Hired TNG for septic system. Within 7 months of occupancy, we had a significant leak due to poor craftsmanship and parts. ****** stated if we have landscaped since hes been there then it is not his problem. I am the homeowner and builder did the landscaping and know without a doubt no dirt was moved in any manner around the septic tank where the leak occurred. I sent *** the bill for hiring out another contractor for what he stated was under a minimum of one year warranty.

    Business Response

    Date: 09/17/2024

July 16, 2024 customer contacted ****** with *** to state that there was water leaking around the lid of his septic tank and sent a picture. Upon looking at the picture, ****** stated it had appeared that something may have happened when customer had installed dirt around the tank. Customer claimed that that was false.  ****** stated that he would go and fix the issue, but this would be at a cost and he would not be available until Monday. Customer stated that he would hire another contractor to fix the problem and then send us the bill, though we had already told him we would be there Monday. The following day, July 17, 2024 customer sent ****** videos and pictures of the broken pipe stating that they found the issue, I will send you an email and have copied my attorney to proceed with a suit for failure to perform due to poor workmanship and parts. At this point, we decided not to respond and wait for customers attorneys to reach out.

Here is why we, TNG believe the broken pipe was not our mistake and the mistake of someone elses negligence. On November 1, 2022 the septic system passed inspection on the drain field and tanks, but we were waiting for a pump test once the customer had power installed.  The final pump test was done and passed on November 16, 2023, a year after the initial drain field was installed. Fast forward,on June 15, 2024 customer reached out to ****** and stated that the back lid on the tank was never tightened (word changed) down, so do I tighten (word changed) it down or was there a reason? Also we would like to raise up the lid, so isnt there extenders for those lids so they set up with our landscape. ****** responded It should have been tightened (word changed) down unless someone took it off. Yes, there is rises they make.Customer never mentioned anything about water in his text message at that point, nor at any point prior to July. July 13, 2024 is when customer reached out asking why is water leaking from this. This is after customer installed risers and dirt around tanks.
With this information, we feel that there is a lack of evidence that puts the blame on *** for the broken pipe and customer was not willing to wait until Monday July 22, 2024 for us to investigate it ourselves.

    Complaint: 22257731

I am rejecting this response because:

The response from *** confirms and reiterates a lack of ownership and accountability for the work *** performed. *** did not make an attempt in any manner to return to jobsite to investigate (using your words) or resolve the issue once I brought this to Trevors attention as the owner of ***. Trevors response was 100% blame directed to the landscaping company. The pictures and video are indisputable who is responsible for the poor workmanship and lack of accountability!

    Sincerely,

    ****** ******
