On September 20th I went to pick my car up from Midtown Auto Repair where I was told to pay an extra $1,200 on my car repair after no contact from management made me aware of this new charge. He told me if I wanted my car than I needed to pay it. I paid the balance and her assured me that if my warranty covers the extra work I will receive a refund. I was then notified I was not supposed to be charged this extra amount. by the manager and that they will send a refund to me and they let me know it should take about a week. My warranty did cover this work and I had a small deductible which I paid. This was around the end of September. I have never received the refund, after countless phone calls and emails, they refuse to give me money that was taken from me that should have NEVER been taken in the first place. The manager ***** says it is out of his hands and that there is nothing he can do to help me. He said Janat, their billing administer is in charge of the refund and he does not know why she wont send it or return my emails and there is nothing he can do to help me besides telling me to tell my bank I need a refund and dispute. They will not transfer me to the owner to help me resolve it either. This business STOLE money from me and refuses to give it back. They have no decency to resolve this with me and told me I'm out of luck on getting my money that they stole back.Initial Complaint

On Aug 27, 2024, Midtown Auto Repair replaced a cracked oil pan on my vehicle and changed the oil. I was told that I lost a significant amount of oil and I was lucky to make it to the shop in time. The morning after picking up my vehicle from service, it began making noises consistent with engine failure. When I got to work, I called the customer service manager and was told to come in right away. That evening while on my way back, I was on interstate 55 about to exit at 292A when I was forced to pull over. The car was shaking and would not accelerate. Oil light and check engine were both flashing at this time. I had my vehicle towed back to the service center and after the mechanic examined my engine, I was told that the oil pressure sensitive timing belt had failed. When I first asked about their willingness to repair the damage that followed your repair, they said they would see what could be done to repair this damage. In the meantime, I called two other agencies that repair mini coopers. Both informed me that in cases such as mine, the replacement of the oil pan should be followed by an examination and if needed the realignment of the timing belt. Not doing so would certainly result in timing belt failure resulting in complete engine failure. After a few days I was informed that the engine would need to be fully replaced. They claimed that here were no error codes after the digital scan, proving the engine was fine. They confirmed that the timing belt was therefore not checked. They stated that repairing this engine failure would be my responsibility. I disagreed but they stated that there was nothing more that they would be willing to do and that it was simply at series of unfortunate events. I am asking that the damage done to my engine in result of service oversight, be completely repaired by their center. I am requesting to be refunded for the initial work that ended up totaling my vehicle.Initial Complaint

I am writing to file a complaint against Midtown Auto Repair located at **************************************** due to inadequate repair services performed on my vehicle and the subsequent damage that occurred.On August 24, I paid $650 to have the ignition coils and spark plugs replaced at Midtown Auto repair shop. However, after driving the vehicle for approximately one hour post-repair, it became undrivable. I immediately returned the car to the shop for further evaluation.Upon inspection, the repair shop informed me that my vehicle now requires an entirely new engine due to overheating. This diagnosis was alarming, as I had no prior indication of any overheating while driving the vehicle. It was later brought to my attention that the primary cause of the overheating was a coolant leak, an issue that the shop failed to mention or address during the initial service. This oversight suggests that the shop did not perform a thorough inspection of my vehicle when it was first brought in for repairs.I find it unacceptable that after paying a significant amount for what should have been routine maintenance, my vehicle is now in worse condition due to a problem that should have been identified and resolved during the initial inspection. The coolant leak, which was the true cause of the overheating, was neglected, leading to severe engine damage.Given these circumstances, I am requesting that Midtown Auto Repair either:1. Refund the $650 I paid for the initial repair, as it did not resolve the issues with my vehicle and led to further damage; or 2. Cover the full cost of the necessary repairs, including the replacement of the engine, at no additional charge to **** believe this request is fair given the shops failure to conduct a comprehensive inspection and address the root cause of the issue during the initial service.Thank you for your attention to this matter. Details of the transaction are in the attachment. Midtown Auto Repair represented that the tires sold to me were brand new. Upon picking up the vehicle, the date code on the tires are more than three years old. Upon raising the issue with the manager, I was threatened and told that it didn't matter, if I wanted the car I had to pay the invoice regardless. According to The National Highway ***************************** (*****) and official manufacturers suggest a tire is only 100% safe to use until it turns 5-6 years old. These are already three years old before they were sold to me as new. From KBB- Tires also degrade even when they are not being used. The ***** recommends that tires be replaced every six years regardless of the number of miles driven. Proper inflation is the Holy Grail of tire maintenance. Literally ****** this issue and the evidence is plenty.The complaint alleges that Midtown tire knew they were selling me used or outdated tires, when confronted at the store, used intimidation and threats to get me to pay up and leave. This is an expensive sports car which now has unsuitable tires and affects the value of the car because two tires are three years old and would be devalued because of it.Business Response

I paid $3030.39 to this company for the replacement of 4 tires and one wheel. My wheel was bent and needed replacement. They called when the wheel was ready to do the repairs. I picked up my car and noticed a week later that the rim that was supposed to be replaced was still on the vehicle. I went back to the shop and they told me they forgot to do it, but couldnt put the rim on because they sent it back to the distributor. They then offered to order another wheel and have me come back. I told them no, and to refund me for the rim, which cost over $1,000. The fact that they returned a brand new rim to distributor obviously made me feel like they are completely scamming me. They are refusing to refund me. I have the bent rim on my car to this day.Business Response

I am rejecting this response because:I have just read the response letter from Midtown Auto Repair, and I would like to provide the facts in this case, as Midtown Auto Repair is attempting to manipulate every company that I have complained to.
The work requested from Midtown Auto Repair was to replace tires and REPLACE one rim. This is very apparent in the work order that is attached. There is a list of parts with part numbers. The tires have part numbers, etc. If you look up the part number that is next to the line item labeled WHEEL/RIM, if you literally ****** the part number, youll see that it is for a 20 inch black alloy wheel. I have attached photos of the damaged wheel that I took while I was under the lift inside Midtown Auto Repair. This damage is not repairable, its a bent wheel. Midtown Auto Repair cannot fix this, they can only replace the wheel. I did not and would not accept a repair.
************** claims that he was rendered payment by an insurance company. That is false, and that's proven with *********** being involved in this predicament as well. I was reimbursed by an insurance company for the repairs. Nobody is trying to hide the fact that I was reimbursed by insurance. Apparently, ************** thinks that because the root of the finances aren't from my paycheck and that they are from an insurance company, that he is relieved of the required duties of doing the work that was requested. I asked for a refund for the wheel that they did not put on my car. They have refused. They literally had me pick up the car saying all the work was done and I noticed they didnt replace the rim. I wanted to be refunded so I could take that money to a professional shop where they dont employ scam artists and people that specialize in committing fraud.
************** attached a copy of the credit card chargeback. What he failed to tell you was that he is fighting the credit card company as well, and they have reinstated that charge, meaning I have been charged.
I did not ask for a repair, nor has Midtown Auto Repair performed any repairs to the wheel. They are claiming they did a repair because they saw a repair done by another company on another wheel. I will attach proof of payment last year (AUGUST 2021) to ********************* for repairs of a scratched wheel, which is completely unrelated to my visit at Midtown Auto Repair. This wheel has nothing to do with the one that is in question. Also, nobody would accept a REPAIR quote for $1100 when a brand new wheel costs.. YOU GUESSED IT, $1100!!! WHAT A COINCIDENCE!!!!

I am rejecting this response because:The business most recent response proves that they have been lying the entire time. They never repaired my wheel as they stated they did in their last response. These two responses alone show that ************** is lying. I paid with a credit card, whether insurance reimbursed me or not is absolutely none of their concern. They are not police investigators. If I take the money and get my wheel replaced elsewhere, then I have satisfied the requirements of the insurance company. This is no longer about money. This is about refusing to allow a corrupt, dishonest business owner bully and take advantage of a consumer. The fact of the matter is that Midtown Auto Repair has money from my credit card, and did not perform a service and give me a product that they promised. This is called fraud.
I demand a refund as I refuse to trust my vehicle with this fraudulent, corrupt business and I will not settle for anything else. I will never allow this shop to touch my car again and I will file complaints with every authority until they refund the credit card. If **************, being the trustworthy, North Star, highly ethical type of person that he is trying to portray, wants to report me for insurance fraud after he refunds me, then he can. This isnt up to him to not refund because hes worried that Ill keep the money. I have a right as a consumer to take my business elsewhere. Im sure the attorney general, whom I have filed a complaint with, as well as ******* ********** of ******** Affairs, and not the mention the insurance company itself will also ensure the insurance funds are spent on the vehicle. I will also give the business response to those entities to show that ************** is in fact lying and this will only help my case in court, which is the next step, if ************** would like to keep the money that he stole.

Had my daughter car repaired hear to find out they didnt put a Alternator belt on the car they charge me too much money to not have put a Alternator belt on the car very unhappy will never go there again I thought he was repairing a whole car bad business I would like part of my money back paid a total of 496$Business Response
