      When I moved in, the landlord methodically went through the move in check list, omitting significant defects with the property. most importantly, the electrical system current surges which fry electronics and throw off electric shocks. That said, the apartment has electric heat. Now the landlord is willing to terminate the lease but will not return my security deposit in advance. Problem: is the move-in check list was not accurate. In possible solutions, as a property company they could accommodate me by moving me into another location for the duration of the existing lease. If they intend to act honorably, this would be what is best for the community. The very last page of the lease is the move-in check list of defects, which does not mention the electrical problems. Note: I am a 66 year-old disabled veteran.

      Mr. ******** first brought the issue to our attention a few months back.   We sent our maintenance staff to the unit and could not get it to replicate his complaints and noticed his lights not working due to the bulbs being burnt out and informed him they needed changed to make them work. He was not happy that maintenance could not get the problem to replicate. I did not hear anything else from the client.  In May our area had some storms and this property sustained damage. Due to this storm damage we had the electrical panel on the building replaced by ***** Electric.  They checked all electric for the property and made sure everything was working and functioning properly before they finished the job. After this electrical work was completed Mr. ******** then made a complaint to the City of ********** regarding his electric issue. He never made an additional complaint to our office. The city reached out to us and I sent our maintenance staff to check on it and he refused them entry stating "he didn't want them, he wanted an electrician."   In late October we received a letter from Mr. ******** requesting to be let out of the lease early and to get his deposit back prior to leaving the unit.  I responded via letter on October 30th,  that he could break the lease early but would not receive his security deposit until he had moved out to ensure if any damages had occurred we were protected.  I have been awaiting his response and had not heard anything else regarding this until I received the BBB complaint in the mail today. Also as a side note there are 12 units in that building and we have not had any other tenants make any maintenance requests regarding electrical issues.

      I did not refuse entry to maintenance, I stated I didn't know what they could do as the problem they are intentionally ignoring probably requires an electrician. I also asked them to check the smoke detectors, which they did. If they do not intend to return my deposit before we schedule a move out, I will live out the lease. However, I do not believe they are acting in the best interest of the community.
