refreshed.
      We are renewing the contract to continue the bait system to control any pests.
      A sign will be erected towards end of development on the outlot referencing the history  and will be of the type required by **** County.

      The area will continue to be cut/trimmed and bait system will remain for a period to be determined by the ***** of **********

      I am rejecting this response because:  The weeds remain, the two rat bait boxes are empty, and rats persist.  I just checked.  Nothing has been done except for when last week, a man sprayed some of the weeds which remain.  Over the weekend the rats had a great time.  They were running the retention wall, going in and out of the site, and jumping/climbing the wall.  We should not have to live with rats running around our yards.  What is the plan for ongoing care of this site to prevent weed/grass overgrowth and rodents with their disease?  What is going to replace the mud in front of site - grass? irrigation to maintain it?  weeds?  Anything?  When are you really going to mow down the weeds which are inside and all around the site and bait the boxes?

      Since the site must remain, it MUST be cared for ongoing with rodent abatement included.  Also, Please remove the fence surrounding the site from our property.  It is just a little bit, but will prevent us from building a fence to block the site once construction next to it is done.  We were NOT told this fence was even touching our property.  Also - why isn't there a name attached to this correspondance?  We included our names.  It would be good and proper to know who we are corresponding with.

      We are not disputing the fact that there was a failure to maintain by the landscape crew. We have met with the supervisor and he will be responsible for checking behind the landscape crew to make sure the crew keeps the sit maintained. ********************* (the supervisor) will be there with the crew and they are scheduled to arrive 7/20. The manager with the management company is also tasked with the responsibility of overseeing this as an area to inspect each month upon her site visits. Development and the manager discussed this on 7/19.
      The contract for the bait boxes expired end of June and the following then took place:
      Assessment done to see if there was still a need for the bait traps-determined there was still a need.
      Bids obtained to ensure best pricing found for service.
      Company selected and contract signed 7/19-manager will notify ****************** of expected date that the pest service will get bait traps refilled.

      A site visit will be set to review statement about fencing and if this is related to erosion control fencing or the metal fence surrounding the foundation. If ********* is on the property of Lot 25-it will be moved.
      Erosion control measures must remain in place to catch runoff per county.

      The slope on the outlot was adjusted allowing for ease of maintenance in the future. The area will receive seed and straw. Pricing is still in progress and should conclude soon.

      When PMC/HMS actually does these things, then we will accept.  So far, we have not found them to be reliable.  They (name not noted) just wrote that the rat abatement contract ended in June??????  The boxes were never rebaited or checked last year once put down.  What kind of contract is that?  The bait goes bad after a couple of months.  Regular ongoing care of this site needs to take place.   I hope the board of directors which includes their managing HOA owner, PMC lawyer, and PMC controller decide on a mowing program with more frequency than spring and fall mowing.  ************* is a beautiful community and was awarded ******* 2019 Community of the Year.  We take pride in our home and community, keeping our yard and landscaping neat and maintained, and want to enjoy our backyard/patio without rats running around.  So will the families that buy the 3 other surrounding houses.

      I am rejecting this response because:   There are two bait boxes at the site.  Weeds are growing back again.  Rats have decreased somewhat but still persist. We want PMC to maintain ongoing rate abatement at this site.  It should never be terminated.  There is no reason to believe that the rats who have lived there for many years will vacate the site just because PMC baited once or twice.   It is a natural habitat for rats/vermin.   When the site is overpopulated with rats they will spread out the colonies into our properties.  The bait boxes need rebaited every month or two.  Rats will not eat "old" bait.  There are many ********* both old and new in the site.  A permanent ongoing abatement program needs to be maintained both now and when PMC is gone and a new HOA is in place.  This site is abutted by four residential homes.  We are currently the only ones in one of these houses.  Whoever buys the other 3 houses will not want rats either.  It's a danger for people and pets etc.  A land survey done shows that a corner of the site's fence is on our property.  Clearly the site fence-not the silt fences.  It needs to be relocated so we can maintain a nice looking buffer between the site and our property and not have to use so much vegetation killer which is not good for the environment nor people.  This fact was not disclosed to us when we purchased our house.  We were told that the two houses behind us on either side of the "Servants' Quarters" were impacted but not ours.  We were told the site would be cleaned up, nicely maintained, and a historical plaque placed on it.  After complaining multiple times to PMC/HMS and then finally calling on the **** County ************ was anything done.  We were invited along with our former next door neighbors and the people across the street from us to participate in a group to talk about the site with PMC and historical society **** Cty.  Never happened.  This was clearly a lie and just a ploy to stop the complaining.     Frankly, while we like our house if we had known these things in advance, we would never have chosen this one.  We have as yet to know of any person to contact as they will not let names be given out, email addresses, phone numbers, etc.  We have no idea who is even handling this complaint from PMC.  We have never had a business act like them.  We have zero trust or confidence in them.  What on earth makes them think it is ok to have a crumbling slave house foundation be weedy and home to rats, snakes, and other pests nestled by four houses within feet of this?  What makes them think a once and done approach to abatement will be effective?  The rats don't understand this - it's home to them and will continue to be a safe haven unless permanent ongoing abatement occurs.  We also find it very disrespectful to the family/trustees/etc that sold PMC the land for development with this in mind.as well as the former slaves who were once housed there.  PMC can and should do better.  What would they expect if we owned this site and they lived next to it?   In summary, we expect:

      I believe we have made every attempt to respond to the concerns of *******************  The bait stations have been refilled and the contract has been renewed.  The lawn care company has been told to make weekly visits to weed eat the area and the supervisor has been told to follow up to ensure this is happening. On the 3rd point, the fence is over the property line on 2 lots and the go ahead has been given to have them relocated - that should be happening in the next week or so. Thank you!

      I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me at this time.  However, I have ongoing concerns.  The bait stations have been refilled.  They need to be maintained with fresh bait every couple of months.  Rats will not eat old bait per literature review.  This needs to be done ongoing - not just until the current contract runs out.  They have seeded the front side of the site.  Weed whacking has occurred on our side (no seeding) and inside the site (no clean up or seeding).  Vegetation killer was applied.  Weeds are now growing back. Maintainance needs to be ongoing - not once and done.  Rats have decreased but still seen in the area.  Yesterday the fence around the site was relocated.  PMC has not said what the final plan is for the downhill side of the site.  (i.e. behind our house and our neighbor's house)  Just lots of vegetation killer?  This is a bit of a concern as when it rains moderately to heavy a waterfall cascades over the retaining wall.  This was shown to them months ago.  No action taken to stop the runoff.  I have zero to little confidence that they will uphold ongoing maintainence of this site.  Time will tell.
