Dec 2022, someone set fire to the high-rise apartment adjacent to the apartment I lived in. Damages from the fire, smoke, and water, rendered the unit uninhabitable. The landlord gave no financial assistance of any form and required me to still pay the full rent amount. For the next month or so, I was pressured to vacate. In order to do so, it would require me to dive deep into debt to pay for movers, a deposit, etc. I required legal help, so I contacted **************** **********************, an attorney specialized in Tenant/Landlord issues.I paid his $125 consultation fee, and we discussed my situation. He explained to me, the rent paid could be reclaimed because of the uninhabitable conditions. I agreed to employ services and pay his initial retainer fee of $1000 on 2/9/23, and provided him with my supporting documents. He instructed me to inform him when I had procured a new residence at which time he would engage the landlord regarding returning rents paid. On 2/16, I was issued a Notice to Vacate and reached out to ********************** with questions. On 2/23, I informed Mr. ********************** that I acquired a new residence and of my move-in date. I again reached out to Mr ********************** with questions. Questions went unanswered and I proceeded to deal with the Notice and the move-out process. On 3/2, he contacts me to discuss, I updated him on what actions I took. In May, I am contacted and asked if he can close the case. Not attempts have been made to reclaim any money. I remind him that my case involves reclaiming money, and he says he will take action to do so. On 9/11, he calls me to tell me that he reviewed my case and the amount I am reclaiming will not be over $5k, and so the attorney fees cannot be sued for and it would be in my best interest to handle reclaiming myself. I can understand he wants higher paying cases, but I shouldnt be paying for his change of mind. I disputed his fees, he claims getting my money back was a new request, even though his invoice case title states return of rents paid.
