      12/30/22 was looking for help with my sexual assistance on getting an erection so I saw this ad on tv that they would help. So I drove 50 miles to ************* to a clinic called ************************** on *******. I had just had a traumatic event where my world ended by losing my wife and everything in a house fire and so I was looking for help to start over on looking for someone who would help me with my life, as I went in there to get help I explained to **** my problem and he said they could help they put some vibrating tool below testicles but I could not feel anything so I told him it was not working went maybe 2 more times and I could not feel anything. So I told this was not working and I was driving 100 miles round trip so he said he was sorry and I don't think I should have been charged for these medical services that did not work. So I'm 68 years old I have given up but the VA is helping me have other problems service related. Thank you and please help me this problem because I believe it does not work and believe it was a scam I'm probably not the only one.

      Momnt offered an interest free financing arrangement for custom replacement windows ordered from ****************** (now out of business) in ***********. My sister and I own a house there that needs considerable renovation. This was April 2023. No deposit was requested for the order, though I began making payments (eventually totaling $905.20) in the following months. When it became apparent in late September 2023 that no windows were ever going to arrive, my sister discovered that Aesop's Gables had gone out of business and were not contactable. I immediately complained to Momnt (I have retained records of all complaints and correspondence). Momnt appeared to be interested; they "suspended" the loan while they "investigated," and gave me a "provisional" credit for the outstanding loan amount. For more than a year. I was informed late 2024 that I stilled owed them $15,755. They will not listen to reason, but expect me to participate in the fraud that was perpetrated against me. They have been calling me daily to comply. I will not. Momnt seems to be in the business of enabling scams that defraud consumers.

This financing arrangement was intended to fund goods and/or services to be provided by *********************. It is important to note that Momnt and **************** were not parties to the agreement betweenMichael ***** and Aesop's ************* regarding the provision of goods and/or services mentioned in the complaint.


      Our records indicate that ******* ***** electronically signed an Installment Loan Agreement with **************** on 4/11/2023, acknowledging the terms and conditions of the financing arrangement and authorizing a loan disbursement to Aesop's ************* for $15,755.00 on 4/28/2023. This agreement was executed following a request verified via a phone number linked directly to ******* Clarks name.


      Understanding the concerns raised, Momnt conducted an investigation into this matter to explore potential solutions on ******* Clarks behalf. Unfortunately, despite our efforts, we were unable to secure a resolution from **********************


      While we empathize with the difficulties Mr. ***** has encountered, the terms of the Installment Loan Agreement remain binding, and Mr. ***** remains responsible for fulfilling the obligations under that agreement. We encourage him to continue addressing the matter directly with Aesop's *************, as they are ultimately responsible for delivering the agreed-upon goods and/or services.

      I am rejecting this response because:

      I find it inconceivable that a reputable consumer loan broker would proceed to pay out to a construction firm the entire amount of a project that had not even begun. To do so clearly deprives the consumer of any recourse if the project fails. In my case the project did not even begin; Momnt essentially handed over my money to a thief who then left the scene of the crime without a trace. It never occurred to me that by signing up for a 0% financing package I was signing away any hope for holding the contractor responsible.  I assumed the first payments I made were in lieu of a deposit to the service provider (*********************). I assumed that my money was being handled responsibly by a financial firm that had "vetted" the business (per one agent I spoke with on the phone). Why should I believe that Momnt's practices are anything less than enabling of disreputable businesses?  When I discovered the fraud, Momnt proceeded to leave the impression that they were going to resolve the issue (see notifications I received from Momnt between the fall of 2023 and fall of 2024). Instead the scammers had a full year to disappear and cover their tracks. When did Momnt learn of Aesop's Gables scam transactions? Was Momnt aware of the numerous complaints that consumers had already lodged against Aesop's Gables by the time my first request for contracted work? If not, why not? Was I the first to alert Momnt to the fraudulent nature of Aesop's Gables?  Is Momnt really taking no responsible whatsoever for this scam?

      In January of 2023, I went into ************************* for ** consultation and agreed to a medical plan. The plan was quoted to cost $9200, and included 12 ** *********** ******* had me apply for financing through Momnt. I was approved for the financing with a 24 month interest free rate. I started my *********** 5 treatments were completed. When I called to schedule my 6th treatment around Nov 2023 I was informed the clinic was closed and no longer in business and they were being investigated for fraud. We called Monnt at that time to talk about payments as we were considering paying them off in full. At that time they told us to not pay anything as they were taking legal action against Wasatch medical and going to resolve the issues that way as there were multiple people involved in the scam and same situation as me. They gave us a ticket number #**********. I had not heard, been contacted in anyway until now 01/23/25 requesting payments because now it was out of the 24 month interest free period. When explained the situation they offered a settlement of $9200, then the second ****** offered settlement of $8552.55, if paid in full by 02/15/25. We see that Momnt won a lawsuit against Wasatch in the amount of ************************************************************************************************************************* to pay. The scam was identified we followed the instructions from Momnt to do nothing due to the lawsuit and fraud, they should not be seeking payment now even after they won a lawsuit.

      This letter is in response to the complaint submitted by ***** ********* to the Better Business Bureau on 02/05/2025 (the Complaint). Momnt has reviewed ***** Vanvalliss concerns as stated in the Complaint, which has been assigned a case number of 20945841513.  We understand that the Complaint expresses concerns about a former merchant in Momnts program, *********************** and/or its affiliate companies (collectively, Wasatch).

      Momnt provided the electronic application platform that ***** ********* used to apply for and obtain a loan from *********** to finance goods and/or services to be provided by Wasatch.  Momnt and *********** were not a party to the agreement between Wasatch and ***** ********* to provide the goods and/or services at issue in the Complaint.

      Momnts records show that ***** ********* executed an Installment Loan Agreement with *********** on 12/13/2022.  When ***** ********* entered into the Installment Loan Agreement, He confirmed the terms and conditions of the financing arrangement in addition to authorizing the loan amount to be paid to Wasatch.

      Momnt maintains records of the loan agreement electronically signed by ***** ********* on 12/13/2022 acknowledging the terms and conditions of the financing agreement. Momnt also maintains records of the loan disbursement request(s) authorized by ***** ********* in the amount of $9,200.00 on 12/13/2022 via a phone number directly linked to ***** Vanvalliss name.

      Momnt takes consumer protection and customer satisfaction seriously, and to that end, its merchant agreements require its partner merchants to comply with all applicable laws and fulfill all obligations to its customers and prospective customers. Additionally, when a customer disputes the delivery, quality, or performance of the services provided by the merchant, the merchant has certain obligations to Momnt in responding to such disputes and handling of associated loan proceeds.  A merchants failure to comply with these obligations is a breach of its contract with Momnt.  Based on a breach of those obligations, Momnt filed a lawsuit against Wasatch in the **** District Court for the Northern District of Georgia (the Litigation). Although Momnt obtained a judgment against Wasatch as a result of the Litigation, Momnt has been unable to recover any of the funds it is entitled to under the judgment.

      Accordingly, ***** ********* is responsible for HIS obligations under the Installment Loan Agreement with ***********.   Should ***** ********* have any questions, he may contact our customer support team, at ************ between the hours of 8:00 am to 8:00 pm ET Monday through Friday.

      My name is ***** *****. I live at **********************************************************************************. In 2022 I saw an advertisement on Chicago TV for ** treatment at ************************* located in the ******* area. I made an appointment and was told the program could help pay for the service thru a finance company Momnt. I had about 4 or 5 sessions and I paid $400.00 each session for the service lasting about 40 minutes each session. I was told you only pay when you have a session or treatment which I did. Later in the year I made an attempt to get a treatment and found the doors locked and no explanation why the business was closed. I tried calling, no answer. I called Momnt finance and explained what happened and that I would not need their service anymore. In 2024 I started getting texts and letters from Momnt saying I owe them for services I did not receive. I feel this is wrong and the I should not be charged for service I did not receive.

      I signed a contract with ********************, fraudalent company which used MOMNT for home improvement credits. They charged me 900 USD cash deposit + ***** USD credit deposit that MOMNT transferred to the contractor's account directly.The contractor never replied to me nor showed up for any job in my house. While reporting this issue to MOMNT I raised the claim that the contractor was fraudalent and was using MOMNT credits to ask money from people. There was a bunch of people scammed by this contractor using this credit service. When I reported the situation, MOMNT suspended my credit.After a year of visits to court, the Judges in **** Arundel and ****** Counties in the state of Maryalnd, held contractor accountable for his actions, determined he was guilty and should be responsible for the damages. Now, MOMNT is asking me to pay the credit amount transferred to the contractor account and not to my account.They claim the case was reviewed but they never called me or gave me an status for this case and how they arrived to the conclusion that I should be responsible for that payment. Until Nov 2024 where MOMNT resolution was that I should pay for the balance of the credit. Again, the money never arrived to my account and I will not pay. I have asked MOMNT support to explain this and since then it has been 3 months without an reply.

      It is clearly an automatic message. I already stated the following:

      - I authorized the credit but the money never reached my account.

      - I was the one who notified MOMNT about this fraud, they were not even aware when I call your customer service, otherwise the fraud will have keep going on and on.

      The business is not longer in operation, as the place was "burned". I welcome you to give the business a call, if you can. Feel free to ****** the address and check the news from 2023.

      - The Judges in **** Arundel and ********************* in the state of Maryalnd, held the contractor guilty. If there is any settlement it will be only for the money I paid in advanced not for the money MOMNT deposit on their account.

      - The owner was sentenced to 6 months in prison into the Howard County Jail. Even if he  is released, I will not deal with fomer convicts.

      - I have not received any proof or evidence on MOMNT investigation and how you arrived to this conclusion.

      - I am not responsible for fullfiling any obligation as you become part of the the fraud while not checking backgrounds on the companies you work with.

      - There are at least 19 people affected on this and I am willing to have a collective law suit to stop fraudalent companies.

      - It is MOMNT responsability to deal with contractors, I already went into a law suite with this company and I suggest you should do the same to get your money.

This loan should have been terminated already due to the contractor to which I applied for this loan through reported to me that they went bankrupt and this could not provide the goods and services (windows + installation of windows). Since they are the ones that broke the contract, I should not be responsible for paying this loan. I reported this incident immediately upon finding out. Over a year later, they MOMNT is now demanding I pay for the loan, despite reporting they are still continuing investigation. I'm calling into question their investigation as part of their investigation should be reaching out to me to verify if I did in fact ever received the goods and services. I do not have new windows and it would be an essential part of an investigation. It should be illegal to demand payment while they have yet to make a determination, and their investigation should be called into question for not including verifying receipt of goods and services by the consumer. Their argument for forcing me to pay for the loan is that "permission was granted to use the funds from the loan", but permission was never granted to take the funds and provide nothing in exchange. It was permission to use the funds based on the agreement that I would be receiving a set of windows and an installation of those windows in exchange of payment. They are attempting to pin the loan on me by using manipulated language that implies that I am responsible for allowing a company to use funds from a loan MOMNT provided directly to this company. I never once even touched the funds, they were provided directly to the contractor to which they likely had a business partnership with.

      We were solicited off ******** on or about 07/26/2023 for a quote for a bathroom remodel. We were contacted by a company named ***********, who sent a sale *** to the house to show us different designs and materials. After my wife and I decided on the bathroom remodel design we wanted, we filled out a form to apply for their special 0% down, 0% percent finacing for 12 month through a lender named Momnt. *************) customer service number., located at ******************************************************************************. The ***resenative **** Prime, ( Bath Planet) , explained that we were apporoved and a *** would be by the house in a few days to take measurments. As he advised, we were contacted by the ***resentative and they showed up to take measurments at which time they explained their material and tubs are made in ******** and would would be availaible around October. We immediately recieved payment request from Momnt which we thought was unusual, however the company had a good ****** rating and seemed legitimate. We made payments every month until, we didnt hear from Bath Planet in October, and attempted to reach out, whereas the phone numbers were disconnected and the business was no longer at the address listed on thier invoices. . We called the corporate office located in ******** and spoke to customer service, whom explained that they were aware of the sub-contactor issue, and advised to dispute the fraud with Momnt. We called Momnt, whereas they acknowledged the known issue with the company and stated that they appologized and they will investigate. Recently they updated my account back to active whereas a ***resentative told me they understand that fraud occured, involving Momnt and their business affliat, ***********, however I need to pay the amount of the loan. I re-explained that we never recieved goods or services, how can we be charged for the loan. They ***eated themselves and advised I need to pay the amount of the loan.

      I am rejecting this response because: While most companies use lending institutions to assist their business, the lending practices that Momnt performs by releasing funds to their business affiliates before such services or good have been provided,   are predator in its design. If I as a consumer gets approved for a car loan and the dealer fails to deliver the car to the consumer: does the consumer still pay for it? Momnt has a a legal obligation to protect the consumer/borrowers from fraud. Their business affiliate, ************, had been in business less than a few months, and the owner had open and closed multiple businesses in the same time frame, which suggests fraudulent activities, a scam.What or how does Momnt decide on who they align themselves with? How do they protect their own reputation by aligning themselves with predator business? What common practices does momnt utilize that has allowed consumers to be victimized?

      On 1/9/23, I visited ************************** for a scheduled appointment. It was to learn more about the acoustic wave treatment process. I met with a gentleman who gave his first name only. He explained the procedure, cost and benefits. He also mentioned a complimentary treatment was included with introductory meeting and a signature was required. I left undecided and never returned. Recently, I received a letter from Momnt Technologies Inc indicating that the two year grace ****** was over and payment was now due. I am being billed for a service I did not agree to or receive. The introductory meeting was convoluted. ************************** is now closed and under investigation.
