*************************** ******************************************************************** February,28, 2024 ************ To whom it may concern I am writing to you today to file a complaint against Heritage Place Civic Association, **** located at PO Box 1496, *******, ** *****. I have been the owner of my rental property since 2004, and I have always taken pride in being a responsible and law-abiding citizen. However, recent events have made me feel that the association is treating me unfairly. Heritage Place Civic Association, **** has started to harass my tenants without any reason, despite the fact that they have been living on the premises without any problems for over ten years. Additionally, the association has requested me to pay a rental fee of $599.00 to rent my property, even though this was not a part of the covenant when I initially bought the property. I have never paid any rental fees in the eighteen years that I have owned the property, and I find it unfair that I am being asked to do so now. Furthermore, there were a few fees from the home owner association which were a set amount, but gradually the total keeps going up. They have concluded that I owe them $6,500.00 and now the total owed is $9,353 this is with payments already made. I have tried to make arrangements to pay this amount by setting up automatic payment on the 30th of each month through their law firm. However, they changed the law firm they were using and stopped taking money from my account. I tried to contact them several times, only to find out that my name had been sent to a collection agency in *******, and I now owe a larger amount than what I was initially paying. I feel that I am being treated unfairly, and I need your help to resolve this matter. ***************************

    Business response

    03/06/2024

    Good morning, BBB,

**************** has held a delinquency status with Heritage Place Civic Association, *** since 2008.  Thus, we are responding to a complaint from this owner and her tenant as well that has no regards for our Covenant and Restrictions within Heritage Place.  **************** only started to pay because Heritage Place legal team processed a judgement that was granted and a payment plan that was agreed upon.  **************** only paid 9 installment payments before we changed property management companies and legal attorneys.   Heritage Place sent out notice to all homeowners of this change and **************** was in that distribution list.  **************** claims that she tried to get in contact with us and yes she did 8 months after she stop paying.  **************** has our email address and has been in contacted with us many times through email.  So, the excuse of not being able to contact us is not true.  She has had plenty of opportunities to contact us.   As far as, her complaint of us harassing her tenant, this also untrue.  Her tenants have to follow the same CC&Rs as the rest of our homeowners and her tenant has misinformed **************** with misinformation to avoid being caught with non-compliance violations that have occurred on ******************** property.  **************** stop paying her installments and claimed she couldn't get in touch with us and that is also false.  **************** still continues to not pay her past due balances and because of this, she was sent to collections to recover the association's dues and fines created by her tenants.  As of today's date, March 6th, 2024, **************** owes Heritage Place approximately $10,000.00.  In summary, she's a property owner with tenants that she collects money from monthly, but doesn't want to pay the Association their monies that are owed to the community from an obligated signed deed agreement, upon purchasing her property withing Heritage Place Civic Association.

    Sincerely,

    Heritage Place Civic Association, *** - ***** of *************
