The house/garage construction project started 6/21/21 when I signed a contract with IA Builders, LLC. The contractor had me sign his contract he created and uses regularly. It was a fixed price contract and any changes were supposed to be made using change orders. There were no change orders. He would just send me invoices that increased and he expected me to pay the invoice. Some of the things in the contract were not done and not taken off of the invoice. When I asked him about those things he said he would take the cost off the invoice but never did. He did work that was not what I wanted. I asked him to let me know when he was doing the excavation work and he said he would but then did the work while I wasn't there and then charged additional money. It's been terrible working with him, poor communication.I paid him the full amount of the contract. I signed his contract 6/21/21 for $26,385.00 + sub base and gave him the deposit check $5,500.00 check #**** and he cashed it. He sent me a new invoice reflecting the remaining balance of $20,885.00. I paid the 2nd check #**** for $6,580.00 on ,6/28/21, he cashed it. Then I kept emailing and texting him to come back and fix my driveway because he created a hill in my driveway that allows water to run towards my house. He said he would come and reshape it but he has not. He admitted the house foundation should have been 2-3 feet higher than what he built. I told him to fix it by cutting down the hill 2-3 feet to eliminate the hill. I figured he was not going to come back and fix anything and I was tired of working with him so I sent him a final check for the amount I still owed based on the contract. On November 9, 2021 I sent him check #**** for $17,263.45. The sub base was $2,958.45. So the total amount of money I paid to him was $29,343.45. On the final check I wrote PAID IN FULL in the memo line and he has not cashed it and says he will not cash it until I pay him more money.
