We signed a contract with Jeff Lindsey Communities in February of 2021. It took us 14 months (April 2022) to close on our house, and there were a lot of problems doing those 14 months. Communication problems between **** Lindsey's realtor and building supervisor and our realtor. Very little integrity, they would consistently lie about the progress of our home. Then they would tell us weeks later why something did not happen. Most of the time they blame the county, if it was not because of permits it was because of an inspection not passing. They left out things that were supposed to be installed in our home, and they replaced some things that we did not even agree on. They moved our closing date from October to December of 2021, then to January, February, March, and then to April 2022. We lost over 25 thousand dollars just because of **** Lindsey moving our closing date. Once we moved in these are some of the issues we had. The painting was incomplete and poorly done, different light fixers were installed, the downstairs bathroom sink was leaking, and well as the tub fault was improperly installed. ***** was not removed from the master bathroom floor and shower. Siding and rocks around the elevation of the house were loose and or falling off. Doors and door k**** were loose and not lined up correctly. Our stainless steel sink in the kitchen was all scratched up and it was not stainless steel, and the whole entire house was dirty. After we moved in and after all our complaining, they started working on correcting our issues. Now they have stopped coming out and stopped communicating with us, and we still have issues that have not been resolved.

The homeowner did close on the home 4-15-2022. The warranty department does not get involved with the closing of the home but closings get moved due to weather and building materials are very hard to get right now. Jeff Lindsey Communities did cut the homeowner a check for his driveway repair for $1920.00. JLC did repaint the entire exterior of the house and detached garage. The homeowner had 17 items on his list and everything has been completed but 4 items. We still owe homeowner for pantry to be trimmed out, lawn to be reseeded, porch light which has been ordered and waiting on delivering and scratches in sink which bar keepers friend will remove all of that from the sink. The homeowner is wanting everything done at one time and that is very hard to make happen when you have multiple sub-contractors. JLC has accommodated the homeowner and still agreeing to finish the remaining items. JLC will have to schedule with the homeowner as the items are ready to be done but the homeowner has to be willing to work with JLC.

      Thank you,

      Customer response

      08/04/2022

I would like to start by saying I have not heard from ******************************* since the 12th of July 2022. I have been emailing her but she has not responded to me. So I was surprise when the BBB sent me a message, stating the Jeff Lindsey Communities had responded to my complaint. I would like to address **** Lindsey response line by line. I would like to address the closing, by their contract which was told to us by our realtor and loan officer. They can move the closing date 45 days twice. From October 15th 2021 which was the original closing date until April 15th 2022 the date we closed is *************************************** February of 2021. We would be getting close to the closing date and me and my wife would contact our realtor. She would contact **** Lindsey and most of the time we would not hear back from anyone until after the closing date has passed. Enough said about that since ****************** has nothing to do with that department, but it is a lot more to be said this. About the driveway which is also not in ********************** department. **** Lindsey did reimburse me for my driveway, because I had to hirer a concrete company to come out and finish my driveway. **** Lindsey did not do a standard driveway on our home. They kept telling me that they had to do it this way, because that is what the county of Fayette was instructing them to do. **** Lindsey sent me and email from the county in June of 2022 after we had closed on our home, the same email that I had been asking for since March of 2022. After receiving the email I went to the county of Fayette myself and spoke with ******************************* and Mr. ***************************. After speaking with them I sent **** Lindsey an email relaying my conversation with the county of Fayette. After I sent **** Lindsey that email that is when they decided to reimburse. I was getting much push back about our driveway until I spoke with the county. **** Lindsey would have never reimburse me if I did not continue to push the issue. On repainting **** Lindsey did repaint the outside of the house but just the siding only. They did not paint the entire house, which the entire house is what should have been done. I sent **** Lindsey pictures of our house and ******************** from the warranty department came out and saw how bad the paint looked as well. After they painted the siding they got gray paint of some of the white trim of the house, and around some of the window frames. Which is still there today, I have asked if they were going to send the painters back out to repaint the trim of the house because it looks just as bad as the grey did. Or at less clean the grey paint off of the trim, I still have not gotten and answer. I really don't know the total number of issues there where in the beginning. But there is more than 4 left, I will attach a copy of the email I sent ****************** about what issues that are still outstanding. I will also attach a copy of the email I sent **** Lindsey about the driveway before they reimbursed me the $1920. The pantry has not been completed, and this is the first time I am hearing about **** Lindsey reseeding our lawn. I have been sending ****************** emails and have not heard from her since the 12th of July 2022. I keep asking ***** I do not know his last name. He is the one that is coming out to our home repairing things for **** Lindsey. When I ask him has anyone from **** Lindsey said anything about our grass, his answer has always been not yet. So again the reseeding of our lawn is new to me. I hired Think ****************** to help with our lawn because it was looking so bad. And **** Lindsey was not responding to me or ***** about our issue with the lawn. I paid Think ****************** a total $532 dollars for Lime, Weed Control, and fertilization. I stop the service because I was not seeing any improvements. About the porch light it has been on order since May 2022. ***** told me that the porch light they we are having the issue with. Is because the wrong porch light was installed. ***** told me that he was reordering that day which was in May. ***** was coming out to our home prior to ***** coming out. So how much longer is it going to be before the light comes in? About the sink we paid for a stainless steel sink, this sink in not stainless steel. Me and my wife are very familiar with Bar Keepers Friend we have used it for years. We have some under our kitchen sink right now. Bar Keeper is not going to remove all those scratches and discoloration in our sink. As well as keeping the sink from rusting let it does everyday. And if it works so well why did **** **** Lindsey building supervisor on our home not use it. Him and I were in the kitchen after it was installed, and I asked him about all those scratches and discoloration. I told him this is not a stainless steel sink, he said it will look better after he clean it up. So why is our sink still looking the why it is? I have told ****************** and I have told and shown *****, *****, and ********************, the differs between the sink in the kitchen and the one in the laundry room. The one in the laundry room is stainless steel the one in the kitchen is not. I think I have been very patient with **** Lindsey, despite it taking 14 months to close on our home. An even after closing having all the issues on a home that took 14 months to built. As well as reaching out to **** Lindsey employees and not getting a response back from them for weeks at a time. Yes I think I have been very patient. I want all my issues resolved in a professional manner.

      Business response

      08/09/2022

Yes I did speak with the homeowner on July 12th. I was on vacation July 13, 14 and 15th. I worked the 18, 19 & 20th. I was out sick the 21st and 22nd. Then I was on vacation again for 10 days starting July 27th for my grandson's World Series in *********. Once I send a warranty request to the field the warranty person in your area should be addressing the concerns. I know that **** was involved as well. I do not have anything to do with the building of the home to the closing of the home but I do apologize for the inconvenience. JLC has reimbursed you and corrected items and willing to correct anymore that are warrantable.

      Thank you

The last 4 times I emailed ****************** was on the 12th, 15th, 19th and 28th of July, 2022. She stated that she was at work on the 18th, 19th, and 20th of July, 2022. Then why did I not receive an email or a phone call from ****************** on the 18th, 19th or even the 20th of July. Enough is enough I am so tried of this, we have not really enjoyed our home since we closed in April. I really wanted to get my wife in our new home, so that the feeling of just being in a new home. An the excitement of shopping and decorating would pick her spirits up and help her bet this cancer. But this house has not done anything but brought our spirits down. Going with **** Lindsey to build our home was the worst mistake of 2021 without a doubt that I made. I really want to be done with this, because we are finding more and more new things everyday. Now in the master bathroom our standalone tub cold k*** is knocking when you shut the water off, and we really haven't even been upstairs to check things out. I would like our house inside painted, just like the outside had to be repainted because it only received one coat and it was poorly painted. The inside needs to be repainted or even painted because it is just as bad as the outside was. The light on the porch needs to be replaced and the kitchen sink needs to be replaced. Even if Bar Keepers Friend could remove all the scratches from our sink, which it cannot. Why was a ***** scratched up sink installed in a brand new home in the first place. We paid for a brand-new stainless steel sink a sink that has never been used. We did not receive that new stainless steel sink. Last thing is to have the grout removed off the master bathroom shower and floor. If we can agree on these four things, we can bring this nightmare to an end. I really would like that especially for my wife. Also ****************** could you please have someone pick up these interior doors. They have been here for about two months or move since someone from **** Lindsey dropped them off, a month or more since a couple of people from **** Lindsey promised to get them picked up. I would greatly appreciate it if you would have someone retrieve them.

      Thank You

I purchased a home on 02/05/2021 and Jeff Lindsey communities failed to provide the warranties that it promised for the year end work and continue to ignore our emails in regards to issues that arises from builder's lack of expertise when building the house. all backyards on our street has drainage issues and they are aware of it but just failed to correct their work. Throughout the year, the warranty department's in charge person continuously ignore my request to come out to do repair work and despite numerous attempts to get their warranty department to come out to fix the issues, we have no one to really come out to do the warranty work. We keep getting "we are getting to it" answer when we could get a hold of someone. Now that our year end warranty time has passed for almost 6 months and we still have no luck getting them to come out to do the work. This is happening to more than just me in our neighborhood. This company false promise their product, breach multiple contracts, provide false advertisement to the amenities in the neighborhood and it has caused tremendous amount of stress on the whole communities.

      Good Afternoon,

I spoke with the homeowner 7-5-2022 at 4:13 pm and explained to him that ***** would be getting his warranty sheet and schedule with him. The water drainage is something that **** our Production Manager will have to look at and approve to get fixed. I explained to the homeowner that as well. We are willing to fix all warrantable items on his list. Sorry for the delay and his list was not completed by *****.

      Complaint: 17468993

**** Lindsey warranty department continuously demonstrated no regards to the customers to whom they sold house to despite countless complaint they receive on the way the house drainage system are built. The whole neighborhood is impacted and yet they do not care to fix it. After they received the first compliant by me via BBB in June 2022, they pretended like they are going to fix the issue so they can dissolve the BBB case, however, no action has been done since then and we are almost in September. I received no communication from the landscaper on when the issue is going to be fixed. I recommend BBB look into the whole neighborhood's drainage issue, I doubt it is built according to the building code. The issues have been known to **** Lindsey warranty department for over a year and a half, and the answer I keep getting from them is " we do not know when we will get to you" or " you are on the list". I am not sure if they truly care about their warranty commitment which constitutes breach of contract and fraudulent advertisement. I wish BBB look into this issue and make sure this issue is actually addressed.

      Sincerely,

      Tong Gu

I initially spoke with homeowner on 8/9/22. He explained his concerns for yard drainage, sod, and sprinkler heads that needed attention. I forwarded this information onto the landscaper. The sprinklers were repaired on 8/12/22 to prevent the leak from continuing. I have spoken with this homeowner a couple of times on the phone, the dates I am unaware of. I assured him the landscaper has his information and he is aware of the problems he is having. On 8/30/22 I received an email from the homeowner expressing his concerns as to why no one has came out to repair his yard. I responded to his email explaining the best I could as to why his yard has not been repaired yet. The email correspondence is attached. There are many unforeseen circumstances that can hold up the landscaping process. Such as weather, material allocation, equipment break downs, etc. That being said we are unable to provide exact dates on when the repairs will be completed. I believe I have communicated very well with this homeowner, and hope we can get the yard repaired here soon.

Bbb write up We purchased a home in ************************ 10/2020. We have been trying to resolve outstanding warranty items with sheetrock, easement, & flooring since November 2021 & now JLC isnt responding to our requests to meet in person & review for resolution. *************************** told my husband she did not have time to go back & forth with him on email. Weve emailed/texted/placed warranty requests online w/ ***************************, ******* Mix, *********************, *****, a production Mgr, ************ Lindsey, several times with zero response. Our floors are splintering, cracking and gapping between boards and upon inspection by a 3rd party, the reason is install issues, which JLC is refusing to accept. Our sheetrock has attempted to be repaired twice & still looks awful - we were asked to sign off on the work as being complete and when I refused, ********************* said he didnt need our signature and left. Additionally, our home is next door to the model home, which has sod on their portion of the easement - JLC placed pine straw and rocks on our side & is refusing to sod our portion. My husband has attempted communication through text and now **** isnt responding to those either. We want a production Mgr and a senior leader at JLC to come to our home and inspect the issues with us & come to mutual resolution. We want JLC to stand behind their warranty and not ignore our communication attempts. Weve been very patient and have followed all the protocols as homeowners and its unacceptable for JLC to ignore us and leave these items outstanding. I have attached screen shots for reference. P.S. the job sites around our home have been left extremely dirty (beer cans, used condoms, food trash, chicken wing bones, etc.). They constantly allow their trash dumpsters to overflow garbage all over our neighborhood including our yard. When asked if the job sites could be maintained better, I was told JLC cant do that because theyre having a difficult time getting contractors to work for them.

      Business response

      02/22/2022

The homeowner purchased the home at ********************************************************************. 10-1-2020. The first concern was the easement and I explained to the homeowner that they were more than welcome to contact Coweta County but Jeff Lindsey Communities has to abide by the county rules of an easement. The second concern was the flooring and JLC got Atlanta Flooring out to look at the flooring and then they got the manufacturer involved. The manufacturer will not warranty due to they are saying that the dogs are causing the problem. The third concern is the sheetrock work and ********************* is trying to work with the homeowner but she told him yesterday that until the easement and flooring issues are addressed that she will not let them complete.

      Complaint: 16751462

I am rejecting this response because:

Georgias Right to Repair Act, O.C.G.A. Section 8-2-35 et seq. states you have to respond to us within 30 days of written notice and repair or settle.
We didnt mention the easement in our write up, but since you mentioned it, we understand what an easement is and did contact the county regarding ours. They told us that JLC made the decision on what material to place on the easement, as they only need access, which they have. Our question is not regarding easement access or what an easement is, our question is why was the decision made to have model home sod laid on their portion of the easement and our portion has pine straw and gravel that continuously washes out with rain. We even received a letter from our HOA to employ weed control on the model home grass, which isnt our property.

Regarding our flooring issues, please send proof that the mill claim was denied due to our dog. I have attached the mill inspection report to this claim and it specifically states that the issues were caused at install (install issues) and doesnt mention a dog. I have highlighted the portion stating install issues in case you overlooked it. We have emailed 9 times and left voicemails for every contact in ops/Warranty/production at JLC with zero response regarding our concerns. My husband reached out to ****** via email and she informed him she didnt have time to go back and forth on email with him. We did speak to ********************* who stated that *************************** advised him not to discuss our flooring. Why? It is unacceptable that JLC and ***************************, a customer service manger are ignoring our requests to have someone from production/warranty come to our home and discuss the issues we so we may come to a resolution. Weve received a quote to replace our flooring and its $11k-$15k, which we refuse to pay.

********************* has been in touch with us about our sheetrock and we advised him we prefer all parties come to our home, walk through, discuss the issues and resolve, and *************************** advised him not to discuss anything other than our sheetrock. Why? What is **** plan to address our flooring concerns? Why isnt JLC backing their warranty?

*************** has sent the homeowner a letter that if we agree to replace her hardwood floors that her dogs damaged that she would agree to withdraw the BBB complaint and bad reviews. We have all the manufacturer paperwork saying that the floors were not defective but we are waiting on a response back from *******************. Beware of this builder. We bought a home Sept. 4th, 2021. Trim, paint, walls, doors are horrible. You think you are building a new home until you walk in and see that your home looks like a 10 year old home. If you post anything on their social media sites, they block you. Five months later we have unfinished work, leaky showers, separating trim work, door that wont close, drywall repair not completed, paint all over the floors and fireplace hearth and the list goes on and on. Freedom Builders and Jeff Lindsey Communities (the Builder) installed a defective retaining wall. We closed on the home November 4, 2020 and had to inform the Builder that the wall was failing on December 30, 2020. Instead of addressing the issue the Builder repeatedly denied the wall was failing saying the ******** was just leaning. When the Builder finally admitted that it was failing their contractor came out and dumped more dirt behind it as a fix, which promptly washed out the next time it rained, dumping more mud into the driveway. In November 2021 the Builder told us they were going to replace the wall but refused to provide specifications or agree with us on a contractor to provide the service, which as the homeowners we felt were necessary being that the initial wall was constructed so poorly. We have had other contractors look at the wall and have been provided a list of basic requirements that were omitted when building the wall the Builder constructed. We declined their "offer" under those terms and their emails became even more forceful in an attempt to intimidate us telling us they would build the wall as if we had no choice. After we declined again, the Builder's attorney sent a letter saying that our requests were unreasonable. They also indicated that I was demanding they move the wall back which was and is not true. The wall is built to close to the home but my written request never included that they move it. They indicated that if I rejected their repair, which based on their track record would be just as bad as the first wall, I would only be allowed the *** of the wall they were going to construct which amounted to $9,680. We accepted that amount in writing and planned to put it towards building a proper wall which will cost much more to be done right. However the Builder has not paid, adding insult to injury. There other things they failed to do but this is the chief concern. It is impossible to feel less valued as customer.

This complaint is in reference to the dead grass that is evident in our yard. We have tried to communicate with **** Lindsey to no avail. It has been nearly eight months since closing, yet we have constantly been ignored and the dead grass on our property has yet to be replaced. Under Georgias Right to Repair Act, **** Lindsey is obligated to cure damage to our property, our lawn, due to defective material. On July 2, 2021, ***** spoke with ***** about the deteriorated condition of our lawn. We were told that proper steps would be taken to replace the grass if our grass did not show any progress 30 days from the treatment, which would be July 21, 2021. During this conversation, ***** also reported completing a walkthrough, and he made the statement that it appeared to be progressing. On the contrary, our grass has not shown any progression since our closing on April 22, 2021. As a result, on July 21, 2021, we made several attempts to contact *****. We also left several voicemail messages, but unfortunately, he did not respond to our messages. After being unable to contact him, we spoke with ****, who stated that he would relay the message. Notwithstanding this, we still have not received a response from him. On July 22, 2021 at approximately 9:35 AM EST, we contacted corporate and spoke with ******. We expressed our concerns, and she stated that she would forward the information to either **** or *****, the production managers. I told her to please have them respond to this matter by July 26, 2021. Despite calling corporate, we still have not received an adequate response to our concern. Every lawn professional JL has sent to our home has stated our grass looks great; however, we had our own professionals come out for a second opinion, and we were told the grass is completely dead and needs to be replaced. We have been very understanding and patient throughout this entire ordeal; however, we are not being treated fairly or taken seriously.

      Good Afternoon,

The homeowner closed 4-22-2021 at **************************************************************. According to my notes ********************* the warranty person in that area stopped by a few days after closing and told the homeowner that he was going to have to water his lawn or it would not live. The homeowner did have a sprinkler system installed several weeks later. On June the 14th I received an email from the homeowner saying that they had installed a sprinkler system and the company had found large rocks which were discovered under their grass but no pictures of this was provided. They also did not call the office or let the builder in the subdivision know of the findings. The homeowner did say that they hired Trugreen but then fired them for doing something without their consent. On August 11, 2021 ****** here at the office ordered a one time treatment but the homeowner would not allow Trugreen on their property. Jeff Lindsey Communities does not owe them anything when it comes to their lawn. It was neglected from the start and they have refused lawn care treatment. Sod requires attention and maintenance which includes watering, fertilizing and cutting. The homeowner did sign on 4-15-2021 at their walk thur that they received a copy of their lawn and landscape letter. New Sod has to be watered from the day it is installed and it is recommended 2 times per day for 20 minutes for at least two months and then the watering can be tapered down. I am sorry that they are upset and find a resolution.
      Thank you,
