I purchased a 2016 *** 535 i from AX Auto. My vehicle was totaled and a refund check of $1829.65 was issued to them on my behalf from Alpha Warranty on April 19, 2024. This was a warranty that I paid for, for my vehicle. I have called AX Auto from March of 2024 until current to get my refund check from them but no one will return my calls.Business Response

Hey Jamiylah,
This is incorrect. If you include an extended warranty at the time of financing ( Which you did as its clearly broken down in your contract) and you cancel the warranty, Yes we cancel it and receive the refund which *has* to go the lender due to the fact that they paid for it and financed you the amount. The check does not come to you unless you pay for it yourself out of pocket and not include it in your financing. It was sent over to your lender. Any further issues you may be having should be redirected to your lender.

I am rejecting this response because: I did pay for the warranty. When I paid for my car payment, I also paid for the warranty. The money that is due to me is the amount I paid into the warranty before I cancelled it. The warranty company has also tried calling you to explain this but no one returned their calls either

I purchased a Lexus NX 2019 fro. AXAuto dealership in February 2023. Shortly after purchase I noticed the car was making a squeaky sound. I reported it to the dealership and I did submit a previous complaint regarding this matter and was told that my warranty should cover the repair. However the dealership I took it too refused to do the work due to parts needed and not covered under their cost and it was unclear how much I would have to pay out of pocket. Today I brought my car into the Lexus dealership for yearly maintenance and appraisal at which time I was presented with a Carfax report and it was noted this vehicle is classiest as Salvage. I was additionally informed it is illegal to sell a salvage vehicle and I was not informed of this at the time of purchase. I am requesting a monetary settlement so I can purchase a new vehicle as well as return of the money I put down to purchase this vehicle.Customer Answer

I am rejecting this response because:No where in the documentation does it state this was a salvaged vehicle. When I viewed the Carfax report on their site previous to purchase the report was not 9 pages long. It was only 2-3 pages showing previous ownership and update of title. Its Ax Autos responsibility to make the buyer aware. They knew the condition of the vehicle and knew it was illegal to sell me this vehicle. I will be consulting an attorney on this matter.

I was never informed of the previous damage. I was not asked to sign any document to confirm I was informed of any damages. I wouldnt not have purchased this vehicle if I was informed. Why would I invest in vehicle with this history knowing it has no trade in value?

I bought my car march 12th , a week later I had to bring the car back for them to fix the o2 sensor , two days later after picking my car back up the check engine light is back on , they have had my car 4 times since Ive bought it. They rebuilt the car because it was a salvaged title and they car was not ready for sale but they lied to me and sold it anyway. I recorded every conversation and took pictures of everything that has happened. When I told them I was seeking an attorney they tried to send me emails and lie and come up with an issue. Looking at the reviews on yelp , its a complete fraud ! I spent my hard earned money for a good car that I have. To constantly get fixed. They are rude and they just took my money. Then they also wouldnt provide me and my husband with proof that they replaced parts or even fixed my car. They said they dont have to give me documentation.Business Response

I purchased a Tesla from these people. Initially everyone was so helpful and accommodating for a sale and support until two months later when ***** called me and said my car was registered as a total loss and unable to use any Tesla features including charging. I called to complain and got the run around from everyone claiming as is but swore to me the car had no issues during the sale process. I even spoke to the owner who said he previously owned my car which furthermore solidifies these people should not be trusted at all!They will charm you into a sale.. sell you a lemon.. and leave you with the problems and a car note.. o purchased a santa ********** and the driver side the door does not lock they did not make us aware of this. I keep calling and calling no response and then if you get somebody, no return call the sales person name is ***** purchased the car in September and now it is February so I had the car for five months and it shut off. They should not have sold this car due to the door lock and the key does not open lock the door and only starts the car and now it's not even starting the car. I called and left messages. Spoke with me. No return phone call as of today, the place seem very shady to me anyway, but looks so good on the outside, but in the inside the key gave me does not lock the door they should be put out of business. I have bought cars from various places, but this is the worst place ever so now I have to pay to get this door fixed or locked that they sell it to me after locked and with ****** only starts the car and now the car is not starting. I went on September 7th to look for a vehicle. I was pushed into getting this **** There were thi ga wrong with it that I was told to bring back and they would be corrected. I bought the car back and they claimed to have fixed the issue but the next day the same issue occurred along with other issues. I went to AX Auto in February of this year and test drove a Lexus NX 300. I began the process to purchase the vehicle and submitted s total of $5500.00. When arrived to pick up the vehicle I went for another test drive and noticed the vehicle was making a squeaky sound. The associate by the name of ************************* told me the the spare tire in the trunk is being covered by a big foam cover and is causing the noise. Over time I forgot about it but noticed the sound would be intermittent and removed the foam piece but it continued to make the noise and seems to intensify. When I was scheduled to take my car in for maintenance I informed them of the sound and they took pictures after running a diagnostic on the car and showed me the vehicle must have been in an accident prior to my purchase of the vehicle. There was no repair made and this was why the sound was intensifying at times. I was informed in order to repair it, it would cost approximately $4,000.00. Additionally soon after I completed purchase of the vehicle I noticed a streak on my windshield. I initially thought it was dirt but after touching it noticed it was scratches embedded in the glass from the windshield wipers. I called AX Auto and informed them of this and they claimed not to notice when I requested some form of partial return in price of the vehicle because I reached out to to my auto insurance and received an estimate of what it cost to fix. I was told it would be approximately $800.00. AX Auto instructed me to fudge the details of how and when the scratches occurred to my insurance company in order to ensure coverage without cost. I am requesting $5000.00 in order to fix my vehicle due to neglect on their part.Business Response

I am rejecting this response because:I received a message regarding my complaint against AX Auto but was unable to respond to it. In review I saw the message was sent on 8/16 but didn't receive notification. In the message they state I didn't reach out to them within the two months of warranty to address issues with my vehicle and this is incorrect. I reached out multiple time regarding damage to the windshield and as I noted in my complaint I was instructed to fudge the details of how the damage occurred in order to ensure coverage from my auto insurance. I should at least be reimbursed for the windshield as they I did outreach regarding this matter.

I am rejecting this response because:1. During the time of my second test drive of the vehicle the dealership associate lied when stating the squeaky sound I inquired about was coming from the spare tire in the trunk area sitting on a piece of foam. He's an experienced sales associate with more than 20 Yeats experience and is fully aware the issue had nothing to do with the tire.
2. The dealership is required to inspect vehicles before putting o=them on the sales floor. I find it hard to believe they didn't know about the accident that was listed in the CarFax report and the scratches on the windshield.
3. I address the issue of the windshield and even sent pictures. I requested assistance in repairing the issue and was told to lie to auto insurance to ensure coverage of the repair despite knowledge of all red flags related to use of insurance immediately after receiving it.
AX Auto should be held accountable to provide financial coverage.

I drove down to Atlanta initially on Saturday, 06/17/23 to look at the 2018 Infiniti Q50. Mo was the salesman. 1st red flag should have been that I could not test drive the vehicle; it was in a crowded indoor car lot surrounded by many other cars. We started ******* sounded fine. I sat inside, looked at all features. I liked it & completed required paperwork. Because I drove down alone in a rented car, I asked if they could deliver to ****** needed it by the following Wed. as I had to return the rental. Mo said NO PROBLEM. It did not get to me by Wed. so I had to extend my rental the rest of the wk (so I wouldn't be left w/no transportation) & a friend drove me back on Sat., 6/24/23 to retrieve the car. The driver's side front tire sensor said the tire was ******** assured me this would go off after driving a few miles. I made it back to ********* & this problem persisted. Also, before I even made it out of *******, I noticed smoke in the rear-view mirror. The interstate was crowded; I was hoping it was another ******* did not see the smoke again. I made it back to **** & the tire sensor was still malfunctioning. I called local Infiniti dealer & made an appt. to see if they could reset. On the way to the local **** dealer, I saw smoke again! When I got to local dealer, I asked if they could look at the engine. They did inspection & found multiple oil leaks & probable engine sludge. They also pulled a car fax & determined prior owners took very poor care of the car. Repairing these issues will be quite costly. I contacted Mo to see if they could help since I hadn't even been in possession of the car 1 wk. He said my only option was to get extended warranty & do the repairs myself. In a panic, I purchased extended warranty but slept on it & decided I'd rather not deal w/this in a car I just bought. I asked ** if I could simply bring the car back since I had not even had it 1 ******* said NO, unless I wanted to "trade it in" since the vehicle was now mine!Business Response

On June 10th I called AX Auto, **** regarding a 2012 GMC Terrain (VIN *****************) which AX Auto stated on their website had ****** miles. I asked about the salvage title listed on their website, to which she said that it does not have a salvage title but that the car was stolen, and the insurance company paid out on it so that makes the title a salvage title until the insurance agent performed a 155-point inspection certifying the car again. She said that the dealership is allowed to sell salvage titles. When I asked about the extremely low mileage of ****** for a vehicle that is over 11 years old, she stated that the mileage had been verified, however when we went to the dealership, the CarFax presented by the salesperson had very obvious gaps in the records.Further, the salesperson changed her story regarding the salvage title once we arrived at the dealership stating that she was mistaken about the theft story that she told me earlier but rather the real story is that the vehicle had suffered extreme water damage which is the reason for the salvage title. We instructed her that if the salvage title could be removed and that she was sure of the low mileage that we would purchase the vehicle. She then told us that she would wash the vehicle and fill it with gas while we went home to complete the paperwork and that by the time we returned, everything would be good, and we could drive the vehicle home. An hour later, I received a call from the dealership stating that the car had been sold after she told us that we had a deal. The way that this dealership dealt with us is very unprofessional and appears to have some unscrupulous and unethical activity going on. I am also going to file a complaint with the ************************ such that they may look into the activities at this dealership.Business Response

I am rejecting this response because you stated that we did not leave a deposit, however when we asked the salesperson if we needed to leave a deposit, she stated that we did not leave to leave a deposit at that time and that we could take care of all of that (the deposit included) when we returned to pick the vehicle up. And if she denies that statement, she is not telling the truth.Further, you did not address the issue of the low mileage discrepancies and the title discrepancies. The different stories that the salesperson told about the damage to the vehicle. Further, we did some research only to find out that you lied regarding the damage to the side of the vehicle.
There is something that is not completely legal with this business and when your salesperson found out that I went to ****************, we were told that the car was sold. As I stated before I am going to take this matter to the ************************************ and to the ************************ (FTC). It is no accident that you have a BBB score of 1.8/5. The public needs to be made aware.

I am rejecting this response because: As I stated before, your salesperson told us that we did not need to place a deposit on the vehicle before we left. I stated all of this in my previous emails. Are you deliberately not reading the entire messages or are you playing a game? Either way, this is a serious matter that needs to be addressed and that the public needs to be aware of the "bait and switch" game that you play. The ************************ and the Consumer ***************************** will be in contact with you as soon as possible and they won't simply take your word for how your run your business but will dig deeper to find about the issues with the title and mileage discrepancies which you have not addressed in the many times I have asked about it in this exchange. Internet ad for a Used Vehicle For Sale at dealership. Son texted screen shot w/photos/price $18,800. I went to website & saw ad listed $19,800 with line through it with $18,800 in red lettering. Put 500 deposit down. 4/24/2023, ******* Mom went for test-drive. They were told of "issues". Mainly, title is "branded" as it is "flood car" from *******, **. Son insisted on purchasing vehicle. $5,000 down payment. Initially, the Sales Agreement listed price $18,800. They added Extended Warranty $3,000. This was printed on paper. We declined Extended Wrnty. They advised this could effect interest rate; it was ****%. They did not print new Sales Agreement. It was emailed to him to docusign. He did not think he had to re-read the whole agreement as he had just looked at the one printed. However, they adjusted the sale price from $18,000 to $21,800. They adjusted the interest rate to over 19%. They did not disclose this to him. He is looking for highlighted boxes to initial or click for the docusign. His screen is cracked. & couldn't read the contract in its entirety. We received pdf's later in the day. I phoned this ************** said the contract has been processed. They claim they advised my son and his "grandma" that there could be changes made by removing the warranty, but they did not declare the changes and were sneaky by not printing it out for them again. I co-signed. They rushed him to docusign & send to me, for me to rush & sign, stating he had looked it over & approved. Yes, he/we docu-signed the contract. They misled him by printing one contract w/sale price of $18,000 & emailing him revised one; without stating changes, to a cracked cell phone & ******* him to sign. Out of the $5,000 in cash, they kept $3,000 by deceptive practices. They claim these are Lender Fees charged due to him being a first time buyer. When we rejected the warranty, she felt confident business would be handled appropriately. She left to drive home, trying to avoid some of the ******* traffic. Once she left, they did not reprint a physical contract/purchase agreement. It was emailed to him via docusign. They did not verbalize the changes to the purchase price or the interest rate. This was his first major purchase. There were three of them and one of him. There was no truth in lending. They took advantage of an eager young man who was desperate to get a vehicle that day so he didn't miss any work.

We absolutely do not take advantage of any of our customers. We made everyone involved fully aware of all approvals. We did not wait for anyone to leave since all approvals were explained to everyone prior to her leaving our dealership. As per our prior response, we dont rush our customers into signing anything.
