On November 2nd 2021 Lamar Trucking was contracted by a neighbor to transport a dump truck to another address. In the process, the truck driver ran over a number of 20 year old shrubs on our property. We sent them an estimate from our landscaper totaling $3349.75 to restore the property to it's original state. They said that the price was too high and wanted to use a landscaper of their choosing to which we said we would consider assuming the job was to restore things to near their original state. They promised on numerous occasions to come out and look at the damage which they never did. There were numerous phone calls and emails promising visits the next day but no one ever showed up.The last email conversation was 1/19 stating they would TRY to visit the following day which didn't happen.Since that time, we have not heard anything back even after numerous follow-*** from us.A message was left for their President and COO on 2/7 followed up with a registered letter with the 'return receipt' delivered back to us on 2/11 with their signature dated 2/9.We offered to accept payment of $2800 to get the problem resolved quickly and we would make up the difference with our landscaper but again, no response from them.We need to get them to fix the problem they created.

      02/18/2022

Good afternoon and thank you so much for reaching out.

I am more than willing to settle this dispute with the homeowner.  First, I have scheduled appointments and had to cancel as we are a small business and my mechanic had to be dispatched onto road service, etc.  ************ was also plagued by COVID with 3 of us getting it and having to quarantine to protect other employees (we have a total of 7) and for rest and recuperation.  My coworker is out with surgery and I am unable to leave the office.  She goes back to the surgeon Monday February 21, 2022 to be advised of a return to work date.  We have scheduled appointments and the ********* cancelled due to their appointment schedule conflict as we have had to do the same. This is verified through the chain of emails.  The estimate they sent seemed high, and after contacting different plant nurseries, we are able to purchase replacement plants at a much reduced rate.

Please review the estimate where we can remove the broken shrubs and replant (saving $1500.00) and saving the delivery fee of $150.00.  From the look of the video, the damaged areas may be part of the right of way on the cul-de-sac.  I do have a video made on the day of the incident and have tried to upload it, and I am having difficulties.  From this video, it is obvious this amount of damage claimed is excessive.

What can we do to come to a fair and favorable resolution?  We are able and willing, allowing for my office to be staffed and bring this to closure for both parties.

Thank you for your time and consideration of this matter.  I may be reached at my office at ************.

      Regards,

      *******************,

      President
