      Tell us why here...This pertains to complaint #******** filed by ******** ****** with the Better Business Bureau. ******** ****** contracted with Exclusive Furniture for the purchase of furniture. Exclusive Furniture is an independent business that uses many different lenders for customer financing and is not contractually obligated to finance any of its business through any particular lender.

      Exclusive Furniture submitted a credit application on behalf of ******** ****** to Castle Credit on October 16, 2019, requesting a line of credit for financing. Credit was reviewed, credit was approved and Exclusive Furniture and ******** ****** were informed of the credit decision.

      A line of credit was opened in the amount of $2,800.00 and a contract was submitted on October 28, 2019 for a furniture purchase in the amount of $2,800.00,with minimum monthly payments of $150.00 beginning on December 20, 2019.

      Payments have been remitted from December 30, 2019 through May 21, 2021. Payments due on December 20 2019 through September 20, 2020 were all remitted late. The account is now paid in full and closed with a zero balance.The account is being reported appropriately to the credit bureaus. A copy of the payment history is provided.

      My name is *******************************. I previously did business with Castle Credit, at least I thought I was doing business with Castle Credit until I paid my account off in full July 2020. At that time, I disputed a late payment for May 2020. However, it was removed from TransUnion but not Experian and Equifax. A couple of weeks ago, I asked for my payment history. After reviewing it, I noticed that I made 3 payments in May (May 8, May 13, and May 22) Next, I requested my contract. The contract along with the Assignment of Contract was sent. Per the Assignment of Contract, all of the rights to my account were given to ********************** There is no documentation of Castle Credit having authority or rights to collect on my account. Plus, the contract states if I paid my account off early, I would receive a refund for some of my finance charges. I never received any refund. I am not trying to be difficult but only expressing my rights as a consumer. After submitting this information to Castle Credit, they went back and reinserted the 30 days late on TransUnion and continues to report the late payment to Equifax and Experian. I have yet to receive a response from Castle Credit after sending several emails to the Credit Department. I am requesting for this account to be removed from credit report and refund for finance charges. Thank you for your time.

On May 20, 2018, ******************************* contracted with ***** Machines for the purchase of a Rainbow Cleaning System. ***** Machines is an independent business that uses many different lenders for customer financing and is not contractually obligated to finance any of its business through any particular lender. In this case, ***** Machines accepted Castle Credits offer to purchase the contract and assigned the contract to ****************. The assets of **************** were acquired by Castle Credit on January 31, 2017. All assignments issued to **************** belong to Castle Credit.

      Under the terms of the contract in the amount of $2,948.92,monthly payments of $112.59 were to be remitted for thirty-six months on or before the 20th of each month, beginning on July 20, 2018. The sales representative listed on the contract is *********************, who was listed on the credit application as a reference and friend. A copy of the full contract is provided.

      Payments were remitted from July 20, 2018 through July 17,2020. Payments were remitted late on fifteen occasions. Payment was returned by the issuing bank on one occasion. The account was not paid off early and not entitled to a refund. The account is now paid in full and closed. A copy of the payment history is provided.

      I am rejecting this response because: Castle Credit stated that I was late on 15 occasions. Per the Account History attached, the account was accessed to 15 late fees but it does not show where I was over 30 days late on any of the months. I can only be reported to the credit reporting agency if I am over 30 days. Also, the contract Credit Castle attached does not show the Assignment of Contract that I received from them on May 13, 2022. I have attached it for your review. It shows that the rights of the contract was given to ********************* on 5/22/2018. If Castle Credit did indeed acquire the assets of ********************* on January 31, 2017, why doesn't the Assignment of Contract indicate Castle Credit as the "Assignee"? And lastly, Castle Credit stated that I had a contract agreement for 36 months that started on May 20, 2018 with payments beginning on July 20, 2018. The account was paid off on July 17, 2020. This was 24 months of payments. Therefore, the account was paid off early; 12 months early.

We submitted our response to the complaint on June 3, 2022. ******************************* rejected our response to the complaint on June 13, 2022 with a rebuttal. This is our response to the rejection/rebuttal.

      The contract states If any payment is not paid within 10 calendar days after it is due, you agree to pay a late charge. Accordingly,late fees post on the 11th calendar day after payment is due, should the minimum monthly payment not be remitted. Should payment not be received in thirty days, the account becomes past due and updated accordingly to the credit bureaus.

      Due to the acquisition of **************** on January 31,2017, any and all assignments to **************** belong to Castle Credit. That includes any and all assignments dated at any time, before or after the acquisition date. This account was opened after the acquisition and the assignment automatically belongs to Castle Credit.

      The contract states If you pay all or any part of the balance early, you may be entitled to a refund of a part of the finance charge. The contract scheduled a thirty-six month payment plan, with monthly payments of $112.59. The account was often paid late; however final payment was remitted ahead of schedule. Payments were remitted late on fifteen occasions and a check was returned by the issuing bank on one occasion. When payments are not remitted timely, the account balance and finance charge balance do not decrease timely. Late fees and retuned check fees also cause the account balance to increase, not decrease.

The representative said that I would receive an email that day or within the next few days stating exactly that. That did not happen and I am still receiving letters in the mail saying that I still owe. This is not right. My account should be paid in full. Please help!!!!

In this case, Quality Water & Air accepted Castle Credits offer to purchase the contract and assigned the contract to Castle Credit.

      Under the terms of the contract in the amount of $5,490.00,minimum monthly payments of $109.80 were to be remitted on or before the 15th of each month, beginning on March 15, 2016. Payments were remitted from March 15, 2016 through March 15, 2017. Twelve payments were remitted totaling $1,320.00. No additional payments have been received.

      We have attempted to reach ***************************** via mail, email and telephone to arrange for payment and settlement of the account. This is a valid debt which is being reported appropriately to the credit bureaus.

      My husband and I had an account with Castle Credit and we got behind on the account due to my job loss. We worked our butts off to pay this account off and was promised a pay to delete from this company. We were told if we paid the majority of the balance, all negative reporting would be removed from our credit reports. Currently, we are trying to refinance our home and Castle Credit has this account on my credit as paid in full. We went through a whole lot to get this paid, and Castle Credit did not honor what they promised. I called them in hopes that speaking to them and explaining the situation, they would delete it from our credit reports and now they claim that is not something they can do. And reading the complaints others have filed on them Im not the only one complaining about the false information they have provided.

In this case, Aqua ********* Systems accepted Prime Acceptances offer to purchase the contract and assigned the contract to Prime Acceptance.

      Under the terms of the contract in the amount of $5,350.00,minimum monthly payments of $107.00 were to be remitted on or before the 5th of each month, beginning on November 5, 2016. The assets of Prime Acceptance were acquired by Castle Credit on January 31, 2017. Payments were remitted from November of 2016 through February of 2018 only. From 2018-2021, we attempted to reach the Avilas via mail, email and telephone to arrange for payment and settlement of the account.

      After nearly three years of no payments or contact, the Avilas paid the balance on March 17, 2021 with a credit card payment by telephone. The account was then placed on hold for thirty days to allow sufficient time for payment to clear. Once thirty days had passed, we updated the account to paid in full and closed with a zero balance. We emailed a letter to the email address on file for ******************* on April 27, 2021 to confirm that the account was paid in full. A copy of the letter is provided.

      At the time of payment, the Avilas were advised their account would be reported paid in full, which it was; there was not a promise to alter or delete their account because credit reporting cannot be altered or deleted at a customers request. The Avilas account was reported appropriately and accurately to the credit bureaus.

      I am rejecting this response because: I did ask for a pay to delete and was told after 45 days it would be done. Also, I did contact the credit bureaus as well to file an appeal and have it deleted  on mine and my husbands credit. They denied the claim but when I called and spoke over the phone with the credit bureaus to get more information on the denial they informed me that,  this information can be deleted from our credit reports. But, because I was under the impression we were paying this account off to delete they did I advise I contact your company which I did  and ask for them to submit that request in writing. Only to find out that wasnt the case. My error was not getting this in writing from your company but your error is not training your customer reps properly because I know I discussed this with you all, otherwise I wouldnt be filing a complaint against your dishonesty and lack of information. and considering that we did pay this account off and settled you should honor the pay to delete. Because it can be done,  your company just refuses to do so. Not to mention I did my homework and also read that several other people who settled their accounts with castle credit were offered pay to delete and your company did not follow through on this matter. All Im asking is that you do us the right thing and have this deleted from our credit reports. .

All calls are recorded for quality assurance. We have reviewed the recordings of the phone calls made by *********************** on March 17,2021. She spoke to two of our representatives three times on that date. She was informed that the credit reports for both her and her husband ******************* would be updated to paid in full, not settled in full. *********************** stated that she was not concerned about the credit reports but only concerned about debt settlement. The Avilas account was reported appropriately and accurately to the credit bureaus.

Not just the 1 date you claim the call is recorded.  I will be looking into other measures to resolve this on my husbands & my credit report if you dont have this removed.

      ************** Systems submitted a credit application on behalf of ******************************* and ***************************** to Castle Credit on July 3, 2013 requesting financing. Credit was reviewed, approved and ************** Systems,******************************* and ***************************** received notification of the credit decision.

      A contract was submitted and the account was opened on July 15,2013. Under the terms of the contract in the amount of $3,491.30, minimum monthly payments of $96.03 were to be remitted on or before the 2nd of each month,beginning on October 2, 2013. Payments were remitted on October 28, 2013 and November 22, 2013. Payments remitted in January of 2014 and February of 2014 were returned by the issuing bank. No further payments have been remitted to date.

      This is a valid debt owed by ******************************* and *****************************. Copies of the contract and account history are provided. We encourage the Galloways to contact us regarding payment and settlement of their account.

      I called Castle Credit and ask if they would accept an agree amount for my account to be paid in full. They did accept the offer of $1,796.00. Which I paid in December I got a call from them stating I was past due. I called them and stated this should be settled and they agreed said it would take 20 days. Which would be January 20th I just received another statement in the mail stating I am past due of $463.00 this should be settled and I am tired of going back and forth and want this off my credit.

      Sign a contract with Castle credit paying equal payments for 24 months interfere. Every month, despite the agreed amout loaned, divided by 24, interest still showed on the account. We paid off the balance to refinance our home. All I need is a statement saying it is paid in full and account is closed, but they say they can not do this until 30 days after last payment. This is the ONLY thing hovering that is keeping me from closing on my home refinance. I am at risk for a high mortgage interest rate because of how shady castle credit is. Why do important? It shows up on my credit line as a lien against my home!!! I just purchased new windows!

      ************************ submitted a credit application on behalf of ******************* and ************************* to Castle Credit on May 29, 2020 requesting financing. Credit was reviewed, approved and ************************ received notification of the credit decision.

      A contract was submitted and the account was opened on June 18,2020. Under the terms of the contract in the amount of $6,639.00, minimum monthly payments of $132.78 were to be remitted on or before the 18th of each month, beginning on July 18, 2020. The contract also provided a *************************************** effect through June 18, 2022. Payments were remitted from July 15, 2020 through January 13, 2022, completing the terms of the deferred interest promotion.

      The account was placed on hold for thirty days to allow sufficient time for final payment to clear. On February 14, 2022, the account is scheduled to be updated to paid in full and closed with a zero balance.       This was towards the purchase of a water softener.I was not informed that this was a secured home improvement loan it was sold to me as a line of credit like a credit card. Now there is a lien on my home and the interest has doubled my balance. The company that sold it to me doesnt even exist they went out of business so all warranties are null and void aling with other things they offered like free soap for a year. I am highly upset about this as i feel they committed fraud and didnt provide me with the correct info regarding this purchase and loan.

Castle Credit provided the financing for the purchase.

      The account was opened on July 26, 2018 in the amount of $8,590.00 with minimum monthly payments of $171.80. The first payment was due on October 17, 2018. Two payments were remitted on October 12, 2018 and November 13, 2018 totaling $176.80. No additional payments have been received to date. Copies of the contract and account history are provided.

      The manufacturer, Aqua Perfect can be contacted for warranty and service information. Any offers of free products or services are not part of the financing contract.

      Payment plan and settlement offers have been emailed to *********************************** and mailed to the ******** residence numerous times, however we have not received any reply. We encourage *********************************** and ***************************** to contact us regarding payment arrangements and settlement of their account.
