Brand new home having a faulty leak in the roof within the two yr. structure warranty 1 yr and 9 months which can cause black mold is unacceptable. Basically, I put down $5000.00 ******* money and all of my documents were in order, I was waiting on GA Dream to complete thier process, by the way, you cant start thier processes until you have a contract. Capshaw affiliates knew this and withdrew the contract and will not give me any of my money knowing that I, as the buyer, had done everything asked of me. They knew that it was just a matter of time for GA dream to fulfill the deposit. I would like to know if I can get some of my money back?Initial Complaint

I have had problems with plumbing since I bought the home November 2021. It has caused damage in my downstairs bedroom walls and ceiling, the kitchen and garage ceiling had to be cut open to find the issue. The plumbing system is not put in correctly. I would like the builder to fix it because it wasn't done properly. It would cost me thousands of dollars to repair the system and fix the damage done to the walls, ceilings, and floors.Initial Complaint

We purchase home with Capshaw in new build community. We have not been able to receive mail or internet. We were told that service would available soon after we close. Capshaw Development has completed their responsibilities. In addition, we assigned the addresses for each box to expedite the process. Per the ******* ************ they are waiting for the maintenance department to install their locks. The ******* *********** stated that they are holding mail for each homeowner residing in ********************** and homeowners can pick up at ************************************************** 30233. They can also be reached on ************.Capshaw Development has complied with all the regulations we are responsible for, unfortunately homeowners are waiting on the post office.

I Applied for a Home with Capshaw Development Group and the lady *********************************** told me as long as I have all of my documents everything should go smoothly mind you I told her that I had amended my taxes and she stated that as long as I have the receipt showing that I amended my taxes everything will go well. She never told me that they didnt accept amended tax returns otherwise I wouldnt have given anyone any money. She started trying to embezzle money from me during the home buying process and told me its taking to long to get approved and after I gave them $5,000 of ******* money she demanded that I give her $600 on a Sunday. I also paid $550 for an appraisal of the home just for her to call me on a Sunday and say she wasnt going to wait until the closing date to see if I get approved. While Im the process of buying the house I did research and *********************************** had the house that I was in a contract with Capshaw to buy posted on other websites as if she was still trying to sale the house. ********* is not the owner so I called Capshaws Office and spoke to the accountant and everyone there stated that *********************************** is just the listing agent and that she should have returned my money. I called ********* requesting my money back and *********************************** cursed me out and told me that I was not getting not one dime of my money back. Capshaws office stated that ********* should have given me my money back. Im a single mother looking for a home not for small businesses like Capshaw Development to take from me and my children who are homeless now because they didnt even let me go to the closing date and a LISTING AGENT decided that she was keeping my money. *********************************** cursed me out a single mom whom trusted these people to do right by me and I feel *********************************** is running a scam and taking families money. I told her from the beginning that my taxes will only say processing and she knew it would be an issue and she knew that she was going to keep my money from the beginning. ************** came to Capshaw New Homes with a pre-approval letter from her lender of choice. Capshaws listing agent, *********, is a professional real estate agent and follows Capshaws closing procedures. Capshaw New Homes, our listing agents, employees, or subcontractors would never curse or scam anyone, including a potential buyer. When ************** and her real estate agent signed the written contract, it was clearly stated that ******* money is non-refundable. Capshaws listing agent is not involved in our decision to retain ******* money and its clearly written in the ratified contract. The $600 was per our contract for the delay in the closing that her lender said they needed to get the file closed, which was signed amendment 002. Once Ms. ****** lender failed to get the clear to close, we had one of Capshaws preferred lenders look at Ms. ****** file to see if she met qualifications with them to close on the home. I am rejecting this response because I called my bank and my bank stated that Capshaw Development and *********************************** whom the check of $5,000 was dropped off to on a Sunday because she demanded that I pay the $5,000 in ******* money right away or I would not be able to move forward with getting the house and she knew that I was a first time home buyer and very inexperienced when it came to buying a house and she also knew that my realtor was inexperienced and she took advantage of us in the worse way. *********************************** is doing fraudulent things to get money out of people and then trying to back out of deals before closing. If a buyer can't get a loan it is not their fault and no company should be pressuring them for more money. *********************************** called my realtor *********** on a Sunday and demanded $600 that had nothing to do with the contract. She stated that it was taking to long to get approved for the loan and stated she needed $600 in her office or she would back out of the contract. *********************************** is sending you paperwork from **************** when the company that she backed away from the contract was with Security National Mortgage Company. Security National Mortgage Company is the last company that I sent my paperwork to and did business with and sent all my personal information to and Capshaw Development is affiliated with that company. I was told if I went through that company I would get my money back. I plan to fight to the death of me to get my money back from this crooked company. I am a single mother and have been since I was 19years old and nothing and no one will take food out of my children's mouth. *********************************** whom work for Capshaw Development cursed me out like a dog when I called and questioned her about my money back. This company has no integrity and is taking advantage of innocent people whom are just trying to buy a house for them and they're children and grand children. I will not be taken advantage of. I do not give money especially over $6,000 with nothing valuable in return when I have children at home whom are in need of things. Capshaw Development is dead wrong for trying to with hold my money hostage and lying to keep it. I will spread the word on my social media platform and make sure nobody has to go through what I'm going through with this company. I do not wish this on my worse enemy. All I want is my money back so that I can continue my process to buying me and my children a home and to move on with my life. This company took complete advantage of me and has caused me and my family soo much pain and suffering. Please help me get my money back from this despicable company. As a residential home builder it is vital for both the home buyer and business to sign the sales contract to ensure both parties are held responsible for their part of the agreement for the purchase. While we understand that each situation is ********** value the terms of the sales agreement for both parties and remain impartial to the terms of the agreement. In this case, the terms of the agreement is that paid ******* money by the potential buyer is non refundable if the sale falls through. I am rejecting this response because: I told these people at Capshaw Development that my taxes was still processing and they told me that that was not a problem and it's definitely your fault because I turned in everything that was asked of me. This company acted as if they were the prize and demanded money that they shouldn't have had they're hands on. I will get my my money back and I will see Capshaw Development in court. *********************************** took my money and spent it the first day she got it and I know in my heart she's doing something fraudulent and I will have her realtor license suspended. I am going to take the steps to do just that and I will get my money back. See you in court.

My wife and I purchased a home in a new build subdivision from CapShaw Homes. We were told by the agent intially that the internet service and cable service is **************** As we got closer to closind we were told to ask others in the area, and they said the same. After closing, we called ******* only to be told they dont service our home, despite being the provider for the area, because the builder/developer never had internet capability installed in the neighborhood. This was confirmed by another provider, who said the infrastructure wasnt in place, and until that happens there wasnt anything we could do. My wife called CapShaw and was told it wasnt thier problem, because it was supposed to be completed in the development phase, so they wouldnt be doing anything. The only company that will come to the neighborhood provides satellite internet, and that company speed is only 10 mbps, which wont run anything in our home. Capshaw had a representative for another company at our walk through selling us home security services that we agreed to pay for, and are now locked into a contract for, that is now obsolete because the internet service wont work. **************** is a luxury, so I am not upset as much about that; but in a day an age where people work remotely (I do occasionally, as well as other members of my household), and some attend school remotely (neighbors), the internet gaffe has become a huge problem. We fkat out would not have purchased this home had we known there was no infrastructure. We cannot even get mail service. When we go to the post office, they are stunned when they find out we are trying to start mail service because the builder neglected to. It's been 1.5 months and still no mail service, which complicates trying to apply for licenses, permits, etc. We havent even recieved our documents to file for Homestead with the county because we dont have mail. There may not be much you all can do, but others need to know before they purchase here.
