I hired the law firm back in July 2023 and have had nothing but problems. I was injured at work on June 2 2023. I had major back and hip problems after the fall and started a ********* comp case with the law firm. 4 months later I was sent to a second doctor through the insurance company called ************** The checkup on me was done before I had my MRI scheduled. So there doctore had no information to go and and submitted his finding that I was find based on nothing. My main finally happened 4 weeks later with multiple confusions and other issues related to my injury and this MRI was 5 months after the fall, thats how bad it was for me. My attorney *********************** did nothing. She said it was formal. How is an Injury formal. So my insurance got cut my physical therapy stopped and my doctor would not sign a paper saying I'm good to go back to work, cause I was not. Again she or the law firm did nothing. I am now homeless and my job will not take me back without that letter and the law firm still has done nothing. The case is still active waiting on settlement but they don't answer or return calls. I even talked to owner and he said he would contact me in a couple days and never did. Again I am now homeless following the guidance of this law firm and they won't answer or call back. Please help me.

      Mr. ***********************,
Thank you for sharing your concerns. At The Illinois Hammer Injury Law Firm, we take every clients complaint seriously and strive to address any issues promptly.
Throughout your case, we made every effort to keep you regularly informed about the developments. Unfortunately, there were several instances where we experienced gaps in communication from you. Despite our attempts to reach out, you did not respond, which sometimes led to the absence of vital information on your case.
Regarding your medical treatment, we want to clarify a few points:

Medical Treatment Timeline: You visited the ** twice before receiving treatment from AMCI. An MRI was recommended at the end of September and was conducted within a week, contrary to the claim that there was a five-month delay.

TTD Payments: You received Temporary Total Disability (TTD) payments until your off-work slips expired, and you were released to full duty on three separate occasions. AMCI kept you off work from August 20 to September 27, and there were no further extensions from them. Any additional time off work was not supported by medical restrictions from any physician.

Communication and Information: There were discrepancies between the information you provided to us and what was reflected in your medical records. This inconsistency impacted the perception of your case during the pre-trial, as noted by the arbitrator who ultimately recommended a settlement, which you accepted.

Our goal is to ensure every client feels heard and supported throughout their case. We believe we delivered the best representation possible and helped secure a favorable settlement on your behalf.

If you would like to discuss this matter further, please do not hesitate to reach out to us directly. We've also attached notation of **************** case.

      Thank you,
The Illinois Hammer Injury Law Firm team

Received a settlement contract, requiring my signature for my attorney ******* Maciariello upon reviewing contract became aware of several or multiple false statements that they are requiring me to sign as a settlement agreement my signature on this type of settlement that I would be committing several other chargeable offenses according to the law fraud and several falsifications of documents that I have signed which is untrue. An addition incorrect information in reference to said accident that I reported and receive ********* conversation for an approved and accepted accident/ injured on duty.

The allegations in the complaint submitted by ************** are baseless. We have addressed the statements he may have perceived as false via email on 10/12/2023 from his attorney, ******* Maciariello. Attorney ******* Maciariello also sent a follow up email on 1/2/2024 asking ************** to explain what statements he believed were false so they could be addressed and explained, but ************** did not respond. We've attached the two emails ******* Maciariello sent to **************, as well as his settlement contract to support our assessment that this compliant is inaccurate.

Seriously the WORST firm to deal with unless your case is upwards of 1M+I cannot get ANOBODY to call me back, like 1 out of every 10-20 emails gets a vague, information less response. They clearly do NOT know how to write up court documents as my lawyer told me in JULY that my offer was being submitted to the judge for approval. I couldnt get a hold of anyone until October for status, at which time I was informed it was rejected by the judge and here we are almost mid January and again little to no contact and the offer STILL has not be resubmitted. I hate working with this firm. I just want this resolved.

**************** hired us in September 2021. When he was finished treating we made a demand to settle his case. We negotiated the case and always kept **************** aware of the offers we received in December and January 2022. We finally came to an agreement in February 2022 with a release and resignation. However, **************** had given us the wrong employer originally as he was a borrowed employee. So we had to amend our application and re-draft the release and resignation then draft corrected settlement contracts.  This was completed at the end of April 2022.  In early May **************** had signed the release and resignation documents. When the waiting period passed we sent him the settlement contracts. He signed them on 5/20/22. They were submitted to the Arbitrator this week for approval. Today is 5/2722. We are waiting for the contracts to be approved by the Arbitrator.  **************** has been sent the below email outlining the exact process that the contracts would take from acceptance to approval and finally to payment.

      Subject: Settlement Time Frame
      Dear Mr. Capers,

Now that youve accepted your settlement offer, please read the steps below to help you understand what happens next. Be sure, we will make every effort to make this happen as fast as possible.

      Settlement Process:
      1. The attorneys and the insurance company will draw up and agree to written terms for the settlement contract. This process usually takes approximately 14 days.
      2. Next, a copy of the settlement contract will be emailed to you. You will be able to access the contracts and sign them electronically. We will also notify you via text message once the documents have been sent for your signature, and we will get notified when you have completed signing.
      3. We will then submit the contracts to your Judge/Arbitrator for approval once you have signed the contracts. This process *** take approximately 14 days.
      4. Once the Arbitrator approves, the insurance company has 30 days to mail a settlement check to our office.
      5. When received, your check is processed through an escrow/trust account to safely and securely separate your funds from our funds. This takes approximately seven days.
      6. We will contact you as soon as the check is received and available for you.

You *** contact your case manager, ***********************************, with any questions or concerns during this time by email at *****************************************.

The entire process will take approximately eight weeks. Issues *** arise that *** delay this process. However, these issues are rare. We will contact you as soon as your settlement check is ready. At that time, you *** either pick up the check at our office or have it mailed to you.

We thank you for placing your trust with Dworkin & Maciariello and allowing us to represent you in this matter.

      Sincerely,

I have re-sent this email to him today showing him that we are on step #3. I have also called and emailed him today with an update. We have no missed calls from ****************. His emails are answered in a timely fashion and he knows the exact status of his claim.
