      1.) Date of transaction was August 14th, 2023. 2.) Amount paid to the business was 23,550.57.3.) Business committed to provide full roof finish, garage roof, coping tiles, and timberline Biscayne blue color.4.) The dispute of nature is I contacted them, and they came. They offered to cover the patches. I said no, as it will cause further damages along the line and more costly repairs. I've reached out for a resolution, and they have been avoiding me. I went to the town of my area, and they informed me they don't service ****** any longer. However, they were when they agree to fix my repairs.5.) They have not solved anything. I went to ************************, and they informed me they no longer serve ******. However, when I did the contract, they were servicing ******. I have an inspection information and it failed. I want a refund of all my money and Ill hire someone else that will comply. 6.) The claim number is *********** 7.) Solicitating in the street in ****** walking down down the alley.

       We apologize that you're going through this unfortunate experience and we as a professional restoration company for the past 18 years have an understanding and we fully take upon any responsibility on each and every situation we come across. 

      With us, you can rest assured that we do not ignore any incorrections accidentally made on our behalf on any restoration project. 

      As you know, we worked with your insurance carrier on getting your roof approved and they refused to open any coverage on your dwelling house roof as the process would take months or a year to get any open coverages. They only paid for your garage roof, rear house siding and a few aluminum window capings and 1 awning. 

       ********** since you were upset on the long process from your insurance carrier refusing to pay for your house roof, you and American Disaster Restoration agreed to exchanging all paid insurance proceeds for the house roof restoration and Garage roof. 

      (No other items were included except Garage and house roof)

       As agreed, we completed the House and Garage roof. 

       After the completion of the modified roofing, we applied the final roof silver coating. That process has to dry in order to move forward with installation of coping tiles. Again you were upset we didn't come the next day to install the coping tiles. We exlained to let the fresh coating paint dry from preventing any damages. You were upset and my roofers then came.back to install coping tiles.

      Due to the paint not fully being dry, a piece of the paint may have been removed from the bottom of the roofers boots while walking with on the roof. 

      We never disagreed with you.

       We have tried many times in reaching out to ************************* to fix the issue and everytime my roofer shows up, ********** doesn't let them.up on the roof. We have tried reaching out over the phone and no answers. 

      ************************* we are willing to come fix the damaged.areas as we take full responsibility.

      We also provide a 10 labor warranty on our work..

      please give us a call and allow us to complete our work.

      I am rejecting this response because: 
      They were supposed to replace the roof and what they did was knock down the two side of the bricks from the roof without my permission so they want me to pay for it and Im not gonna pay something that they did without asking me before doing it. 
      The company was suppose to communicate to the workers what work was suppose to be done. 
      They also did not present a new form with work that was suppose to be done or them saying they were going to knock down the brick wall from the roof. They added more work that was not necessary or even asked to do.

      Hello *********, sorry for the delay, after investigating what happened with our crew, it looks like the interior brick wall on your roof (parapet wall) was already deteriorated and falling off with the membrane, that is the reason of why your roofing material would look bubbled in the photos taken by yourself and our representative that did the inspection with the insurance company, the repair of the walls is not usually included in the price of the roof, that is charge separately when discover as you have no way to see the amount of work that would be required without removing the roofing material over the brick wall, we understand your frustration but we ask you to understand as well that your property's maintenance is not our responsibility as well.

      I signed over a $12,489.89 check from my insurance company to American Disaster Recovery because they were supposed to complete numerous repairs to my property, including replacing the roof and siding. They replaced the roof on Oct 9, 2021 but damaged hundreds of dollars worth of plants, stole or threw away some of my personal property, and worst of all did not competently put on a new roof. They told me they would seal the skylights but not only didn't do that, they cracked a skylight. Some of the workers were drinking alcohol while they were working. They did a poor job of installing flashing and during a moderate rainstorm, I got a lot of water in my house in a location that had never leaked in the 19 years since I've lived here. They have repeatedly promised to come and fix their mistakes but have not shown up. They have promised to come and complete the work, including installing the siding and some interior repairs, but have not shown up. The representative I was dealing with, *******************************, has not returned my calls and texts in weeks. Neither has ******* -- I don't remember his last name but he seems to be a manager with the company. I can provide more documentation if needed.

      Hello *******************, hope your doing well, please find the response to all your concerns below:

      1. Siding work: As explained to you in multiple occasions, your siding has not been approved fully by your insurance, that is the sole reason of why we have not started any work on it.

      2. Landscape: if you read the terms and conditions of your contract with us you can find the following wording -Non-liability for landscape damage: Landscaping will be protected to the best of the ability of the installers while performing labor. American Disaster Restoration, Inc. is not responsible for damaged trees, bushes, flowers, lighting equipment or any other type of landscaping. - Due to the lack of maintenance of your lawn we were unable to safe all your weeds and/or overgrown grass, our installers tried their best to work around the conditions of the yard. We have attached some photos of your lawn previous to the installation.

      3. Personal Property: We took photos of the yard while the shingles were being torn off the roof and it shows no personal property around, if you have any photos of the items you mentioned please send them to us for review / in addition please read line number 12 on your terms and conditions of our agreement: Homeowner to protect property: It is the responsibility of the homeowner to protect or remove all window and door screens, pictures and/or any other breakable items in vulnerable positions to damage due to the scheduled replacement of the exterior applications of the home. American Disaster Restoration will not reimburse the homeowner for damaged items caused by the labor involved in completing the project. 

      4. Workers being drinking during the installation: During this whole time you have not made any comments about workers being drinking alcohol while working on your home, we take this matter seriously as safety its our main goal while work is being performed, we spoke to our project manager that overlook your project and he never seen any alcoholic beverages on site, this accusation is pretty serious and this crew could lose their job so we would appreciate that you send any evidences to support your statement.

      5. Skylights: As explained to you in multiple occasions the cracks on your skylights have dirt and calcium accumulated, this is an evidence of this cracks being pre-existing, it is obvious that at some point in life they were going to start leaking due to the condition of the glass, the interior damages in your home have mold and dried water stains, this shows that your water leaks are pre-existing to us working on your home.

      To conclude we have offered (not promised) to try to help to repair temporarily the leak around the skylight to prevent any further leakage and for you not to incurred the cost to replace it till spring, I personally was going to complete this work in order for the company not to charge you or incurred any labor, you have to understand that my schedule is pretty tight around this time of the year and I been going through some personal issues as well.

      I am rejecting the business response. Here's my explanation and documentation. 

      Landscaping: the company's contract states that they will protect landscaping to the best of their ability but ******** own words to me indicate that they didn't even try: they thought they were doing me a favor clearing it out. I did not have overgrown grass and had relatively few weeds. The pictures he showed you were of daylily stalks, established raspberry bushes, and goldenrod and other native plants that attract bees and butterflies. My garden took years to establish and I didn't think to say anything about it because people get new roofs all the time without their yards being destroyed. 

      It will take years and hundreds of dollars to get my plants back to where they were.

      Personal property: I had a Halloween decoration attached to a fence panel which I hadn't realized would be removed until the workers removed it without asking me. I don't have a photo of it. By the way, I had to remind the workers a couple of times to reattach the panel.

      Drinking alcohol while working: unfortunately I didn't take a photo, but I saw an empty Modelo bottle or 2 next along with other empties next to the cooler the workers put on my lawn.

      Skylights: ****** initially told me that the workers would be able to temporarily seal around the skylights so I would not need to replace them immediately. However, they not only leak as much as they did before,  a skylight that had never leaked leaked during a moderate rain since the roof was put on. ****** told me that cracks might have worsened because of the workers on the roof with their tools but wouldn't take any real responsibility. If he had told me initially that his workers couldn't help with the leaks around the skylight, and might actually make the leaks worse, I would have had the skylights replaced when I got the new roof.

      Please let me know if there's any more information I can provide. I will regret hiring this company for years and I would like to prevent others from feeling this way.

      The photos don't show overgrown grass or weeds because I didn't have any. They show raspberry bushes and native plants. I'm wondering why they took so many photos of my plants, without my permission -- perhaps this had happened before, perhaps they knew they were doing something wrong and were planning ahead to try to make a case.Obviously the project manager isn't going to take photos of his workers drinking on the job, or of their garbage strewn on my lawn. I should have taken photos, but the workers could have retaliated against me if they saw me take photos.I know the skylights need to be replaced soon, and I would have hired this company to do so if they hadn't assured me that they could temporarily fix the problem. Also, they just admitted in their response that their work probably made the issues worse. I'm not aware that they've repeatedly tried to contact me without success. I don't think that's true. Of course I want them to refund to me the money for the work they didn't do.

      Hello ********************, as you may remember we had a claim with your insurance company for damages to your home, part of our claim handling procedure is to take evidences of damages, this procedure requires for us to take photos of your home, especially overviews of all elevations, these overviews show your yard entirely.

      Unfortunately about your skylights we can not assure you that any prior damages or wear and tear would get worse with working around them, no one can predict the future, we tried to help the best way we could but at this point you have to replace them, that is your duty as the homeowner keep maintenance on your home.

      We will send you a refund for your remaining balance of the $12,489.89 we received from ******************* on Monday January 10 2022, we will send you a release of claim as well so you can finalize your claim with your insurance company as well.

      *************************** It's hard for me to tell from the way it's written but I think the company admitted responsibility for making the damage to my skylights worse. We also have to come to some type of terms for the damage they did to my landscaping. I'm willing to consider my not having to pay the deductible, in order to save us both time and money spent on lawyers.
