On 2/25/24, sales agent for McKinley Homes distributed a completed contract for the house located at *********************************************. They received a $5,000 payment from me as construction deposit. My agent and I hired an inspector who inspected the house on 3/15/24. His report, as well as identifying other defects, stated the roof had "damaged, missing, loose, torn" shingles needed to be replaced/repaired "as soon as possible". On 3/16/24 we provided his report and additional defects identified by my agent to sales agent. Twelve (12) days later, on 3/28/24, sales agent sent an email and said his builder called someone with more experience to take a look at the roof. He said they will have to push the closing date. On 3/29/24 closing attorney's office canceled the closing. Finally, on 4/10/24, I decided I do not want to wait any longer for repairs to be made and asked them to return my $5,000 construction deposit. They said they will not return the construction deposit because I did not close. I could not close because the repairs were not made, we could not perform a reinspection/final inspection and the closing was canceled by closing attorney's office.The builder/seller should return my $5,000 construction deposit.Business Response

The purchaser originally bought a house from McKinley Homes with a contract date of 1/23/2024 when it was signed by the Seller. In February, said purchaser found a problem with flooring, which was not evident in any way, and said that house would no longer work for him, and he refused to move forward. In an effort to pacify a nervous buyer, the flooring company offered to change any flooring in question. Not good enough for the individual, yet the company allowed him to transfer to the house next door, another totally different home. As closing was nearing, the Purchaser and/or his inspector had a question about the shingles, as a builder we had the manufacturer get involved, and the entire roof was replaced to satisfy this purchaser. This is what created a delay in the closing which the buyer was informed of. At this time, we have received nothing but this complaint from the Purchaser. This is a contractual issue, and the builder has honored two contracts for this buyer who is again creating problems where none exist. The contract is clearly written, the seller has performed according to the terms of said contract, and we expect the buyer to do the same.Customer Answer

I am rejecting this response because:I initially signed a contract with the intention of buying the house being built on lot 120. I went to check the progress being made on the house on 1/27/24 and saw the foyer, living room, dining room and kitchen floors were covered with rainstorm water because the front and rear doors could not be closed. I also noticed a large hole in the living room ceiling, a coat of gray dust stuck on window frames inside the house, screws sticking out of the kitchen sink wall, large piece of broken door trim in the master bedroom walk in closet, etc. I have pictures and video that show them all.
The Builder transferred the contract and the construction deposit to the house being built on lot 121. My agent and I hired an inspector who inspected the house on 3/15/24. His report, as well as identifying other defects, stated the roof had "damaged, missing, loose, torn" shingles needed to be replaced/repaired "as soon as possible". On 3/16/24 we provided his report and additional defects identified by my agent to the sales agent. Twelve (12) days later, on 3/28/24, the sales agent sent an email and said his builder called someone with more experience to look at the roof. He said they will have to push the closing date. On 3/29/24 closing attorney's office canceled the closing. After not hearing anything was fixed through 4/9/24, I decided I did not want to wait any longer for repairs to be made and asked them through my agent to return my $5,000 construction deposit on 4/10/24. They said they will not return the construction deposit because I did not close on the house. I could not close because the repairs were not made, we could not perform a reinspection/final inspection and the closing was canceled by closing attorney's office.
According to Section 28. DEFAULT (r) of the contract, the Seller failed to perform its obligations under the Agreement, and therefore, should provide the Buyer for liquidated damages resulting from Sellers breach the sum of Two Hundred Fifty U.S. Dollars ($250.00) and return of the Buyers deposit.

McKinley Homes responds to all legitimate concerns from any legitimate ICC Residential Combination Inspector and will address any and all violations of trade practices. As a builder, we deal with all kinds of issues daily and try to not only do our job as a builder, but to educate people on the process of building a home.
The period taken to assess any roofing issue and to entirely replace the roof took approximately 3 weeks. You were kept informed during all of the process. You created issues on the first house, and then the second. Many of these issues are handled in the normal course of construction, but your unwillingness to try to understand any of the process kept us from moving forward. After 4.5 months, you have once again decided to change your mind without any concern about an agreement that you studied for weeks before signing. Notwithstanding all of the other issues named in the contract, The contract is clear. McKinley Homes went above and beyond normal requirements to replace the entire roof to assure buyer satisfaction, not just the shingles that were defective as agreed to by the manufacturer.

16. Closing Date.
The closing of this transaction ("Closing") shall be held at the office of the Closing Attorney within Seven (7) days of the substantial completion of the Home on the Property at a date and time, during normal business hours, selected by Seller, in its sole discretion and notice of which is provided by the Seller to the buyer. Substantial completion shall be deemed to occur when a certificate of occupancy or other document used by the local government where the Property is located to confirm that the Home on the Property is substantially complete and may be lawfully occupied, has been issued relative to the Property.
All parties acknowledge that closing will take place within 7 days of obtaining the Certificate of Occupancy regardless of the closing date herein.

I am rejecting this response because:McKinley Homes response again includes many false statements.
I DID NOT create issues on the first or second house. The issues were caused by the Builders defective construction completions. The Builder should read what I submitted in this complaint and emails I sent to the sales agent.
I DID NOT study the contract for weeks before signing as stated by the Business. I signed it hoping and not expecting I would run into all the problems I ran into.
The sales agent was provided with the inspectors report on 3/16/24 which, among other issues, stated the roof had damaged,missing, loose, torn shingles needed to be replaced/repaired as soon as possible. Twelve (12) days later the sales agent sent out an email on 3/28/2024 and said my builder is looking at the roof and called someone who has more experience. I will let you know what they do and do not find out. He said they will have to push the closing date. When we were not told anything was fixed for another eleven (11) days, my agent sent an email to sales agent on 4/10/2024 and said Because this process has taken so long to repair the roof, my client would like a full refund of his deposit, We received an email from the sales agent stating the roof was repaired on 4/17/2024, that is seven (7) days after we notified them I am no longer interested in buying the house and asked them to refund my deposit, and OVER A MONTH after the defective roof was identified by the inspector.We were kept in the dark during the entire process with the one exception of the email the sales agent sent out on 3/28/2024 which did not help any. The Builder did not respond to an urgent situation in a timely manner.

I have included the termination signed and agreed to by Mr. ****** as he knew he had twice violated his responsibilities in a contract. Im not sure, but I believe he is an engineer, it took 6 months for him to make a decision to buy a house. Two months later, he didnt want that one, but the one next door. He changed from a two story to a small ranch. We had a shingle defect which we resolved by replacing the entire roof and Mr ****** decided he didnt want that one either. This was a contractual matter, not a customer service matter, and he decided to file a complaint even though he signed the cancellation agreement since he was in the wrong.

I am rejecting this response because:This builder and its sales group started acting very unprofessionally after I signed a contract with them to buy a house and paid them the construction deposit.Instead of owning up to their construction errors and delays and try to remedy them, they accused me with many false statements. I did not breach any contractual responsibility. I did ask if I could switch to a different house from the house I was initially planning to purchase because when I arrived at the house one day to check on construction progress, I saw the foyer, living room, dining room and kitchen floors were covered with rainstorm water because the front and rear doors would not stay shot. I also saw many other construction errors. I STILL HAVE PICTURES, VIDEOS AND COPIES OF ALL MESSAGES WE EXCHANGED THROUGHOUT THE WHOLE PROCESS TO PROVE EVERYTHING I AM CLAIMING HERE ARE TRUE. They agreed to switch me to another house and transferred my construction deposit. The contract for the new house was distributed on 2/25/24. The home inspector I and my agent hired inspected the house on 3/15/24. The house inspector and my agent identified many things that needed to be corrected. The most significant of which required replacement of shingles on the roof. These items were provided to sales agent on 3/16/24. Nothing was getting done in a timely manner, so, the sales agent said they will have to push the closing. On 3/29/24 the closing attorney canceled the closing meeting which was scheduled for 4/1/24. I waited until 4/9/24 to find out when the repairs are going to be made and when I did not hear anything, on 4/10/ 24, I asked through my agent that they refund the construction deposit I paid them. The termination document I signed on 5/16/24 states the buyer failed to close per contract, but I could not because the closing meeting was canceled. They were repeatedly asking me to sign this document. I had no choice. I had to find another house to buy.
THEY SHOULD REFUND THE $5,000 construction deposit they received from me.

We bought this newly built house in January 2023. During the final inspection, as well as before, we had asked and verified with the builder that ethernet ports would be installed for the two guest bedrooms before closing. The builder had told us that they would install the extra ports along with the existing two ports per our request. In addition to the original two ports not being fully finished, the extra ports were never installed and they told us during final inspection that it would be done during closing. We had tried to make do with our wireless connection, but with the router/modem being stationed in the first floor closet, the signal is incredibly weak for the second floor. I had contacted the builders for McKinley Homes on multiple occasions and they had sent me over to their community electrician as well as my ISP. Both other parties stated that the responsibility of having the ethernet lines installed fell on the builders. All I am asking is for the builder to install the ethernet lines as was initially promised.Business Response

I apologize for any misunderstanding in this matter, but I have included your email that was sent 5/5/2023, your home closed 1/11/2023. You stated that you asked the builder about additional ethernet ports during the final inspection. I am afraid that this at this time we were already too late. At that time he told you that ATT would have to install as we prewired your home for a central ************ per ATT and several phone and cable outlets. We could have prewired for ethernet ports had you informed us prior to construction. After the drywall is applied, we cannot go back into the wall and add electrical or electronic wiring. ATT or a third party low voltage contractor would be capable of adding ethernet connections, but we cannot install after the house is built. I have reviewed all paperwork and there is no mention of ethernet connections. Once again, I am sorry for any confusion, but this is not a builder item. Generally a one year touchup is just that and is handled in a day. The warranty department does a very good job helping homeowners to prepare for the work to be done and ask that any items in question are marked prior to sending two different contracting crews to perform work. As we try to work with people, we sent the crew out a second time as you requested and additional work was done. A warranty manager will accompany the crew to your house for one last trip to verify that an appropriate touchup has been completed and at that time, we will consider this matter closed.

Very cheap houses. No insulation of exterior walls. Big hassle to deal with. Mostly will tell you its normal and nothing can be done to any repairs. Having to pay outside home inspector to address problems and get a resolution to fix the issues. House is very cold in the winter. Sod laid on red mud with little to no grading. Even found bricks and beer cans under the sod. The dry wall and trim looks like trash. Looks like a kid did the work. Caulking everywhere. 1/ inch thick. They will hook you with the deposit, then its over. Unless you want to loose the deposit. This is the worst company I have ever dealt with.Business Response

I am rejecting this response because: Came out to fix popping in my floors. Half way done the job still pops where the pictures were taken by the manager. The stair was never fixed. The guy who came out says that isn't his department. Emailed ******************* to get this resolved. He stated he cant guarantee a squeak free home. Im just looking for the original problem to be fixed. After my first complaint I received a call from ********* to ask what they could do to make it right. I told them my wishes to have my own home inspector to come inspect the home. I didn't want to use there's because they all say the same thing. "its normal". After this phone call I have heard nothing back. There is a reason they have a F on BBB. I strongly warn people that these homes are made with cheap materials with even cheaper labor workers.

I'm sorry you are unhappy with the service provided, the flooring company came out twice to assess and rectify any loose flooring issues. They screwed down any possible movement areas in the subflooring. Up against a wall, you can create a noise if you apply enough weight near a framing plate as the plywood may move on the nails, but this is not a normal traffic pattern, nor is it anything unusual. The flooring company has assured us that the subflooring is tight and not moving.
You also complained about the garage being cold in the winter. Garages are not a heated space, they are not part of the thermal envelope of your home and thereby are not insulated. Your home is insulated from the garage as it has a 16' hole on one end with an uninsulated metal door. If you wish the garage to be warmer, the garage door can be insulated and some type of heat source would be recommended.
As we build 500-1000 homes yearly, we have practices in place to minimize any issues, and we try to work with our customers to make them happy. We have replied to your concern and tightened the floor as requested, we consider this matter closed.

We purchased our home from McKinley Homes as a new build and my family and I were ecstatic. Our excitement quickly turned sour as we hit issue after issue with the build process and the constant delays. We knew it was going to be difficult and have delays but the extent was completely staggering. At 9 months past the last possible date it would be completed. To then have our walk through was terrible, the joke of a builder ******** Brothers were awful. They make a snide joke to my wife that she should pay attention to the walk through so she didnt ask stupid questions. ***** made a number of comments about how we need to simply look past some of the cosmetics issues as that was the joy of home ownership and we could fix those after we purchased it. During the walkthrough a number of items were mentioned, leaving a laundry list of repairs to which we were told of you dont like it you can always just walk away from our deposit and ******* money. Almost ***** at the time due to upgrades which were so poorly installed.After three months the stairs began to give way and any slight movement caused the entire structure to move away from the wall and only livable areas of the home. This was deemed as unlivable standards by two outside inspectors. The bonus room was so poorly constructed and designed that the room was deemed by a third inspector as unsuitable for a living space. So many other issues to include, flooding in the master bathroom, broken water heater with in the first year, over 58 emails, 76 phone calls, 214 text messages. And we still have 26 remaining issues they promised to resolve! This home was purchased in August of 2021! We have done our due diligence, we have put in over ***** dollars to make this house LIVABLE, and McKinley homes has recanted time and time again. The final judgment, they promised to fix the issues and after 427 days they no longer wish to honor their contract. Be careful, all potential buyers!Business Response

It's been a year since we moved in to this half done, rush built house. This house had several serious problems including missing AC vent on the ceiling, different hardwood flooring than I ordered, cracked concrete on my garage floor and backyard, etc. My biggest concern/complaint is that we ordered window screens installation when we purchased and signed a contract with McKinley Homes. Like I said, it's been a year since we moved into the house, but we still haven't received it yet. First of all, these window screens should've been already installed before we moved in, but they failed to do their job. Whenever I sent emails and filed a claim on their websites, they've always brought us the wrong-size window screens to my house so many times. At this moment, I'm very frustrated about their poor work ethic, and I am also tired of wasting my time. Since I couldn't stayed at home anymore for them to bring us another wrong window screens, I asked for refund (which is included in my warranty). However, they are still (up to today) refusing to give me a refund. They just simply forward my email to different departments to avoid their accountability. Last time I spoke to them was 1/12/2023, McKinley Homes, as always, lied to me and said they will contact me and they didn't. I'm just done with waiting for their falsehood, sugarcoated lies and excuses just to avoid giving me the refund or install my window screens. I need my money back.Business Response

I apologize for this inconvenience that was created when our industry was struggling. During the 2020-2022 rush, the supply line disruptions affected the building industry in many ways during the busiest selling time in history. There was a window shortage that was nationwide and as builders we all reached out to new vendors and did whatever we could to fulfill our contracts and build our houses. Now we are trying to get the return service from these vendors and many times they are not getting it done in a reasonable manner as you can see they have come to your home several times and failed to get it done. I will be refunding your cost as well as sending you a $100 gift card for your trouble. Please accept my apology, and I will be forwarding a check to you next week.

I moved in this half done speed built house where they left walls dirty a hole has been in my ceiling and there has been numerous issues I let slide but when I'm told about complimentary service after all this I have a serious problem! They rushed this home I know it if I have to pay for everything they did wrong I will make sure I get everything addressed that's flawed which is ALOT and file in court if it comes to that because a home should be a happy place and I paid for c*** and they are shady don't want to correct what they did wrong. They built wall wrong so wall had to be cut for ice maker to work and the garage disposal was flawed but I was nice about that but now they want to make me feel like I'm bothering then and I have walls that need to be painted and a hole that came out of know where from c*** buildingBusiness Response

I apologize for the fact that you are so unhappy in your home. I checked in with the warranty supervisor, who provided me with the email where you said the repairs were complete for any drywall work. They then scheduled the painter to finish the job. You have sent me two pictures, one so blurry I cannot see what I am looking at and another of a wall that is obviously scuffed and marked up from moving and living in a home. It certainly was not in that condition when you moved in as you walked through the entire home with the builder and signed off that you were satisfied with everything.
Our one year service extends to sheetrock cracks, settling, nail pops, cracked caulking as well as failure of any systems in your home. The painter asked about sheetrock repairs and then finished painting those areas. If there is any other items that are needing attention that are based upon failure of workmanship and/or materials, please take pictures, and send to the warranty portal so they may be addressed. We try to make everyone happy in their home, but we also must adhere to realistic guidelines in what we are able to provide.

Regarding complaint ********, *******. While we have been to his house multiple times with drywall and painters, we reached out again. The last thing he told the warranty group is that he might shoot the painter. We contacted him again, today to offer to touch up even again, here is his answer. This is not a rational individual.

There was a language barrier and he didn't speak good English, but McKinley Homes said that was my ONE time warranty and it's taken this many years to respond and I need NEED REAL CALIFORNICATION before someone else comes here and decides not to do the job.

I am rejecting this response because: The Business accused me of something I did not do and they have not made any efforts to do paint touch *** in my home. To resolve the issue, someone besides the person that keeps contacting me that is very unprofessional needs to address me with details about what they are willing to do in my home because as I said before the original person came and didn't do anything and they have never returned to my home. I have full camera security and can provide full details for any date they claim they came to my home.

Bought a home from McKinley homes on 7/11/22, have had SEVERAL warranty tickets unanswered and the most recent being and electrical issue! No one has returned calls or sent anyone to fix any issue !!! At this point were scared to sleep being afraid of a electrical fire or something serious!!!Business Response

We signed a contract with McKinley Homes in May of 2020 and our home was finished on May 2021. In August 2021, we communicated with the warranty department at McKinley Homes of a potential environmental health issue happening from our septic tank. We had waste water from the septic coming out of the ground into our backyard. McKinley advised that we needed to wait until rain season passed to be able to have someone come out and inspect. We then turned to the septic company who after many requests actually contacted the county to come out and perform exploratory excavation to attempt to identify where the issue was and see what corrective action was needed. County and Soil Engineer made several recommendations, one of those recommendations being a curtain drain. McKinley performed the simplest and likely the cheapest recommendation and moved forward with the first step to see if this addressed the waste overflow, thinking that putting grass over the area was going to solve this issue. This took about a year to actually get completed. Meanwhile we had septic waste water all over our yard/ After this was done, septic company cleaned the septic and informed us that it would take 30 days for the septic to get to operating levels and help us determine if the issue was addressed. Exactly ************************************************ our yard again. We contacted McKinley once again, including ********************* and ******************* and ***********************. **************** had actually responded and communicated with us throughout this process. We were advised on 07/15/2022 that upper management should be contacting us back within the next week. Since then we have not heard from McKinley, nor have they responded to our request for an update on this. In the meantime, we STILL have waste water all over our backyard.This has been going on for almost a year now and just need a resolution. It has been confirmed that this was a buildout issue and is not our responsibility.Business Response

Creating yard ****** to redirect any surface water away from the system
Pipe all water discharges away from the system
Sod all disturbed areas to establish ground water coverage.
