In April 2020, at the start of the Covid pandemic, I was relocating to the ********* ** area from CT. All rentals were being rented without any visual walk thru. I rented with *************** in *********, specifically told the agent I have a mold allergy after learning my unit had carpet. After moving into the unit I was having health issues consistent with mold exposure. I asked they check a few areas of concern. The sinus infections continued, and they continued to insist there was no mold. I finally found the significant mold they deliberately covered up after seven months of suffering. When I contacted the leasing office they sent a maintenance person over to my unit with a spray bottle of bleach. UNEXCEPTABLE! That is not proper mold remediation. I advised that I would need to vacate immediately due to my health and mold allergy. I was told they would only allow me out of my lease if I moved to another Equity Residential. I went to other Equity Residential in the area. The other properties were more expensive and had bad maintenance. My attorney contacted the leasing office at Sheffield Court as did I and I relocated to a newly renovated apartment not affiliated with Equity. My attorney was advised by Equity to contact a third party to handle the claim for my damages. That third party never handled my damages nor responded to my attorney. I then received a collection for nearly $7,000.00 stating I broke my lease and owe for damages created by them. I filed civil case in ********* County Courts against Equity Residential. Their listed registered agent in the state of ******** was served with the court files but responded claiming they are not the registered agent for Equity Residential in the state of ********. I have attempted to contact the registered agent and the company with no response or even any human answering a phone. This will also be sent to my state representative as this company shouldn't be allowed to exist in the state of ********.

Thank you for sharing your concerns. We did, indeed, file a claim with a third party claims administrator, Sedgwick, who handles all claims on behalf of Equity Residential. A representative from their office attempted on several occasions to reach both you and your attorney, to no avail. The matter was finally closed on their end due to a lack of response.

We cannot comment on who or where your papers were served. However, we can assure you that all entities where we do business in VA are properly registered. That being said, we have reached out to Sedgwick to have them re-open the matter and contact you directly.

I am rejecting this response because:

It wasn't myself or my attorney that was not responding to *******. It was ******* that didn't respond to us. These are the emails that my attorney sent requesting responses.

      **********************,

I have not heard from you again regarding **************** claim.

I specifically asked if you can settle the property damages claims, lost income and any medical losses.

Please replay at your earliest convenience.

      Best,

      *************************| Esq.
      mobile ************

Please respond with your registered agent information because the registered agent listed on the ******** State website sent a letter stated they are not your register agent.

I have heard from ******* and this claims person seems to be responsive. I am unwilling to sign the medical release form without any specified service dates. You didn't respond to the nearly $7,000.00 collection that is on my credit report regarding the lease. There's a pending dispute with Experian. An uninhabitable apartment that I should have never been lease to begin with full of mold. I have pages of complaints by tenants who contacted the leasing office complaining due to mold in their units. I attached a snippet to this response. A maintenance person was sent out; clean the area and mold returned. This is not proper mold remediation. I made it very clear to your leasing agent I have a severe mold allergy prior to moving into your properties sight unseen during a pandemic. I took your companies word that it was habitable. When the leasing agent offered for me to relocate to another Equity Residential property I could visually see the same low maintenance and feared the same outcome. A person I know did take that offer, after being exposed to mold in her apartment and is now having issue with rat infestation in another Equity Residential property. I will be contact Arlington *************************** Tenant-Landlord Commissioner to further investigate the uninhabitable conditions at Sheffield Court.

      Darya,

I am attempting to set up electricity, Dominion is stating there is a pending turn on service already for the address. Is that normal?
One other issue, I have a SEVERE mold allergy, it was my understanding these units all had hardwood floors, based on online advertising. It is a concern that this unit has carpet, how old is the carpet?

      Thank you

      Shawna

      Sincerely,

We dispute the allegations in this complaint. The resident reported mold in her home. However, she did not provide us with the opportunity to address the matter and simply vacated, terminating her lease prior to its expiration. Nevertheless, in an effort of good faith and to amicably resolve this matter, we have waived the charges assessed for early termination, leaving Ms. Mead with a small balance for rent and utilities through her move out date. We trust this resolves Ms. ****** concerns and encourage her to pay the remaining balance.

I moved out of Equity Residential property March 26th, 2022 and upon receiving my move out inspection report I was falsely charged of multiple items. There are no evidence of what was wrong with our apartment and I was charged an early termination fee when I submitted my notice to vacate in timely sufficient manner. I have made multiple attempts via email so its documented to reach out to the property manager at ******************** and there hasn't been any response regarding my concerns. I have asked for numerous follow *** and called earlier this morning to leave a message for the property manager and I still haven't heard back. The property managers name is *************************** and I even cc'd the First VP of Brand and Customer Experience on this emails. Even with that I haven't heard back from anyone. I'm requesting for a sufficient refund from my security deposit as I was a loyal Equity Residential tenant. I made ALL my rent payments on time and never had a lease violation. Please help me get a sufficient refund from my security deposit.
