I got behind on my car payments and I spoke to the store manager and set up a agreement to cancel the repo, I did everything they asked on my end and the did not cancel the repo like our agreement said. I plan to have attorney file in court asap. This is the 2nd time this happened. And when I messaged the manager he blocked me, and I requested the owner and they said he is over seas.Business Response

I cannot find an account in our system under that name. I need the acct# or actual correct name on the acct. I am not sure what you are referring to with titling in a different state but if you move that is something you also need to get with the *** and I can follow up on our end if ppw was sent but it definitely doesn't entitle you to a full refund. Regardless, I cannot get any info without pulling up the account and researching it.
I would need either one of the 3 I can find the acct with.
1) Acct #
2) Actual name on acct
3) Last 6 of the vin#

In September on 2023 I went to the dealership to purchase a vehicle. I put down a partial down payment of $1000. The vehicle turned out to be a lemon (engine and axle issues) I had the vehicle towed to the dealership shop. I never took full possession of the vehicle. They refused to refund my money and now are falsely reporting the vehicle on my credit as a voluntary repossession and reporting monthly late payments! This is fraudulent as I never took full possession of the vehicle, never gave a full down payment so how is this a repossession! I want this false information immediately removed from my credit report!Business Response
Date: 03/12/2024
The vehicle was not a lemon. You decided after purchase that you did not want the vehicle anymore and turned it back in of your own decision. We did some minor warranty work for less than $100 and at that point you decided you did not want the vehicle anymore therefore it was treated as a voluntary repossession. It is true that you did not have the vehicle long at all but taxes and fees were already paid on the vehicle. There was no refund due for the down payment.
To come to some type of resolution, I will agree to remove the vehicle from your credit report and also not pursue the deficiency balance due of $1491.08. There will not be a refund of any down payment though. You can check your credit report again in 30 days and it should fall off by then.
Thank you.

I purchased a Kia **** from this Company. I had paid $21000 on this loan . In February 2020, they repossessed my car right the c eorldcwas hit with *****. *** stated that the car would be sold in 2 weeks. Well I was a non essential business so I was shut down by government until July 2020. After reaching out to *** on several occasions he stated the car was sold. Then later that year I received a letter stating car was sold and I owe $4000 from an attorney. I reached out to attorney however they never provided documents to me. I checked my credit and there was nothing derogatory reporting. I called *** and asked him.to provided amount sold for and he states he does not have to tell me that. Recently, I pulled my credit and now it's reports if the car was just repossessed. It has been 4 years. *** violated my rights under fair credit act. Second dealerships need to be held accountable for fraudulently reporting taking peoples cars right before they pay the loan off and reselling to make another 10k. I need my credit report corrected. I do not have a balance and this account should be $0Business Response

The car was repossessed and processed in March 2020. The vehicle was sold and you got credit for the sale of the vehicle. Whatever the difference was between your balance and what the car sold for plus fees is your deficiency balance left over which is the $*******. All forms were mailed to the address we have on file including the breakdown of the deficiency balance. Everything was done in accordance to how it's supposed to be done. 10 day letter for repossession was mailed. Once the vehicle was sold and we knew what the deficiency balance was then the balance owed was adjusted. I am not sure what you are speaking of as far as credit. I am showing it's reflected correct on my end and does show a repossession with a balance owed of ******* which is correct. If you wish to settle this balance and update it to a paid repossession you can contact our office.Customer Answer

I am rejecting this response because:I just filed with the credit bureau, your company has been inconsistent with the documentation since you picked the car up. *** is a ******! He is mad at the world.
I will upload the documents to show how you are lying. In the credit report you sent in, the car was picked up in February 2020. You told me that I could come get my things out of the car , but you had already sold the car. You sold the car in March 2020. Which was Amazing because the Government shut the world down March *****, 2020 so who bought the car. That was the month COVID -19 and people were dying and afraid so who was at the auction. Also I was never provided a bill of sale to prove to me what the car sold for. You. A tell me anything.
If my balance is $3900 , you sold the car so how am I $1920 behind. The car is no longer mine. Your math and integrity dont add up.
I am asking you to remove all of the lies you have provided. A dealership with integrity would produce documents. I can type the letter you sent. Where is the bill of sale from the auction. You picked my car up when I almost done paying for it so you could resale it again. I pray God has mercy on your soul for treating people like this.
* Produce the original bill of sale from the auction.*Or produce the bill of sale where you sold it to a new customer.
please delete the information from my report.
The next agency I will contact is Fair Credit Act. When I do that I will be asking for the maximum amount in damages.Shady!
I will upload my credit report where your company have that the car was picked up in August of 2021. You also Never reported anything to the bureau until August of 2021.
all of your documents are inconsistent. Please correct. I only had 6 payments left. If my balance is $3900 you sold the car for $2000 so that makes me behind $1920. I can not have both. Once you repo and sell car your company was suppose to send me verification of what the car sold for. Not a letter you made up. I am requesting valid proof from the state ior auction.
Sincerely,

There is nothing to resolve in regards to this. The credit report reflects the current deficiency balance on the vehicle. I understand you are mad at someones personality but I cannot fix that in regards to credit and what you owe and there are 2 sides to each story and don't have a recording of the conversation between you and *** but in the end it doesn't matter since we do things by the book once it comes to the repossession and the processes involved in that.
When the vehicle was repossessed and paperwork was filed then everything is in order. Again, the vehicle was repossessed around feb 2020 and even a note saying you will bring the key. You were pretty far past due which is why you were put out for repo. We would have loved if you paid, we don't make any money from repos. We lose money in 99% of cases compared to if you were to pay out the loan.
We take your principal balance plus any fees and that is what you owe for your balance still on the loan. We then deduct the proceeds of the sale of the vehicle which was not much due to the condition and miles of the vehicle at time of repo. All this paperwork was filed and mailed to you by certified mail back in 2020 as well as the 10 day letter and a breakdown of how we came up with the deficiency balance.
Your vehicle balance left was around $6000 at time of repo and car was disposed of for $2000 so that is where the deficiency balance is coming from. There was loss on this repo from the company and actual real bad debt due to the repo and contractually you are still responsible for the charged off balance remaining.
The credit report reflects correctly, paperwork was mailed in a timely manner all by certified mail. I am not really sure what the dispute here is unless you are just mad as you claim. We don't put any personal stuff into what we do. It's just numbers and by the book. I am not sure what you are trying to accomplish except get things removed and not have to pay what is owed. We did not repo the vehicle because we were mad, we didn't repo it so we could make more money(if that was the case you would have no deficiency balance). We simply had to repo because you were not paying the payments. All this would of been avoided if you were somewhat current.

I am rejecting this response because: nlNqtiinal Auto Sales has not provided any evidence that my call was sold for only $2000. They are caused car dealership. I had just serviced the car and purchased new tires. The car was in great condition. They did not provide me with a ******************************************************** February2020. Again, 30 days later the world was closed due to a pandemic so please provide the evidence of a sale. I need some valid receipts from a auction or a sales contract because by law when you sale the car for more than the balance I do not owe ************* sales any money the balance was covered in the next sale.
I do not want a ****** written up on a letter head from. National Auto Sales Mr. **** I need governing documents. If you are not lying , you would not have a. Misuse with providing your evidence.
I am not a search to track my VIN through Carmax and I can find the new owner and call them . So I am giving you an opportunity to come clean. I am really exhausted and disappointed in how you really took my car because it was really paid for. But thats the business. So if you are not gonna provided governing documents, BBB lets just file the complaint. When I get the information and statement from the person or auction who bout it, according to the ** Secretary of State, the fair credit act and the *******************************, I will press the maximum charges from each one. The ball is in your corner. Just do right by people. I am not going away. I am so tired of companies like yours taking advantage of people like me who continues to give our hard earn money to unethical people and companies such as yourself.I am requesting that a formal complaint is filed against this company if in the next response proof of sale from a auction or to a buyer is not provided because for all we know the numbers are made up to have a write off for bad debt.
Sincerely,

You would need to contact the firm that is pursuing the deficiency balance which is Cooling and *******. Once your vehicle is repossessed we use Cooling and Winter to pursue the deficiency balance and they go through the proper channels and courts and they are handling it.
I am showing your name in our system. A Chrysler 300. But if you feel like this is not you then you will need to contact Cooling and ******* and they can assist you going forward.
Thanks

You bought the vehicle on 2/26/2022. As the documents state the vehicle comes with a 30 day or **** mile warranty whichever comes first. Anything after that is your responsibility. Also, there is nothing to re-imburse you for. In July 2022 we did the work for you to fix those issues and added to your account to help you out and you never paid off the entire balance owed on those repairs. In fact your account got extremely past due and was repossessed on 12/31/22. We did see in the notes where you left us some very derogatory and profanity filled remarks in relation to this and your past due payments so I understand you are upset but the repairs on the vehicle are your responsibility after the warranty period is up and you were well past the warranty period. We did help you out and added to your account and if that didn't fix the issues you were more than welcome to take to a shop of your own choosing to evaluate further.
