      I received a letter from IRS that my personal information had been comprised. I immediately checked my credit report and noticed an inquiry from 1st Franklin Financial which I have never applied and authorized them to pull my credit report nor have I ever had an account with them. When I reached out to them on 6/17/2024 at ************, they did not confirm any information and told me to find a near by branch and take a police report. This is extremely poor customer service especially being that they did could not verify my information. I am looking to get this fraudulent activity on my credit report resolved immediately.

      This company refused to take my payments for a loan I received from them by mail that was deposited into mine and my wifes account. They locked my online account that was wife used to pay for the loan each month. I had no job at the time and I still dont so they let my wife call and pay every month. They suddenly stopped and told me I had to come in, we do not live any where near there any more and the manger is so rude that I will not be put down by him any longer, why is my credit suffering because they kept refusing payments stating that this is a new protocol. If this is true why didnt they mail letters out or take payments from my wife. We never paid late until they refused our payments! We have other loan companies that dont treat people this way! They talked to me and my wife like dogs and said the only way Ill take your payment is to come in! So why have internet pay and why take payments by phone from my wife for over a year!!! They should be shut down ! I refuse to be talked to or treated this way! They harass me every day after I told them not to call me! Ill be ready to see them in court with phone calls recorded!

I have asked that my address and name be removed off mailing list, but it has not been removed. In last letter, I advised I would file a complaint if I received another letter and I have as of today.

      This company refused to take my payments for a loan I received from them. They locked my online account from the moment I created it. I managed to get it unlocked for one payment. They constantly withdrew from my account on the day before I received my paycheck resulting in the payment to be returned, and they refused to except a debit card payment, which would have resulted in on-time payments.

      I received an order to show up for court on February 9, 2024. 1st Franklin Financial had a fraudulent contract that was signed by a third party business whom lied to their company stating that I purchased a product/ device in which I never agreed to nor signed. I explained this to the courts and the Manager committed perjury in court stating that I had received a copy of the contract prior to the court date. That was the untruth. I never saw the contract nor signed it prior to the notice of service. The contract was initiated December 2021 and the company manager of Pure Air in *************, SC forged my signature electronically and emailed it to 1st Franklin Financial unbeknownst to me. They had a charge for over $3,400 on the bill for a display vacuum that was shown in a demonstration. No agreement nor contracts were initiate on 12/12/2021 when I the demonstration took place, so how is it a contract was initiated in my name under the wrong address and no drivers license nor last for digits of my social security number on the contract to verify it was me? The contract was initiated fraudulently by the manager of Pure Air! The manager of 1st Franklin Financial stated in court that they had several complaints with previous customers regarding the same matter but those cases were thrown out and mine wasnt! Its an act of fraud, discriminatory and malfeasance to bind a contract that was never signed. I explained on numerous times to 1st Franklin Financial that I did not sign nor have a contract with a vendor name Pure Air. I notice a bill on my credit file and started paying on the bill so that I did not receive a default on my credit file. I have reached out to consumer affairs and the ************************ and a copy of this will also be given to the ************************ and the ****** of ********* General. This business is binding innocent people in contract agreements they know nothing about and call harassing and bullying people into payment agreements.

      I am rejecting this response because: My signature was fraudulently produced on a record that I did not create which is a federal violation.  The magistrate judge did not ask me to return a vacuum to reduce cost, that's a lie. She stated I could return it if I did not want to keep it and still mandated payment. The judgment was unfair and malfeasance based on the fact that Pure Air and 1st Franklin were notified by me of the fraudulent contract and coerced me to pay something knowing that I did not produce nor sign nor agree to any terms non whatsoever!. I have paid nearly $3,000 for an unopperable device, so why would I pay an additional $2,000 which totals $5,000 on something I never agreed to and 1st Franklin will only fix and resale the device due to GREED? This is absurd and my complaint has went further than BBB. I have notified the ************************* SC ***************** *********************** and ****** of ********** General, Consumer Affairs ******; to include filed a complaint of my Civil Rights being violated.

      Dear BBB,I am writing to file a formal complaint against 1st Franklin Financial Corporation regarding their misleading representation and refusal to acknowledge their legal status as a ************************* (CRA) under the Fair Credit Reporting Act (FCRA). I have made multiple attempts to address this matter directly with 1st Franklin, but they continue to ignore my legal order given under 15 U.S.C. 1681b(a)(2) and deny their role as a CRA.I initially contacted 1st Franklin on [date] to request that they update my account status to reflect as "paid as agreed" and "never late" in accordance with 15 USC 1681b(a)(2). This request is necessary to ensure the accuracy of credit reporting and comply with the legal requirements of the ***** Despite providing the relevant information and highlighting their obligations as a CRA, 1st Franklin has failed to take any action to remedy the situation.In subsequent communication attempts, both written and verbal, 1st Franklin has continued to deny their status as a CRA and has provided misleading representation regarding their legal responsibilities. This refusal to acknowledge their obligations is a clear violation of the unambiguous language and decades of case law interpretation of the *****I believe that filing this complaint with the BBB is necessary to ensure that 1st Franklin understands the seriousness of their non-compliance and takes appropriate action to rectify the situation.       I am rejecting this response because: This response from 1st Franklin is a violation of 15 U.S.C. 1692e in regards to the false representation that 1st Franklin gave implying that 1st Franklin is not engaging in part as a CRA. 

      I have reviewed 1st Franklin response to my complaint and I must express my disappointment and disagreement with your position. Your denial of 1st Franklin's legal status as a consumer reporting agency (CRA) under the Fair Credit Reporting Act (****) is baseless and contradicts the clear language of the law, as well as established case law and regulatory guidance.

      In my previous communication, I provided a detailed explanation of how 1st Franklin meets the definition of a CRA under the ***** The law clearly states that a CRA includes any person who regularly engages in the practice of assembling or evaluating consumer credit information for the purpose of furnishing consumer reports to third parties. It is undeniable that 1st Franklin furnishes consumer credit data to TransUnion, Equifax, and Experian on a regular basis, which falls squarely within this definition.

      Furthermore, I cited relevant case law, such as ********* v. ******************* Services, LLC, which affirms that creditors who furnish information to credit bureaus are considered CRAs. Multiple circuit courts, including ********** v. Experian Info. Sols. and ****************** ********** Med. *********** have also affirmed this interpretation. Additionally, the Federal Trade Commission's (FTC) official commentary on the **** explicitly states that furnishers of information, such as creditors, are considered CRAs and must comply with all applicable requirements imposed by the **** and its implementing regulations.

      Your assertion that 1st Franklin is not a CRA is not supported by the law or the facts. By denying this legal reality, you are exposing 1st Franklin to potential liability, including FTC enforcement actions and class action lawsuits.

      I kindly request that you reconsider your position and acknowledge 1st Franklin's legal obligations as a CRA under the ***** It is in both parties' best interests to resolve this matter in a fair and mutually beneficial manner. As stated in my previous letter, I propose that 1st Franklin promptly updates my account status to reflect as "paid as agreed" and "never late" in accordance with the written instructions I gave under 15 USC 1681b(a)(2). This will not only satisfy your legal obligations but also ensure the accuracy of credit reporting.

      I urge you to take immediate action to address my dispute and comply with your **** obligations. Failure to do so may result in further escalation of this matter, including legal action. I trust in 1st Franklin's commitment to excellent customer service and adherence to the law, and I expect your cooperation in resolving this issue.

      Please confirm your agreement to the proposed resolution and provide me with details of the steps you will take to rectify the inaccurate reporting on my credit file.

      I am rejecting this response because:

      It appears that 1st Franklin Associates may not fully understand the nature of my claims. They have not addressed my concerns and have instead avoided them. The course of action taken by 1st Franklin in denying my claims has caused me further harm and frustration. This is precisely why we are communicating through the BBB. 1st Franklin has not made any effort to discuss a fair resolution with me. Is it normal procedure for 1st Franklin to dismiss customer claims instead of attempting to find a reasonable solution? 

      I am aware that a privacy disclosure was sent to me in our previous communication through the BBB. However, that privacy disclosure did not comply with 15 USC 6802(b)(1)(A)(B)(C), and I did not receive an opt-out disclosure in compliance with 15 USC 6803(c)(1)(A)(B) before my non-public information was shared with third parties such as TransUnion, Experian, and Equifax. The lack of compliant disclosures from 1st Franklin means that they have committed identity theft under 18 USC 1028(a)(7) by transferring my means of identification without the legal authority to do so.

      I am well aware that 1st Franklin "may" report the status of my account, but this does not mean they can do so without complying with the statutes that govern such actions. The bottom line is that the late payments must be removed and updated to reflect "paid as agreed, never late." 1st Franklin is acting as a ************************* (CRA), and CRAs are bound by 15 USC 1681b(a)(2) to follow the written instructions of the consumer. It is evident that I have provided my written instructions.

      I kindly request that 1st Franklin have one of its team members who is knowledgeable in law review our previous correspondence before providing another generic and misleading response to me.
