    I paid a deposit of $850 and the lease wasn't renewed. I cleaned the apartment upon end of the lease and sent receipts to landlord. The other roommates left without paying the rent or cleaning their areas. As a result I have been denied my deposit. None of the pictures sent were in my assigned area which wasn't really a real room. She has punished me for the other roommates not paying and has denied my deposit.

    I am respectfully responding to the following complaint. I paid a deposit of $850 and the lease wasnt renewed. I cleaned the apartment upon end of the lease and sent receipts to landlord.  The other roommates left without paying the rent or cleaning their areas.  As a result I have been denied my deposit.  None of the pictures sent were in my assigned areas which wasnt a real room. She punished me for the other roommates not paying and has denied my deposit. 
    Response Summary:  Three individuals entered into a Rental Agreement which they agreed to all be collectively and individually responsible for compliance with all its terms and conditions including rent.  Upon vacating, the tenants were charged for unpaid rent in the amount of $2,700.00 and repairs in the amount of $649.21 for damages beyond normal wear and tear.  Damages included a badly patched wall which appears someone punched, heavy black marks on the wall, dark scuff marks, missing drywall/paint in 2 bedrooms.  The move in property condition forms shows walls were in good condition at move in.  Tenants were not charged for anything else (They were not charged for cleaning).  Tenants were provided with the payment ledger, repair invoice, an explanation of charges, photos and an itemized security deposit statement.  Tenant #3s complaint is that he paid rent and cleaned and, has stated the damages were not in the room he occupied.  Tenant #3s security deposit was not refunded because the agreement was signed collectively and individually so they are all responsible for unpaid rent and damages. 
    Details Unpaid Rent:  Tenant #3 paid $850.00 each month however, Tenant #1 did not make a rent payment in May and, Tenant #2 did not make rent payments in April and May.  The total amount of rent that was not paid was $850 April and, $1850.00 for **** or a total of $2,700. (Ledger attached). 
    Rental ******************* Term I-Disclosures, Item K: 
    Tenant #1, #2 & #3 entered into a rental agreement (attached).  As stated in standard term I. DISCLOSURE in bold and all capital letters, just above the Acceptance of Rental ********** Item K states: TENANTS JOINTLY AND SEVERALLY RESPONSIBLE: BY SIGNING THIS RENTAL AGREEMENT EACH TENANT SHALL BE JOINTLY AND SEVERALLY (COLLECTIVELY AND INDIVIDUALLY) RESPONSIBLE FOR COMPLIANCE WITH ALL ITS ***** AND CONDITIONS, INCLUDING PAYMENT OF RENT IN FULL.  EACH TENANT IS RESPONSIBLE FOR OTHER OCCUPANTS AND GUESTS AND SHALL ENSURE THEY COMPLY WITH THE ***** AND CONDTIIONS OF THIS RENTAL AGREEMENT. 

    Details Damage Charged:  When Tenants vacated, there were damages beyond normal wear and tear in the master bedroom and 2nd bedroom.  Damage was documented and the Tenants were charged for repairs.  The move in property condition form (attached) shows walls in the master bedroom and 2nd bedroom in good condition.   
    The master bedroom had a hole punched in the wall then badly patched and there were large scratches and scuff marks.  Cost to repair $330 plus tax (Photos attached).  As noted on the (attached) move in condition form, the walls were in good condition at move in.   
    The 2nd bedroom had drywall pulled in 2 spots, large scratches and scuffs on 3 walls.  Cost to repair was $290 plus tax 
    (Photos attached). As noted on the move in condition form, the walls were in good condition at time of move in. 
    Rental ******************* Term *********** & Condition, item 2: 
    When TENANT Moves Out.  Tenant must remove all TENANTS personal items with TENANT.  If TENANT leaves any personal items behind, TENANT must pay for any storage and other costs, including advertising costs, involved in selling or disposing them.  TENANT must leave the unit in the same condition as when TENANT moved in.  It is TENANTs duty to have the Unit in clean and proper condition ON THE *** TENANTS TENANCY ENDS, NOT ON ANY LATER ***. TENANT must have the same items in the Unit that were present when TENANT moved in; and TENANT must leave these items in the same condition less normal wear and tear.  If there is any disagreement, the signed PROPERTY CONDITION FORM will be treated as correct    
    Tenant #3s complaint is that damage was not caused by him however, again as stated in standard term I. DISCLOSURE in bold and all capital letters, just above the Acceptance of Rental ********** Item K states: TENANTS JOINTLY AND SEVERALLY RESPONSIBLE: BY SIGNING THIS RENTAL AGREEMENT EACH TENANT SHALL BE JOINTLY AND SEVERALLY 
    (COLLECTIVELY AND INDIVIDUALLY) RESPONSIBLE FOR COMPLIANCE WITH ALL ITS ***** AND CONDITIONS, INCLUDING PAYMENT OF RENT IN FULL.  EACH TENANT IS RESPONSIBLE FOR OTHER OCCUPANTS AND GUESTS AND SHALL ENSURE THEY COMPLY WITH THE ***** AND CONDTIIONS OF THIS RENTAL AGREEMENT.
