I am disputing an invalid account reported by Navy Federal Credit Union on my credit report. This account is inaccurate, unverified, and violates the Fair Credit Reporting Act (FCRA). Since it does not meet the legal standards for reporting, I request its immediate removal. If the furnisher cannot provide proper validation, it must be deleted per federal law.

I am writing to formally file a dispute against Automobile Acceptance Corp regarding an inaccurate charge-off entry reported on my credit report. I recently obtained a copy of my credit report and noticed that Automobile acceptance Corp has reported an account as charged off. This information is incorrect and has severely impacted my credit standing. I am requesting that this matter be reviewed and that Automobile Acceptance Corp required to remove the charge-off entry ************** the best of my knowledge, I do not have any outstanding balances with Automobile Acceptance Corp that would justify a charge-off status. If this charge-off is a result of an error or miscommunication, I request that Automobile Acceptance Corp provide clear documentation validating the accuracy of this reporting, including:A detailed statement of account history.Any signed agreements or contracts pertaining to the account.Proof that ********************************************* Corp attempted to contact me regarding any outstanding balance before reporting the charge-off.If Automobile Acceptance Corp is unable to provide concrete evidence supporting their claim, I request immediate removal of this derogatory **** from my credit report. As this erroneous entry is negatively affecting my financial standing and ability to obtain credit, I urge the BBB to intervene and facilitate a resolution at the earliest convenience.Additionally, the Fair Credit Reporting Act (FCRA) mandates that only accurate, complete, and verifiable information be reported to credit bureaus. If Automobile Acceptance Corp fails to provide evidence of the legitimacy of this charge-off, they are legally required to remove it from my credit file.I appreciate your prompt attention to this matter. Please let me know if you require any additional information. I look forward to your assistance in resolving this issue fairly and expeditiously. Thank you for your time and consideration.

I reached out the company months ago and spoke with a ***resentative named ***** and then spoke to a ***resentative named ********* . I told them my personal situation and the *** on the phone said that they would remove the late fee and walked me through how to make a payment without applying the late fee to my payment while she worked with her manager to remove the late fee from my account and I made a payment without applying the late fee to the total paid for about 3 months. They called me almost 10 times a day asking when I was going to pay the late fee and I explained to every ***resentative that a *** told me it would be removed from my account and that I didnt have to worry about paying the late fee. Now I have an alert that the same late fee is on my credit and has taken me from a 700 credit score to now being 577 due to them ***orting something they said they would remove from my account all together. If a *** from a company tells you they will do something they should do it! Also shows my auto loan is 60 days behind when I made 2 payments in the month of December when all this started

Our standard is to provide excellent customer service at **********************.  Thank you for bringing this matter to our attention and allowing us to research your concern.

The late fees in question were assessed 9/11/2024 and 12/11/2024. Mrs. ***** was instructed how to make payments, so the funds were not applied to the late fees owed.  Mrs. ***** was aware if she paid on or before her due date, the funds would be applied to the late fees.  On 12/29/2024 Mrs. ***** made her contractual payment amount prior to her due date of 1/1/2025 and did not include the late charges of $59.16, therefore the late fees were resolved and the balance applied to her monthly payment amount, leaving it short $59.16. Mrs. ***** was advised of this shortage on 1/3/25,1/7/25, 1/8/25, 1/9/25 and 1/14/25. She was also advised the late fees assessed were accurate and would not be waived.

Also,on 9/27/24, we granted her a two-month extension, moving her account from 9/1/24 to 11/1/24.

On 1/16/2025 Mrs. ***** request no calls from Automobile Acceptance. Per ********* request, we ceased telephone communications.

Please allow us to work with you to get your account back in good standing by calling our office and paying the late charges that are due.

I am rejecting this response because: A representative from the company told me they would remove the late fees and walked me through how to make a payment without the late fees included until the manager was able to remove the fees from my account . And now because I didnt pay for late fees they told me would be removed they have reported the late fees to my credit and it has negatively affected my score. And I was not told that if I make a payment early it would be an issue .. I was only told that if a payment is late then its an issue, the company also advertises flexible payment plans and options but has neither . This is a horrible company

      Sincerely,

      ***** *****

This account does belong to Mr. ************* He contacted our office and applied for a loan to pay off Title Max.  He was required to come to our office for the loan closing and for us to inspect the collateral.  We then had to meet him at the TitleMax store to pay the loan off.  We conducted a thorough investigation at that time to confirm this identity.  He also called our office twice in December 2020 and offered to settle the account if we agreed to remove the tradeline from his credit file, which we refused to do.

When we originally financed the title loan we were under the assumption that it was 1800 New Deal. We were told that we would be finish paying back the loan within 2 years as they but majority of payments towards the loan. This turned out to be a complete lie. Majority of funds are put towards interest and nothing towards the principal. Truck valued at 35k was repossessed for a loan in the amount of 10k which we had been paying on for almost 3 yrs. Total amount still owed was *****. Monthly payments of $787. Now they want to put it on my credit as if selling the truck didnt pay back the loan and what other made up fees double. Please do not do business with them. I am seeking legal action as this company is a scam. The office employees are horrible and I will make it my mission to make sure they loose as much business as possible until they are shut down for good.

We thank **************** for her comments and our response is below.

****************, along with *************************, entered into a Note Security Agreement on 9/20/22 with a 24 month term.  They were advised this was a simple interest loan and if they wished to pay the loan off in the stated 24 months, they would need to ensure the payments were paid on or before the due date.  They had two NSFs, were granted a two-month extension and nearly every payment was delinquent, resulting in additional interest charges.

The tradeline is reporting correctly and we will not remove such.

      Regards,

      Automobile Acceptance Corporation

I am rejecting this response because:
It doesnt matter about what was late. The loan was for 10k and you have the vehicle. Sell it and the loan will be paid back simple. Majority of payments went towards interest so how exactly was the loan going to be paid back in 24 months. Being that almost every complaint says the same thing I would believe again this company is a scam. If I have to make a review everyday for the next year to make sure nobody comes to you guys for business I will.
      Sincerely,

      Business Response

As previously stated, your loan was a simple interest-bearing loan, which means you only pay interest for the time you had the money.  First, your loan was for $11,561.07, and not the $10,000.00 you referenced.  Your first payment was due on 10/20/22 and you paid this on 10/21/22.  On this payment of $767.60, $577.35 was for interest and $190.25 went to principal.  This payment was returned for NSF and you paid it on 11/1/22, which resulted in more interest for a total of $782.22.  This pattern of delinquent paying throughout the loan resulted in more interest being charged, especially with the two-month extension.
The collateral has been sold and you will be receiving documentation via the **** regarding such.
      Regards.

I am rejecting this response because: please provide statements to prove your point. Since we have been locked out the online portal. You actually just proved a point that majority of payments go to interest. At the time of repossession we still owed almost $9000 two years later. We have a 2022 ***** Silverado that cost 46k so again yall have been paid triple the amount of the loan. The company is a scam and its my mission to make sure you loose as much business as possible.

This Company is reporting incorrect information to the credit bureaus as it relates to a charged off account. I confirmed that this creditor filed a 1099-C Cancellation of Debt on my behalf but they are refusing to provide me with a copy of the 1099-C. Please help.

      Business Response

      Date: 05/10/2024

We are not required by law to issue a 1099-C to any customer for the balance on a charged off account.  In our 30+ years in business, we have never issued such, and this includes not issuing one to Mr. ********** He has a deficiency balance of $18,910.02 and is fully responsible to our company for this amount.  His charged-off account will continue to be reported to the three major credit bureaus.
