      I seek reimbursement. 6/11/23, contractors were paid $8,000. 6/13/23, contractors stated check would not cash, after it was already deposited it. Required another $8,000 check. Said he would put a hold on the check at his bank. He did not. He cashed both checks. Had $16,000 in his account. We put a stop on the first check, but it had already deposited. The job was to start on 6/21/23. Contractor didn't show 1st day. Claimed it was due to supplies being cancelled. 1st day was to be demo. Showed 2nd day, worked for 3 hrs. Did not have supplies to clean up demo, used ours (against the contract). Contractor was not capable to carryout demo on their own, needed our help to carry materials to dumpster. *** ****** ** *** told us he fired Reclaimed Soul from the job. Reclaimed Soul only showed 2 days. Never saw or heard from them again. Everyday work arrival time was promised, but time was not kept. Excuses were given for being late & not showing. Minimal work was completed on bathroom. Materials were to be completely purchased& obtained by them as stated in the contract, but there was always an issue that caused a delay in work. No work on weekends, days were taken off by contractor for holiday. Claimed that issue was my family in the way & because Reclaimed Soul was to do the work. His worker stated that *** ****** ** was completing a different job. When we signed the contract, the promise was that he would be doing the work and it would be completed in a timely fashion. By 6/6/23, *** ****** ** refused to work at the house claiming that my family was not allowing him to do the work. There was no work completed. As of 6/6/23. I still no bathroom in my home. I requested on 6/6/23 he could get his tools & bring receipts, a list of time worked, & reimbursement check. He did not bring that. He came for tools. We met on 6/9/23 at a neutral place & didn't bring receipts/hrs worked. Said spent $10k on supplies & needs to contact an attorney. Reclaimed Soul is on contract.

      ********* ******* **** called BBB to inform us that she has received several phone calls from **** from Reclaimed Soul. The business called Ms. ******* **** once from her phone number, and nine times from a private phone number. Complainant also stated that the business called the complainant's parents multiple times. The business also sent an email to the complainant. These communications were to inform the complainant of the business's intention to sue the complainant for slander and liable. -- 7/19/23 ****

      On June 2, 2023 I was asked by Mr. ****** of *** ****** ** *** to help him with a bathroom remodeling project. He asked my assistance in meeting the client, creating a scope of work, creating an estimate of time and materials, and creating the contract. I was also to perform the construction duties on this project. After the contract meeting I was not in communication with the client until after I showed up to work on June 22, 2023 at 8am. 

      On June 11th, I met with Mr. ****** and Mrs. **** to review the contract and receive a check for materials. Mr. ****** insisted the check be written out to him and it was. He was responsible for all the financial aspects of this project. The contract was signed and work was agreed to start on June 21st, 2023

      Mr ****** stated on June 12th that he was having trouble with his financial institution and we were not able to order any materials for 4 days. The major items were ordered from **** ***** and they cancelled the order without notice or explanation the Sunday before we were to start work. The items were ordered again and they were cancelled by **** ***** again. Due to not having materials Mr. ****** stated that we would not start working until the 22nd. 

      I did show up to perform demo and was told that the mother of the client had already done some of the demo work. the mother of the client was not pleasant about learning that I was not told. I made a comment to her husband that she is upset and he said she would “punch me in the face”. It was not communicated to me by Mr. ****** that demo had been done but I went ahead under threat of physical harm and performed more demolition duties, using my tools and supplies, but I was not fully prepared to haul debris because I was expecting Mr. ****** to bring certain items that we needed like garbage cans, shovel, sledgehammer etc. He did not show up to the site until almost 930am. The clients mother and father were present, and took upon themselves to carry out bags of debris I had set to the side, while waiting on my coworkers, and take items to the dumpster. They were not asked or expected to help. 

      I came again on the second day, Friday the 23, 2023. Mr ****** did not arrive until later in the morning. The clients mother and father were present again and again wanted to be hands on in trying to demo, and carry things. I said to the elderly mother “I am not trying to be mean, but you have to say out of the way”, it’s dangerous for her to be in there and obstructive to the work process. I worked until there was no work to do as Mr ****** still had not provided even the basic materials. 

      That evening Mr. ****** called me and stated that when I got back to the job I am not to speak to the mother at all because she said I was rude for asking her to stay out of the way.  

      On Monday June 26th, 2023 I asked if we were going to the job site and Mr ****** said no he needed supplies still. I spent all of Monday at ***** getting supplies ordered, and purchasing items for the job. Mr ****** joined me at one point and we went to 2 stores looking for supplies. He was in contact with the client and sending her pictures of what we had picked out. After shopping was done, Mr. ****** stated that he has a meeting with the client that evening and I am not invited to attend. After that meeting he called me saying I was not allowed to return to the job, because the mother of the client didn’t want me there. I asked Mr. ****** to have the client sign a release for me so I could be released form the job and he stated the client would contact me by email. I also asked Mr ****** for a release but also has not provided one. He also stated in that phone call that his worker ***** would not be allowed back to work, but that was untrue as the documentation provided by the client in this complaint show he was allowed to return. 

      I have not been back to the job site since the 2nd day. I still have no clear reason why I was not allowed to return.  I was never in charge of the financials related to this project. Other than the two days I did demo, one day getting materials and all the background work before the contact was signed, I have no hand in any delays, or not getting any work done. I have not been paid by Mr ****** for what work I have done.

       I am rejecting this response because: The facts given are not correct. I would like to see receipts for all items purchased. Ms. ****** states she was not in charge of financials, yet she states purchased items for the project. Purchasing items for the project would be apart of the project's budget. 
       

      I have attached the following statement below, as well as the email, and threatening voicemail communication from Ms. ******.

      When I was introduced to Ms. ****** by Mr. ******, he said that she works for me. It was my understanding that when Ms. ****** came to the house and helped Mr. ****** with measurements of my bathroom that it was for design aspects. I had only communicated via email and text with Mr. ****** what I was interested in doing and throughout the project, and only communicated with him. He had told me Ms. ****** helps him with designing. He did not communicate that she would be doing the work on the job. 

      When Ms. ****** came to my house to sign the contract, I was not communicated with that she would be doing the construction on the house. It was still my understanding that Mr. ****** would be doing all the work. 

      The project was supposed to start at 8:00 a.m. on June 21, 2023. I was not communicated with until the morning of June 21, 2023, after 9:00 that no one would be arriving. To make sure that the project moved along, it was communicated to Mr. ****** that demolition would be started by my family. Mr. ****** was very adamant that time be kept on the project and there was a tight schedule. We ordered the dumpster and purchased the vanity and had to make sure we had both acquired by the June 21, 2023, start date. Pictures of the demo were sent to Mr. ******. He was aware of what had been taken down by my family. 

      My family was at the house because I was at work. Someone needed to be in the home during the time anyone was working.

      Ms. ****** worked on June 22, 2023, for three and a half hours. The only tool/supply that Ms. ****** brought with her was a crowbar/pinch bar. She borrowed, and did not return, a pair of work gloves from my mother. 

      **I would like to make a point that during the contract meeting, my family had offered to purchase supplies (tile, shower pieces, drywall etc.) and do demolition to make job happen more quickly.  We were assured that they were the professionals that would take care of and bring everything. Ms. ****** and Mr. ****** stated that they wouldn’t want anything purchased that would be incorrect for the project. Ms. ****** even told me that they would cover things in my kitchen with plastic to keep things clean. That did not happen. 

      My family removed the bags of debris and helped carry the larger pieces of the vanity because Ms. ****** was not able to carry that to the dumpster on her own. My family was worried about the lack of concern for the water line hooked to the refrigerator coming through from the basement and anything that could possibly scuff/scratch the linoleum in the kitchen. They also wanted to make sure that the site was kept cleaned. There was very old insulation in the house that was being removed, it was best that it is removed as much as possible because we do have pets in the home. Mr. ******, Ms. ******, nor ***** brought a shop vac with them to clean up after themselves.  Ms. ****** stated to my family, “You people stay out of my way, so I can work.” With that statement, my family went outside. 

      When the vanity was put into the dumpster, part of the vanity caught Ms. ******’s shirt and made a rip in it. She made a comment in front of both of my parents that “it almost ripped her titty off.” 

      My father was trying to repair a part of the outside porch railing that was loose, and Ms. ****** said to him, “I’ll just kick it with my steel toed boots.” He asked her not to kick it, that he was trying to tighten and repair it. 

      Mr. ****** and ***** arrived on June 22, 2023, for an hour and a half. They brought minimal supplies for demolition and ***** brought his toolbox to drop off. They did not have a trash can, shovel, sledgehammer, or ladder. My father went home to get his sledgehammer for further demolition.  

      While my mother may have been upset with the lack of communication from Mr. ******, the lack of preparedness of a construction team that we paid money to and knowing that we had dumpster that we had only so many days to fill up for the demo before it would be removed, she is not a violent person. My father never said that my mother would physically hit Ms. ****** and would testify to that. Ms. ****** told me and my family on more than one occasion that she is a former military member and about her military experience. She is more than six inches taller than my seventy-four-year-old mother (who she describes as elderly). The fact that she states she felt threatened by an “elderly” woman is absurd. Ms. ****** later communicated to me on June 23, 2023, when I showed up after work, that she needed to “apologize to my mother for yesterday because she was menstrual.” 

      On June 23, 2023, Ms. ****** and ***** worked from 8 am to 12 p.m. and the toilet was removed. The toilet was left sitting in the middle of the bathroom with water still in the bowl and tank. The water had been turned off the water to my house and it was not turned back on until the following Monday. No work was completed over the weekend. 

      ***** worked at my house on June 26, 2023. The cast iron bathtub needed removed and my family helped in the removal because he could not lift and carry the bathtub by himself. No one complained when the extra hands were there to help. 

      Mr. ****** texted me on 6/26 at 11:39 a.m. and said he was having difficulty locating materials. He said that he would text me pictures periodically to see what I liked. He immediately sent me a picture of a shower and faucet that looked like he was in a store. Later at 4:21 p.m. I got a text of a picture that was a screenshot of tile from online store. I confirmed that was ok. 

      Mr. ****** came to pick up ***** from working and spoke to my mother and me, in person, on June 30, 2023, in person and stated that he fired Ms. ****** from the job. He explained that she was “trying to take jobs out from under him.” He stated that, she “wasn’t insured and was working under his insurance.” 

      We did not hear about his concern for Ms. ****** from Mr. ****** until we met with him on July 9, 2023, when he stated that he would need to consult an attorney because **** was on the contract. 

      On July 18, 2023, Ms. ****** called my phone numerous times and left me a voicemail message stating that she would sue me for libel and slander for filing with the Better Business Bureau because it was ruining the reputation that she had worked to establish. Ms. ****** then called my family. My mother asked her for the receipts for purchases. Ms. ****** stated that she would not give any receipts unless she was “released her from the contract and took away the complaint from the Better Business Bureau.” My mother hung up on Ms. ******. Ms. ****** immediately called my family back, and my father answered the phone and then again hung up on her. 

      That same day, Ms. ****** sent an email to me outlining her issue and that if I wanted to handle this “like an adult,” that I should communicate with her. I responded to her stating that the Better Business Bureau was an unbiased third party that we could communicate through and that she could also contact my lawyer and I gave her my lawyer’s contact information. I asked her not to call to threaten/harass me or my family anymore.

      My father answered the house phone today, June 24, 2023 at 1:53 p.m. It was **** ****** asking to speak to my mother ****. My father told her that she was busy and hung up the phone. 

       

      In an email regarding this case (that is among the files saved to the case), I have asked **** not to call me, or my family and I have given her the BBB information and the name of my attorney. 

       

      I would like this to be documented that she is continuing to harass my family.

      I believe this family has hired an attorney and I am willing to do all that I can to appease them. I did not have financial control, I ordered items and paid for them with Mr. ******s bank card. All receipts were sent to him, I have no copy of them. He picked up all items that were ordered by me but paid for by him.

      I was released under different circumstances than what they describe.  I was told by him that the client would email me and I see the message where they were sent my email but never contacted me. 

      This complaint needs to be directed to Mr ****** of *** ****** ** ***. 

      He states he still has not had a BBB complaint filed against him, but the clients attorney has sent letters to my home addressed to him so I doubt they even have a way to contact him beyond the phone. 

      I was released from the job and have had no further dealing with him or the client. I did call numerous times and finally leFt an unthreatening message on her voicemail asking for a release from the job and a reason as I was advised to do by an attorney. Then she blocked my number so I did leave a email message stating that we could discuss things like and adult when I received the first complaint. 

      I did speak to her mother to try and get an idea as to what really happened to cause me to be let go because to this day I am only getting one side of the story. Even in the original complaint they didn’t state any of these things and now I am appalled that they can create a bigger story further demeaning my reputation.

       I am rejecting this response because: it is not accurate. Ms. ****** has had my attorney's information since July 19, 2023. If she was so willing to cooperate, she could have EASILY communicated with him. 


      Ms. ****** you KNOW that I have hired an attorney. You were given the attorney’s name and information in the direct email response that you received from me on July 19, 2023. If you are so willing to cooperate, here is his contact information again:

      There was no reason for me to contact Ms. ****** because Mr. ****** told my mother and I that he fired Ms. ****** from the job. I did not need to communicate that to her. She was not my employee. 


      Mr. ******, of *** ****** **, LLC, also received the exact complaint sent to him through the BBB. If he told you he didn’t, he has lied to your face. He chose not to respond to the BBB complaint. However, he referred to the complaint made towards his business in a text conversation on July 14, 2023, which has been uploaded to this portal. In the same conversation, when I explained that he had to be licensed to do plumbing work in the state of Illinois, he lied and stated that he did not do any plumbing work and then stated he would have someone sign off on his plumbing work. 

      So, you are more aware of the full spectrum of the construction business Ms. ******, doing plumbing work without a license in the state of Illinois is against the Illinois Plumbing License Law (225 ILCS 320). This carries a hefty fine from the Illinois Department of Public Health. All plumbing work in the state of Illinois needs to be completed by a licensed plumber, of which Mr. ****** is not. Mr. ****** told me he does not operate as a plumber, and in the same conversation he said he would have someone “sign off” on his work. No one can do any plumbing work whatsoever without a license in our state. No one can sign off on work, either. This information can be found by looking up environmental law from the Illinois Department of Public Health. Mr. ******’s business card clearly states general plumbing. He also shares reviews on his website, and you can find reviews of his plumbing work on Facebook. Also, if you plan to do any electrical work for projects, you must register within the municipalities where the work will be completed. Mr. ****** did do electrical work in my home.  He is not registered in Edinburg, Decatur, or Cerro Gordo, Illinois. These are communities where my home is, where much of his client base seems to come from based on his online content, and the municipality that his LLC is registered. 

      If you received letters to Mr. ****** from my attorney at your address, you have directly had the information for the attorney to call or communicate with him. If you were so worried about your reputation, you could have shown some good character and made sure to deliver whatever communication to Mr. ******.  You mention that you are willing to communicate with my attorney, why didn’t you call the attorney and share your knowledge?

      Ms. ******, I did block you from calling my phone. However, I only blocked you after I was threatened. You were still able to leave voicemails, if necessary. However, you tell an untruth in your statement, Ms. ******. You left a message on my voice mail stating you were coming to my house with a letter from your attorney. I have uploaded the text file to this platform. YOU made a threatening statement towards me and my family. To my knowledge, you were fired and disgruntled. You threated me that you were COMING TO MY HOME. You had no reason to come to my home after being fired by Mr. ******. From what you told my family about yourself when we met, Ms. ******, was that you were ex-military. I had no idea what you were capable of doing as someone who is disgruntled. If you had a letter to deliver from your attorney, you could have easily used the ****** ****** ****** ******. If you were working with an attorney, it’s difficult to believe that the attorney’s office would put you in the situation to drive to my home and they would not have just mailed the letter on your behalf.  If you are fired from a job, you don’t call and threaten that you’re coming over. At that point, I had no idea what could happen, The ********* ****** Sheriff’s Office was made aware of my situation and to watch my country neighborhood.

      Your previous communication on this portal states that you have communicated to Mr. ******. Communication is “dealing with him.” While you may have not had other business opportunities with him, you seem to have communicated frequently with him about this issue. 

      I want to make this very clear; I am not demeaning your reputation. This is not a “bigger story.” You are the company you keep, Ms. ******. You decided to partner in business with Mr. ******, a person convicted of misdemeanors and felonies in Macon County, Illinois (easily found on the Macon County Court search as public documents). You were completely aware of the plans for plumbing and electrical in my home, as you have stated you purchased the items that would be used on the project. Working with someone who has been convicted as a felon, is not licensed, and clearly breaking Illinois state law, would not be me damaging your reputation, whatsoever. 

      My family is out of $16,000. If you want to uphold any sort of character, knowing full well from your descriptions of Mr. ******’s erratic spending behavior in prior communication on this portal, that money was stolen from my family. Your name was on the same contract right along with his, Ms. ******. You know that items were purchased because you purchased them online. Your name is on the three orders/receipts that Mr. ****** shared in texts with my mother, not his. You are/were his business partner. If you are so worried about a reputation, I suggest you fulfill your first statement, “I am willing to do all that I can to appease them.” That is what someone with integrity would do. My attorney’s information is listed in the first paragraph… and the email you received on July 19, 2023.
