    Response to Complaint ******** Filed by *******************

    Mr. **** contends that he is not liable for the debt due to *********** ********** contends that Mr. **** is liable for the debt. There is a dispute. Mr. **** contends that he has not received the underlying Contract /Agreement. ********** represents that the docusign agreement is in the possession of Mr. ***** In addition, we are attaching a copy of the Agreement hereto.


    American Financial is a third-party collection agency. We were engaged by ********** to recover the monies due from Mr. ***** Our Agreement is with ********** not Mr. ***** Accordingly, we are unable to satisfy his request for our Agreement with him as one does not exist.


    At the request of **********, American Financial reported this receivable to the credit bureaus. Since the claim is disputed, we properly reported the claim as disputed. We are unable to change this reporting without direction from *********** If Mr. **** has evidential matter to support his claim, we would be happy to present this information to ***********


    As a Desired ******** Mr. **** indicates Other (requires explanation). I would be happy to listen to Mr. ***** He can reach me at the office **************************  or by email **************************

    I am rejecting this response because: American Financial Management has failed to show proof of a contract between me and American financial management. There is still a collection from American financial management on my credit report even though we have no contract between us. Therefore I demand the collection to be removed due to failure of providing a contract with American financial management

    The initial response covers Mr. ****** concerns. We incorporate that response herein. American Financial is a third-party collection firm. We credit report the ********** receivables at their direction. We do not have an Agreement with Mr. ************** suggest Mr. **** contact *********** or any of the other consumer reporting agencies to get a better understanding of how credit reporting works.     I called and talked to ******************* to make payment arrangements. I authorized him to take $100. And to make reoccurring payments on the 16th of each month until balance was satisfied. He took the entire balance from my bank account. He overdraft my account by $600.

    We have thoroughly investigated this matter. Apparently, there was a miscommunication.  The collection agent, *******************, asked if Mr. ******** intended to " clear the balance" and Mr. ******** responded affirmatively.  ************** therefore put through a charge for the remaining balance. Mr. ******** thought he was authorizing a payment for $100.00.

    As a result of the above, Mr. ******** immediately contacted our office for a "balance adjustment".  Upon receiving credit for the above payment, AFM   made certain that the above transaction was reversed.

    We subsequently contacted Mr. ******** to assure his satisfaction with the handling of this matter. He was. In fact, he indicated that he contacted the BBB to have the complaint withdrawn, but was told that the complaint could not be withdrawn.

    American Financial Management is not the original creditor; the original creditor is Logicallease LLC. The customer has since contacted AFM claiming they never signed the lease, when provided with a copy of the lease the customer then files an EOSCAR dispute stating they are victims of a natural disaster (no further information about the disaster was provided) we then received another EOSCAR Dispute stating they where just starting a new business and where having financial issues. We are certain that the reporting is accurate.

    We had contact with the customer on 9-01-22 when he claimed he did not sign the lease, we then forwarded a copy of the signed lease via email on 09-09-22 ... 15 of 36 payments were made by the customer. We then received the aforementioned EOSCAR Dispute on 10-18-22 (natural disaster victim) We then received a 2nd EOSCAR dispute on 11-18-22 claiming information is inaccurate.  Again, the file is closed in our office however everything indicates our reporting is correct. if the customer would like to discuss directly, we us, we would be happy to receive the call and attempt to resolve.
