Hello, I submitted a security deposit on July 12, 2024 on the intention of moving into West Forty 9 in August of 2024. I viewed one apartment and did not like what I saw, therefore I never signed a lease and I requested my deposit back on July 29th, 2024. I received the check on August 5th and deposited the check into my account that same day. Three days later after I received the funds, I got a notice from the bank stating my account is in the negative due to the check I deposited. I went to the bank and got a copy of the check to see whether the bank deposited the check on an earlier date than what was on the check. The check has a date of July 31, 2024 and the bank teller told me that the reason the check bounced is because there were insufficient funds in the West Forty 9 banking account, ***** ****. I proceeded to tell the property manager about the situation and she apologized for the inconvenience and told me she would get in contact with the "A/P department" and get back with me. I asked her for her manager number, which she did provide, but no one answered or returned my phone call. I asked for **** Management Group number and email address and she never provided that information stating that they do not have an email address or a phone number. I went to the apartment on August 9,2024 to speak with someone personally regarding this matter. The property manager was very unpleasant and rude when I entered the leasing office. I asked if she would call someone I can speak to regarding this matter and she refused to contact anyone. She called the police and lied stating I put my hands on her. The police found no evidence of me doing such and asked for me to not return to their facility. In this process, she also stated, "I can get my deposit back today, and that I am going to jail." This company refuses to give my deposit back. I have also tried to reach out to **** Management Group who owns West Forty 9, but there is no avail.
