Purchased the vehicle on or around 2/21/24 Took a week to receive the vehicle.Still havent received all the signed documents for the purchase of the vehicle. The company refuses to pay for the taxes on the vehicle that were supposedly taken out even though theyve used a stall tactic by stating they would Zelle me the money which they never did. Employee refuses to put me in contract with management/owner.Initial Complaint

We purchased a 2010 ****** Outback for our son from Atlanta Prestige Motors on 2/16/2024 for $7,243.00 and paid an additional $300.00 to have it delivered to **********. The car was listed in good used condition with a clean Carfax report on their website. We were originally told that the car would arrive on Monday, 2/19/2024. It did not arrive until Wednesday afternoon 2/21/2024. We immediately noticed a strong smell of gasoline and when we drove the car there was a loud rubbing sound noted and the car would jerk when accelerating. I immediately called *****************************, the salesman we had dealt with to find out how to return the car as their policy states that you can return the car within three days as long as there have not been more than 150 miles put on the car. He stated he did not know the policy and that everyone was gone for the day and he would have to call me back in the morning. He did not call me back, therefore, I called him twice Thursday, 1/22/2024, morning and he told me he "did not know the process" and that I would have to speak with the owner. In the meantime we took the car to ************ who informed us that the car needs a new transmission as well as new break pads. I attempted to reach Philander again by phone and texted him Thursday evening and got no response. I am requesting a full refund for what we paid for the car as well as the delivery fee as we would have never purchased a car that needs a new transmission.Business response

Hello Thank you for you comments. the 3 day return you are mentioning is valid only if the customer is financing the car and through out the process we come to an issue which then you can return the car or we can take it back. when it comes to cash sales, all sale are final and the is no refund or return on an AS IS used car. We do all the maintenance required on the car if it has issues before we sell them and we make sure the pass the Georgia emission but we don't guarantee anything after the purchase and all responsibility is on the new owner, and all the customers are more than welcome to take the car to a pre-purchase inspection if they need to. All this have been mention on the paperwork you have signed. But since you were out of state you bought the car and asked us to ship the car to you. You could have asked us to have the car checked out by a mechanic shop with your own cost but this option was never requested from your side. Our car never had any known issues as long as we had it on the lot, we had few other customer who test drove the car and never mention any of the issues you Brought up. And when comes to **** one our salesmen, he showed me that he tried to reach you multiple times via text and call but couldn't get in touch with you because you didn't want to talk to him. I hope this helped.

**This is a response to complaint #********. I was unable to respond to this on the response link that was sent as every time I pushed the "proceed" button, it would not go through.*** Prior to purchasing this vehicle, we specifically asked if there was any rust on the car and were told there was none by their salesman. He also sent an email denying there was any rust and texted five photographs showing no rust which are included in the attachment. When the car arrived on 2/21/2024, we immediately realized there were mechanical issues and took it to a mechanic the following morning. He did say the car needed a new transmission and also noted there was significant rust on the car and recommended that we take the car to a transmission specialist which we did on 3/1/2024. We were told by the transmission specialist that the car did need a new transmission, however, due to danger and liability associated with severity of the rust, they declined to work on the car. They also took pictures of the underside of the car which are included in the attachment. Also included in this attachment is a letter from out attorney which was emailed and sent in a certified letter that they did not respond to. The last incoming call I have from anyone at this dealership was from the salesman we dealt with on 2/17/2024. The last email I received from them was on 2/23/2024 basically telling us that we are out of luck and that we bought the car as is. This car was completely misrepresented to us and had we know about the degree and severity of the rust we would have never purchased this it. We now have a car that needs a new transmission that cannot be worked on due to the degree of rust and cannot be sold. Atlanta Prestige Motors are what gives car dealers a bad name. They are liars and commit fraudulent business practices. Since they have made no amends to resolve this situation, we are going to proceed with legal action, but we want to make it known that they are crooks.Business response

Thank you for your comments, we believe we covered all the issues in our last response. For the rust situation and pictures which our salesman took the best way he could, he told you he doesn't see any rust based on the visibility he had since he is not a mechanic and he has no lift, which you were also ok with pictures he sent at the time and you purchased the car.Customer response

I am rejecting this response because:The salesman should not have answered that there was no rust on the car then. It was a direct question regarding whether or not there was rust and he answered there was NONE and provided false pictures. There is no way he missed seeing the rust on this car based on the severity of it. If he was unsure he could have easily checked properly. This is laughable at this point and we will see you in small claims court.
Sincerely,

I am in ***********. I found a vehicle online at this dealership thru Cargurus. I spoke with the same salesman throughout the process. He told me the car had no mechanical problems. I purchased the vehicle. It was delivered to me on Sunday, September 11, 2022. When I drove the vehicle I immediately heard a loud noise. I let my salesman know, and he told me there was no problem with the vehicle. Once my mechanic's shop opened on Monday I took the vehicle for inspection. Today they told me found that the rear struts are busted and it needs trailing arms. I have tried to contact the dealership but am now getting no response from my salesman. I believe the dealership should pay for these repairs. The vehicle that I bought did not arrive in the condition in which it had been described to me. The salesman has told me that there are no returns on "as is" vehicles in Georgia, but this vehicle was not advertised truthfully. The dealership must have accountability in the sale of this vehicle.
