    On July 27, 2024, we executed a contract to (1) remove the concrete patio in my backyard, (2) correct the grade of the concrete, (3) replace the concrete with 4000 psi plain cement concrete and #8 wire mesh, and (4) seal the surface of the patio at my residence located at ** ***** ****** ****** ** *****. As consideration for this contract, I paid the sum of $2,800.00 via check, with half being paid as a down payment on the day of the execution of the contract, July 27, 2024, and the balance being paid upon completion, October 23, 2024. Pursuant to Section Three of the contract, requiring extra charges due to an increase in the complexity of the work, we paid an additional $100.00 for the work required for the concrete surrounding our flower beds. This was reflected in our final payment dated October 23, 2024. On December 21, 2024, only fifty-nine (59) days after the completed your work, I discovered three (3) cracks, averaging approximately six (6) feet in length each. The same day, I attempted to contact the company via text message at the business number we had previously used for communication, informing them of the cracks and requesting them to contact me. I received no response. On December 23, 2024, I again attempted to contact via two (2) separate phone calls, leaving a voicemail each time informing them of the cracks in the concrete and requesting them to contact me. After receiving no response, I then contacted via online messaging at the business ******** page, “Steve Burling Concrete and Excavating” requesting the same. I still received no response. I then sent an email at the business email address. The manifestation of cracks in the concrete only fifty-nine (59) days after it was laid is a breach of the implied warranty of workmanship and constitutes a breach of contract. As such, I am entitled to the cost of repairing the defects.

    The business would not answer phone calls, emails, or letters, until I sent him a certified letter. After that, the owner showed up at my door to check the status of the job and stated, "It's worse than I thought." However, when I asked if he would fix it, he told me that if I wanted anything done about it, I would need to sue the concrete manufacturer, because they are to blame. He refused to take any responsibility for any of it, and became angry when I suggested that he should. I asked that he give me the name of the manufacturer, but he stated, "I'm not telling you nothing." The issues from the original complaint still stand as is.
