The law firm took out their fees without disclosing at the beginning of agreement. I get a 1099 owing for their portion of taxes, meaning that they are not paying any tax on my case and I am this was never told to me.Business Response
Date: 02/12/2025
We appreciate the opportunity to address this clients concerns. When the client retained our firm to pursue her claims, she signed a retention agreement that explained our fees in detail. However, when this claim reached settlement, we significantly discounted our fee so that our client could put more money in her pocket. The exact breakdown of our fees, the costs, and the net amount to the client was disclosed to the client in the settlement release she signed. Under the law, the settlement administrator is required to issue a 1099 with the gross settlement amount, before the deduction of costs and fees. Keller Postman pays taxes in accordance with the law. We are not a tax firm, and we encourage our clients to discuss their potential tax liability with a tax professional.Initial Complaint

They took me on as a client for the Pandora ****** At first everything was going good, then they blocked me or changed their e-mail address. I can no longer contact them or update my information. I am told they also got my phone out. I'm not sure what that fully means, but as I was scrolling through my history you can see what they were interested in. The same names kept coming up regularly. Ca. State lottery along with some other organizations. My phone was in possession of the local ***************** and I think they may have handed it over to Keller and Postman. I never received my settlement amount to my bank account, I put in a complaint and waited and never heard back from anyone, I then received a email saying that my inquiry was being closed but the money was never sent to my bank account.Business Response

Our records show that ************ retained our firm to pursue an individual consumer fraud arbitration against ********. We successfully resolved her claim, and according to the settlement administrator, her settlement payment was deposited by ACH direct deposit on September 1, 2022, into the bank account she designated.
Ms. ********* reached out to us in 2023 to obtain details about her settlement payment. We requested that the settlement administrator conduct an ACH trace of the deposit, and we provided that information to Ms. ********* on May 18, 2023. She has not contacted our firm since then, and we concluded our representation of her.
It appears that the document she attached to the complaint pertains to a separate settlement between Intuit and state Attorney Generals and is unrelated to our representation of Ms. ********** Ms. ********* will need to contact the appropriate party for information about that settlement payment.Initial Complaint

I am a retired lawyer but I am not yet (& I hope never) seeking anything from Keller Postman (KP) as to my interest in the Zantac matter. But I need a lawyer "case manager" to call me promptly. KP recently advised of imminent settlement & the need to act quickly if contacted. Yesterday, a robocall from KP advised that I could "not be included" in the settlement as there was no record of the dates of my treatment. They needed that "immediately." For info, I had provided KP with the date of my cancer diagnosis, ************* numbers of all involved, details as to treatment, etc. I could have supplied that info again but the robocall abruptly ended.I called back immediately. A message informed there were "5 or more calls". I could & did elect to get a call back. But I waited all day with no return call. Today, I started all over & got a call back within 75 minutes I discovered I was talking to someone in a phone bank. She was courteous & sufficiently English fluent to get the job done. She determined that she already had the info but wanted spec documentation for procedures. I never had any of that & KP had advised that the addresses, names & full contact info of the providers was all they needed from me.When I told the phone bank person of that, she appeared to understand, apologized for KP not having long since contacted ***************************************** & said she would "take care of it." I advised that *************** is retiring "imminently" & supplied the name of the "practice manager" as an alternative. I also confirmed the phone number for ********************** & supplied a specific number for the ************* and *********************.I was assured that a "case manager" (a lawyer) would call TODAY. It is now almost 5:30 and I have not received a call but, about an hour ago the phone rang & indicated it was from KP but it rang only once, the line was dead.I am going to dinner.********************* (I had to cut many characters out, excuse any typos, etc.)Business Response

We spoke with ************ and offered an apology for any stress caused by the dialers or communications. We assured him that we received necessary documentation but are in the process of ordering medical records from his providers to confirm a cancer diagnosis date, which is needed for participation in the settlement program and why we reached out to him. We confirmed that we have his providers information and records are being ordered. The conversation concluded on a positive note, with ************ expressing gratitude for the time and attention provided.
