    I hired Kielhorn's Tree Service, owner ***************************** (DK), to trim and clear 3 property lines in preparation of a planned fence installation. DK had made a verbal commitment to install the fence, following the tree trimming, as well as pour concrete, add gravel to drive, repair shed, build outdoor pond, install outdoor lighting, build outdoor animal shelter and install underground drainange around the house. The fence was an urgent need as I had 6 dogs with no fenced yard. I was thrilled to hire someone so multi-skilled; even referred to him as an angel to others including his family members. DK told me the tree servicing would be scheduled within the next couple of weeks, would take one day @ 6-8 hours, at a verbally quoted price of $1,500.00, to which I agreed. I patiently waited near 6 months for DK to schedule my tree trimming. My dogs suffered greatly, while waiting, as southern temperatures soared to 99 degrees inside my house. Thrilled to finally be scheduled for tree trimming, my heart sank as I witnessed DK order one man to perform all the high bucket work, in no time noticeablly exhausted, while denying this same worker his OSHA-mandated rights to take breaks and lunch. In the meantime ** spent much time on his phone and socialized with buddies who dropped by, one even bringing a child. Now a second day was scheduled at an upcharge of $1,000.00, the same worker assigned to the bucket, exhausted and again denied his OSHA rights. DK in a hurry to leave, I informed him the work was not complete and asked he finish at time of fence install. I believed I had to comply in order to assure the other agreed jobs completed especially the fence of which I was desperate. DK, however, never returned for the fence install. I called him at which time he agreed to refund me the $1,000.00 upcharge. I gave him the option to keep the upcharge, just finish the tree trimming, because my now-installed fence was in harm's way of falling limbs. DK then hung up on me.
