      September 19th ****************************** publicly via social media (********) through a post that had information that I was in debt. Also information on my most recent payment.

      Good Morning,

      Upon researching Ms. ****** complaint, no personal data was posted. What was posted was for people that know Ms. ****** to have her contact us as she is more than 37 days late on a payment. Her last payment was made on 7/26/2024. Ms. ****** is due from 8/13/24. (see attachment) We've made numerous attempts to contact us directly but Ms. ****** fails to respond. Ms. ****** did respond personally to the post where our employees replied with a statement of how many days late she is. Ms. ****** currently owes $749.75 on her stove contact but I'll give her a one time courtesy payoff of $300. Payment would have to be made through myself at ************************************************************************ If Ms. ****** would prefer to return the stove, we can pick it up today. 

      Bert's Rentals and Sales believe this claim is unwarranted and is a retaliation for potential embarrassment. Our contact follows guidelines set forth by the State of Illinois and Ms. ****** is unfortunately committing a felony class 4 retail theft.  We've tried to give her the benefit of the doubt by not filing against her with the ****************************** because Ms. ****** truly is a great customer that may have fallen on difficult times. Ms. ******, please help us help you. We appreciate your business and hope you either return the merchandise or schedule a pick up.

      I have reviewed the business' response and am rejecting it because:


      A creditor publicly posting information about a debt owed is generally considered a violation of the law, specifically the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from publicly disclosing details about a person's debt, including their name, the amount owed, or any other identifying information that could be considered "public shaming."

      The FDCPA clearly states that debt collectors cannot publicly reveal information about a debt owed, including on social media or through other means that could be seen by a large audience.

      Afternoon,

      On the ************** we used your picture and asked if anyone has seen you. If they had, we requested them to have you contact us.  No personal data was disclosed nor amount due. Our employee responded to you with how many days past due you were after you posted on our ******** post. No public shaming occurred. It's a shame we're going through all this when you could just return the stolen merchandise. Playing the victim card is not right in this situation when you're committing retail theft.  FYI, we've called and messaged you for payment privately for 38 days in a row. Please return our stolen merchandise.

      My son and I purchased a refrigerator from Berts. We assumed it was new. So they delivered it and it is missing a bottom shelf over the crispers. My son went to get it and they told him we bought it as is. They never mentioned they we would be getting a floor model. So we need the bottom shelf. Can you please help?.

      Good Morning, 

      The customer purchased a used as is refrigerator from ****'s on 2/20/2024. The customer came in and took photos and agreed that was the refrigerator for them. ****'s delivered the refrigerator and the customer signed for the delivery. Typically if a product is damaged or missing items, we require it to be noted on the delivery ticket and we address the customers concern ASAP. If the customer feels we have wronged them in anyway, that is not our intention. Would it satisfy the customer if we purchase the said missing shelf for them? If that ok, please email us a photo of the missing piece and we will get you the piece! (***********************************************************************)
