Georgia Carolina Auto Auction facilitated the sell of a ************************ which the seller, ***************** of ******, **, did not disclose frame damage. It wasn't until I attempted to resell the vehicle through ******************** that it was discovered that the ** *ail/******* was kinked 3" to 4" and the * Apron was kinked 1" to 2". This announcement has now led to offers being made about $10,000 less than the equivalent offers being made when it sold prior at GCAA. GCAA is refusing to accept responsibility nor allow arbitration. I did not even receive the vehicle from GCAA until AFTE* the arbitration timeframe had expired but yet I was just now sent a "presale inspection" report that was dated 12/08/21 by GCAA.

I am responding to complaint ID ********.

To start at the beginning this van was purchased on 12/06/21 through OVE (Online Vehicle Exchange). Once a purchase confirmation is email to GCAA, we begin to facilitate the sale, we are not the owner of these vehicles. We only process the paperwork, collect payment and title for each transaction. When the vehicle arrives at our location, we do a curtesy walk around on each car unless the purchasing dealer requests and pays for a PSI (post sale inspection). A PSI was not requested for this vehicle. The van arrived and the walk around was done. This walk around is for visual exceptions we *** find that do not match the original listing. Make sure miles match what was on listing, report any dash lights that *** be present at that time. After the assessment there was nothing that the buyer or seller needed to be contacted about so the van was released. The buyer did not pick up the van until 12/17/21. The first time I spoke to anyone from the purchasing dealership was at the end of March 2022. He said that the airbags had been deployed and that it wasn't announced in the listing. According to NAAA & OVE policies, this isn't an arbitrable issue. Not to mention the lapse in time. According to same guidelines the purchasing dealer has 10 calendar days to initiate any arbitration claims. I also informed him that airbag deployed was on the CarFax that was attached to the online listing. Which he would have had access to. A week goes by, he calls again, this time with frame damage issues. Again, this transaction is far past the time allotted for any arbitration. While on the phone with him I did remind him that a PSI was not requested. A PSI would have found frame damage, if any, because we put these vehicles on a lift. We hold ourselves and each dealer to the same NAAA & OVE policies. I cannot make exceptions for one dealer and not another. Therefore, as unfortunate as this is for the purchasing dealer, pulling the CarFax and getting a PSI on this almost $49000 van would have saved everyone all this trouble. GCAA has acted fairly in this situation.

    Appreciate your time
